Los dichos Cónsules tendrán poder requerir el ausilio de las Autoridades. locales para prision, detencion y custodia de los Desertores de ques nacionales y particulares de su Pais, y para e objeto se dirijirán á los Tribunales, Jueces, y iciales competentes; y pedirán los dichos Desertores escrito, probando por una presentacion de los Retros de los Buques, Roll del Equipage ú otros cumentos públicos, que aquellos hombres eran parte las dichas tripulaciones; y esta demanda así proa (menos no obstante cuando se probare lo conrio) no se recusará la entrega. ART. XXXI. Con objeto de protejer mas eficasente su comercio y navegacion las 2 Partes Conatantes convienen, que tan luego como lo permitan circunstancias formarán un Convenio Cónsular que clarará especialmente las facultades y prerogativas los Cónsules y Vice-Cónsules de las Partes res tivas. ART. XXXII. Y en el caso de que alguna ó algunas personas cojidas por los Indios que habitan los Territorios de cada una de las Partes Contratantes, fuere ó hubiere ido llevada á los Territorios de la otra, ambos Gobiernos se comprometen y obligan del modo mas soemne á devolverlas á su Pais tan luego como sepan que se hallan en sus respectivos Territorios ó entrearlas al Agente ó Encargado del mismo Gobierno ue las reclame, dándose aviso oportuno reciprocaente, y abonándose por el que lo reclame los gasos erogados en la conduccion y manutencion de tal jersona ó personas aquienes entretanto se dispensará por los Autoridades Locales del punto en que se encuentren la mas generosa hospitalidad. The United States of Ameri and the United Mexican States, desiring to ma as durable as circumstances will permit, the r tions which are to be established between the Parties by virtue of this Treaty or general Co vention of Amity, Commerce, and Navigati have declared solemnly, and do agree to the lowing points: P First. The present Treaty shall remain a be of force for 8 years, from the day of the change of the Ratifications, and until the end year after either of the Contracting Parties sh have given notice to the other of its intention terminate the same; each of the Contracting ties reserving to itself the right of giving notice to the other at the end of said term years. And it is hereby agreed between them, on the expiration of 1 year after such notice sh have been received by either of the Parties fr the other Party, this Treaty, in all its parts lating to commerce and navigation, shall all gether cease and determine, and, in all those par which relate to peace and friendship, it shall permanently and perpetually binding on both Contracting Parties. Secondly. If any one or more of the Citi of either party shall infringe any of the Artic. of this Treaty, such Citizens shall be held perso ally responsible for the same; and the harmon and good correspondence between the 2 Nation shall not be interrupted thereby; each Party enga sing, in no way to protect the offender, or sanctio such violation. Thirdly. Los Estados Unidos de América los Estados Unidos Mexicanos, deseosos de hacer a permanentes como lo permitan las circunstancias relaciones que van á establecerse entre las 2 Partes virtud de este Tratado ó Convenio general de Amis, Comercio, y Navegacion, han declarado solemmente, y convienen en los puntos siguientes: Primero. El presente Tratado permanecerá y tará en todo su vigor y fuerza por el término de años, que deberan contarse desde el dia del camde las Ratificaciones, y terminados estos contiara rigiendo hasta el término de un año contado sde el dia en que alguna de las 2 Partes Contrates haya dado noticia á la otra de su resolucion poner fin á este convenio. Y cada una de las artes Contratantes se reserva asi misma el derecho dar este aviso á la otra, al cabo del referido térno de 8 años, quedando ademas convenido entre abas que al cabo de un año despues de recibido tal so por alguna de las Partes Contratantes de parte la otra, este Tratado deberá cesar y acabar en do cuanto tiene relacion con comercio y navegacion, edando solo permanente y perpetuamente valedero obligatorio á ambas Partes Contratantes en todo anto toca á la paz y amistad entre ambas. Segundo. Si uno ó mas Ciudadanos de alguna las Partes infringiere algun Artículo de este Trado, será personalmente responsable de ello: pero por esto se interrumpirá la armonia y buena corspondencia entre las 2 Naciones; á cuyo fin ambas spectivamente se comprometen á no protejer al gresor, ni sancionar semejante infraccion. Tercero. Si (lo que no es de esperar) alguno e los Artículos del presente Tratado desgraciadaente fuere violado ó infringido de cualquiera otro modo se estipula que ninguna de las Partes Contraantes dispondrá ó autorizará ninguna clase de represalia, ni declarará guerra á la otra por queja de in Z |
