1831 tenciario de la República de Chile, Don Miguel Zañartu, Enviado Extraordinario cerca del Gobierno del Perú, y Oficial de la Lejion de Merito; arreglen y conclugan un Tratado Definitive de Paz y de Amistad, como en efecto, despues de reconoscidos y conjeados sus respectivos Plenos - Poderes, han convenido en el siguiente:

ART. I. Habrá paz inalterable y amistad constante y sincera, entre las Republicas de Bolivia y del Perú, y entre los Ciudadanos de uno y de otro Estado.

ART. II. La fuerza numérica total y absoluta del Ejército de la República Boliviana, será de 1,600 hombres de todas armas, y la del de la República Peruana de 3,000 hombres, tambien de todas armas.

ART. III. Ninguna de las 2 Repúblicas podrá aumentar su Fuerza armada á mas del número seña lado en el Articulo anterior, sin dar á la otra espli caciones claras y terminantes de las causas que la ob ligan á hacerlo.

ART. IV. En el término de 6 meses, contados desde el dia de la aprobacion de este Tratado, Bolivia disminuirà 500 hombres, y en el mismo termino, el Perú rebajará 1,000, de las Fuerzas que actualmente conservan, conforme al Tratado Preliminar de Tiquina

ART. V. Dos meses, despues de obtenida la Rati ficacion Constitucional do este Tratado, estará verifi cada par los 2 Gobiernos, la reduccion de Fuerzas de que habla el Articulo II.

ART. VI. Mientras se verifica la reduccion de que hablan los Articulos II. y V, los Ejércitos de ambas Repúblicas conservarán los acantonamientos, que les fuéron assignados en el Articulo VI. del Tratado Preliminar da Tiquina.

ART. VII. Si per disgracia la República Peruana tuviese motivos de diferencia con alguna otra del Continente, Bolivia prestará su mediacion para que se transijan amigablemente; lo mismo hará la República Peruana respecto de la de Bolivia, cuando so halle en iguales circunstancias.

ART. I. There shall be unalterable peace, and constant and sincere amity, between the Republics of Bolivia and Peru, and between the CitiTens of the 2 States.

ART. 11. The total and absolute numerical force of the Army of the Bolivian Republic, shall be 1,600 men, of all arms, and that of the Army of the Peruvian Republic 3,000 men, also of all arms.

ART. 11. Neither of the 2 Republics shall ugment its armed Force beyond the number menoned in the preceding Article, without giving he other clear and definite explanations of the auses which oblige it so to do.

ART. IV. Within 6 months, reckoning from he day of the approval of this Treaty, Bolivia hall reduce 500 men, and, within the same term, Peru shall reduce 1,000 of the Forces which they ctually retain agreably to the Preliminary Treaty f Tiquina.

ART. V. Two months after the Constitutional Ratification of this Treaty shall have been obtaind, the reduction of the Forces mentioned in the Ind Article shall be carried into effect by the 2

overnments.

ART. VI. Until the reduction mentioned in he 11nd and Vth Articles shall be carried into ffect, the Armies of both Republics shall remain n the cantonments which were assigned to them in the VIth Article of the Preliminary Treaty of Tiquina.

ART. VII. If infortunately the Peruvian Republic should have grounds of difference with any other State of the Continent, Bolivia shall lend its mediation for the amicable settlement of them: the same shall be done by the Peruvian Republic with respect to that of Bolivia, should the latter find itself so circumstanced.

ART. VIII. Los Peruanos en Bolivia, y los Bolivianos en el Perú, serán garantidos en sus derectios civiles, de la misma manera que lo están por las respectivas Constituciones, los Naturales de cada uno de los 2 Estados.

ART. IX. Los Bolivianos en el Perú, y los Peruanos en Bolivia, se declarán exentos del servicio de armas, y de las contribuciones estraordinarios que las Leyes de una y otra Nacion tongan á bien imponer á sus respectivos Ciudadanos.

ART. X. Ninguna de las 2 Repúblicas podrá intervenir, directa ó indirectamente, ni hajo pretesto al guno en los negocios intériores de la otra: cada Estado obrará en ellos como juzgue conveniente á sus intereses,

ART. XI. Ninguna de las 2 Partes Contratantes dará asilo en su Territorio à los famoses ladrones, á los asesinos alevosos, á los incendiarios, ni á los falsos monederos; cuilquiera de estes criminales, que « acojiere à buscarlo, será devuelto al Pais donde per pétro el crimen, tan luego como sea reclamado por e Ministerio de Relaciones Estériores, con un testimo nio autentico de la sentencia definitiva, que se hubiese pronunciado contre él.

