On motion of Senator Walker, the Senate adjourned until 9:30 o'clock to-morrow morning.

The journal of yesterday read and approved.

Senator Wear asked leave of absence for Senator Oliver until Monday.

Senator Baldwin offered the following resolution:

Resolved, That the Secretary inform the House that the Senate is organized and ready to meet with the House in joint session, at such time as it may please the House, for the purpose of opening and publishing the returns of the votes given for Governor, Lieutenant Governor, Secretary of State, State Auditor, State Treasurer, AttorneyGeneral and Railroad Commissioner, as required by the Constitution and laws of this State; which was read.

Senator Yancey offered the foliowing amendment:

And the votes cast for and against an amendment to the Constitution of this State concerning the Judicial Department; which was read.

Senator Baldwin raised the point of order, that the amendment was out of order, which point of order was by the President sustained.

Senator Yancey appealed to the Senate from the decision of the President.

The Senate sustained the decision of the President.

Senator Simrall offered the following substitute for the resolution of Senator Baldwin:

Resolved, That the Senate shall immediately repair to the Hall of the House of Representatives to meet the House of Representatives

in joint session, to open and publish the returns of the votes given at the November election, 1881, for Governor, Lieutenant-Governor. Secretary of State, State Auditor, State Treasurer, Attorney-General and Railroad Commissioner; which was read.

The President ruled the substitute out of order.

Senator McGinnis offered the following substitute:

Resolved, That the Secretary of the Senate be, and he is hereby directed to respectfully inform the House by message, that this body cannot meet with the House for the purpose of witnessing the canvass of the return of votes for Judge of the Supreme Court and for the First Constitutional Amendment, for the reason that the General Assembly has no authority to canvass those returns. But that the Senate is ready at any time, which may suit the convenience of the House, to attend in joint session to witness the opening of returns of the vote for Governor, Lieutenant-Governor, Secretary of State, State Auditor, State Treasurer, Attorney-General and Railroad Commissioner, as provided by section 3, article 5 of the Constitution of the State, and section 5517 of the Revised Statutes of Missouri; which was read and agreed to.

A message was received from his excellency, the Governor, through his private secretary, Mr. Farr.

The President informed the Senate that he had received a communication from the Governor that required an executive session. On motion of Senator McGinnis, the Senate went into executive session.

On motion of Senator Edwards, the vote to go into executive session was reconsidered.

The following message was received from the House of Representatives, through the Chief Clerk, Mr. Bentley:

Resolved, That the Senate be requested to return the resolution inviting them to meet with the House for the purpose of casting up and declaring the vote for certain State officers; which was read.

On motion of Senator Edwards the Secretary was instructed to return the message.

On motion or Senator Edwards the Senate went into executive session.

At 10:30 the Senate resumed regular session.

Senator Allen introduced Senate bill No. 1, entitled "An act to repeal section 4193 of chapter 79 of the Revised Statutes of the State of Missouri, 1879, entitled 'Of banking-illegal currency,"" which was read first time and ordered printed.

Senator Farris called up his resolution offered on yesterday in regard to the appointment of clerks, etc., which was read second time and adopted.

Senator Hunter presented remonstrance against submission of a prohibitory amendment to constitution from citizens of Scott county; which was referred to Committee on Constitutional Amendments.

Senator Baldwin presented a petition in relation to text books for schools; which was referred to Committee on Education.

Senator Gideon presented remonstrance against submission of a prohibitory amendment to the constitution from citizens of Greene county; which was referred to Committee on Constitutional Amendments.

Senator Edwards presented remonstrance against submission of a prohibitory amendment to the constitution from citizens of St. Charles county; which was referred to Committee on Constitutional Amendments.

Senator Ryors presented remonstrance against submission of a prohibitory amendment to the constitution from citizens of Franklin county; which was referred to Committee on Constitutional Amendments.

Senator Parcher introduced Senate bill No. 2, entitled "An act to repeal section 6880, as amended by act approved March 29, 1883, and enact a new section in lieu thereof and to amend sections 6879, 6881, 6882, 6885 and 6886, all of article 8, chapter 145 of the Revised Statutes of Missouri of 1879, entitled Of assessment and taxation of railroads, which was read first time and 50 copies ordered printed.

Senator Gideon introduced Senate bill No. 3, entitled "An act to appropriate money for the redemption of union military bonds held for redemption, by W. R. Watts of Christian county, Mo." which was read first time and 50 copies ordered printed.

Senator Ryors introduced Senate bill No. 4, entitled "An act to amend section 1902, chapter 24, article 18, in relation to challenging

jurors in criminal cases," which was read first time and 50 copies. ordered printed.

Senator Yancey introduced Senate bill No. 5, entitled An act to amend an act entitled Au act to amend section 1167 of chapter 23, article of the Revised Statutes of Missouri of 1879,' approved March 16, 1881, entitled Of courts of record," which was read first time, rules suspendel and ordered not printed.

The following message was received from the House of Representatives, through the Chief Clerk, Mr. Bentley, which was read:

MR. PESILENT-I am instructed by the House to inform the Senate that the House is now organized by the election of John M. Wood, Speaker; W. R. Goodykoontz. Speaker pro tem.; Wm. P. Bentley, Chief Clerk; J. E. Crumbaugh, Assistant Chief Clerk; James A. Turner, Enrolling Clerk; Hezekiah Purdom, Engrossing Clerk; Joseph F. Marsh, Sergeant at Arms; Ennis C. Thomas, Doorkeeper; Ed. S. Vance, Official Reporter and T. M. Cobb, Chaplain; and I am instructed by the House of Representatives to notify the Senate that the House has adopted the following resolution:

Resolved, That the Chief Clerk be requested to notify the Senate that the House is fully organized and ready to proceed under section 5517 of Missouri Statutes, to open and publish the late election returns. of Governor, Lieutenant-Governor, Secretary of State, State Auditor, Attorney-General, State Treasurer and Railroad Commissioner, and the Senate is respectfully invited to meet in the hall of the House immediately and publish said returns.

In conformity with the foregoing request of the House, the Senate, on motion of Senator Jacobs, proceeded to the hall of the House of Representatives for the purpose of publishing the returns of election for State officers.

On reassembling, a message was received from his excellency, Governor T. T. Crittenden, through his secretary, Mr. Farr.

Senator Edwards presented a communication from Hon. R. T. Davis, late Senator, which was read.

The President announced that the communication from the Governor required an executive session.

On motion of Senator Elwards the Senate went into executive session at 11:45.

At 12:15 the Senate resumed regular session.

Senator Downing moved that when the Senate adjourn it adjourn. until 9:30 to-morrow morning. Adopted.

On motion of Senator Downing the Senate adjourned.

To the Honorable the President of the Senate of Missouri:

SIR-As required by law, I have the honor to inform your honorable body that at an election held on the sixth day of January, A. D. 1885, in the Second Senatorial District of this State, to fill the vacancy caused by the resignation of the Hon. Randolph T. Davis, Waller Young was elected to fill said vacancy and as Senator from said district, as appears from the returns in my office of said election.
