And whereas, in confequence of the fyftem of de fence which it may be expedient to adopt for the fecurity of the territorial poffeffions of his Highnes Maha Rajah Myfore Kifina Rajah Oodiaver Behauder, it may be neCellary that certain forts and frong places within his Highness's ferritories, Should be dismantled or deftroyed and that other forts and strong places fhould be streng thened and repaired, it is flipulated and agreed, that the English East India Company fhall be the fole judges of the necefity of any fuch alterations in the fortrelles. And it is further agreed that fuch expences as may be incurred on this account, shall be borne and defrayed, in equal proportion, by the contrailing parties. 1

Et comme en confequence du fyfteme defenfif forteref qu'il pourrait être convenable d'adopter pour la fureté es dedes poffeffions territoriales de fa Hauteffe Maha Rajah autres a Myfore Kitna Rajah Oodiaver Behauder il pourrait être neceffaire que de certaines fortereffe, et places fortes for le territoire de fa Hauteffe foient démantelées ou démolies et que d'autres fortereffes et places fortes foient fortifiées et reparées, il eft ftipulé et convenu que la Comp. Anglaife des Indes Orientales fera feule juge de la neceffité de tels changemens dans les for tereffes. Et il eft convenu de plus, que les fraix qui pourraient être occafionnés de ce chef feront fupportés o et payés en proportion égale par les parties contractantes.

ART. X. A

It being expedient, for the restoration and perma nent eftablishment of tranquillity in the territories now fubjected to the authority of his Highness Maha Rajah Myfore Kiftna Rajah Oodiaver Behauder, that fuitable provifion fhould be made for certain officers of rank ins the fervice of the late Tippoo Sultaun, his Highness agrees to enter into the immediate difcuffion of this point, and to fis the amount of the funds (as foon as the necellary infor mation can be obtained) to be granted for this purpose, in a feparate article to be hereafter added to this treaty.

ART. XII.

Left the garrison of Seringapatam should, at any time, be fubject to inconvenience from the high price of provifions and other neceffaries, his Highnefs Maha Rajah Myfore Kiftna Rajah Oodiaver Behauder agrees, that fuch quantities of provifions, and other neceffaires, as may be required for the ufe and confumption of the troops compofing the faid garrison, shall be allowed to enter the place, from all and every part of his domi nions, free of any duty, tax, or impediment, whatever.

The contraling parties hereby agree to take into their early confideration the best means of eftablishing fuch a commercial intercourse between their respective dominions, as shall be mutually beneficial to the subjects of both governments, and to conclude a commercial treaty, for this purpose, with as little delay as possible.

ART. XIV.

His Highnes Maha Rajah Mysore Kistna Rajah Dodiaver Behauder, hereby promifes to pay, at all times, the utmost attention to fuch advice as the English govern ment fhall occafionally judge it neceffary to offer to him, with a view to the economy of his finances, the better collection of his revenues, the adminiftration of justice,: the extenfion of commerce, the encouragement of trade. agriculture, and industry, or any other objets connected with the advancement of his Highness's interests, the