ART. XII. Ninguno de los Gobiernos de Bolivia y del Perú permitirá que los asilados en su Territorio por opiniones politicas, ò por hechos que hayan re sultado de ellas, attaquen la seguridad pública del Pais à que pertenezcan, promoviendo sediciones desde d lugar en que residan: en tal caso el Gobierno que decubra estos manejos pedirá, con documentos que los acrediten, el que sean retirados de sus Fronteras, al lugar que ellos elijan dentro del Territorio de la República donde se hallen retujiados, y que no po diá distar de casas menos de 80 leguas.

ART. XIII. Los desertores de Bolivia al Perú, y del Perú à Bolivia, serán asilados, pero cado Estada devolverá el armamento, caballos, y equipo qui estos lleven consigo, debiendo los entregar para efecto à la primera Autoridad fronteriza del Estado à que pertenezcan.

ART. VIII. Peruvians in Bolivia, and Boli- 1831 vians in Peru, shall be guaranteed in their civilrights, in the same manner as the Natives of each of the 2 States, under their respective Constitutions.

ART. IX. Bolivians in Peru, and Peruvians in Bolivia, are declared exempt from the service of arms, and from the extraordinary contributions which the Laws of the 2 Nations may think fit to impose on their respective Citizens.

ART. X. Neither of the 2 Republics shall interfere, directly or indirectly, nor under any pretext whatever, in the internal affairs of the other: each State shall govern itself as it may deem expedient for its interests.

ART. XI. Neither of the 2 Contracting Parties shall grant an asylum within its Territory to notorious robbers, treacherous assassins, incendiaries, or forgers of false coin: any criminal of this description who shall be found within it, shall be ent back to the Country wherein the crime was committed, so soon as the Minister of Foreign Relations shall claim him, and produce authentic proof of the difinitive sentence that has been pronounced against him.

ART. XII. Neither of the Governments of Bolivia and Peru shall permit those who have taken refuge in its Territory for political opinions, or for acts which may have resulted from them, to menare the public safety of the Country to which they belong, by promoting sedition from the place at which they reside: in such case, the Government that shall discover the intrigues against it, may require, on the production of documents substantiating the facts, that they be removed from its Frontiers, to such place as they may select, within the Territory of the Republic in which they have taken refuge, and which shall not be at a less distance from the Frontiers than 80 leagues.

ART. XIII. Deserters from Bolivia to Peru, and from Peru to Bolivia, shall receive asylum; but each State shall restore the arms, horses, and equipments which they carry with them, and deliver them for that purpose to the first frontier Authority of the State to which they belong.

ART. XV. Los individuos de tropa Peruanos, enrolados en el Ejército de Bolivia, y los Bolivianos en el del Perú, podrán restituirse à su Patria, tan luego como manifiesten legalmente voluntad de hacerlo

ART. XVI. Se nombrará por ambos Gobiernos. una Comision, destinada á levantar la Carta topogra fica de sus Fronteras; y otra que forme la estadistica de los Pueblos situados en ellas, à fin de que sin detrimento de los 2 Estados, puedan hacerse reciprocamente las cesiones, que sean necesarias para una exacta y natural demarcacion de Limites: estos deberán ser ríos, lagos, ó montañas; en el supuesto de que ni Bolivia ni el Perú se negarán á hacer las enajenaciones que fueren convenientes para satisfacer este ob jeto, á condicion de prestare mutuamente las compe tentes indemnizaciones, ó compensaciones, que sean satisfacion de ambas Partes.

ART. XVII. Entretanto tenga lugar el compli miento del Articulo anterior, se reconocerán y respetarán les actuales limites.

ART. XVIII. Los creditos que se presenten por cada uno de los 2 Estados, serán liquidados y reconocidos por 2 Comisarios Bolivianos y otros 2 Peruanos, nombrados por sus respectivos Gobiernos. Si estos Comisarios no convinieren sobre la justicia, ójitimadad de alguno ó algunos de sus cargos, se suje tarán à la resolucion de un Arbitro. Desde ahora ambos Gobiernos nombran y reconocen en calidad de tal al de los Estados Unidos de Norte América, cuyo consentimiento solicitarán oportunamente.

ART. XIX. Si por desgracia sobreviniere algun dia mala intellijencia, interrupcion de amistad, ó ruptura, entre las Repúblicas de Bolivia y del Perú, los Ciudadanos de cada una de ellas que se encuentren en el Territorio de la otra, tendrán el derecho de permanecer alli, y de continuar sus negocios, sin que puedan ser turbados de manera alguna, en tanto que se composten pacificamente.
