Acte d'adhésion des plénipotentiaires de S. M. Sarde à la déclaration du congrès de Vienne; du 17 De cembre 1814

Les fouffignés, plénipotentiaires de S. M. le Roi de

Sardaigne au congrès de Vienne, en vertu des pleins pouvoirs de leur fouverain, qu'ils ont préfentés d'après l'invitation portée par la déclaration qui a été publiée le INovembre dernier par les puiffances fignataires du traité de Paris du 30 Mai année courante et le Marquis de SaintMarfan en particulier, en vertu d'un pleinpouvoir spécial le plus ample de Sa dite Majefté le Roi de Sardaigne, pour négocier, convenir et accepter toutes les conditions relatives à la réunion des états de Gênes à ceux de S. M. qu'il préfente en original, donnent, par le préfent acte, adhéfion formelle, entière et fans reftriction aux conditions renfermées dans les trois annexes ci-jointes, qu'ils ont fignées à cet objet, et qui font entièrement conformes aux pièces annexées à l'extrait du protocole de la féance du 12 du courant que M. le prince de Metternich a adreffé aux fouffignés.

Ils adhèrent, au nom de leur fouverain, avec ces conditions, à la réunion des départemens formés par l'an cienne république de Gênes aux autres états de S. M. (agrandiffement dont l'objet eft d'établir une jufte répartition de forces en Italie qui en affure le repos) et témoignent à ces hautes puiffances la reconnoiffance de leur fouve

Un quatrième projet des plénipotentiaires, concernant les fiefs impériaux tendait à garantir à S. M. Sarde la poffeffion des fiefs fusdits en invitant le Roi de Sardaigne à étendre aux dits pays les immunités que S. M. a accordées à fes fujets Génois le projet ayant fubi quelque modification dans le protocole da 12 Décembre ci-dellus, c'eft probablement pour quoi l'acte d'adhésion de S. M. Sarde ne parle que de trois

annexes.

1814 fouverain, foit pour la réunion fusdite, foit pour la marque de confiance qu'ils lui donnent en le faifant mettre tout de fuite en poffeffion de fes nouveaux états.

Ils confentent à la réferve appofée, et relativement aux fiefs impériaux faifant partie de la cidevant république Ligurienne, et qui fe trouvent maintenant fous l'adminiftration du gouvernement de Gênes, dont les puiffances ont déclaré vouloir fe réferver la dispofition et à ce qu'ils ne foient occupés et adminiftrés que provifoirement par le gouvernement du Roi, qui fera établi à Gênes jusqu'au traité définitif, en déclarant toutefois qu'ils n'entendent préjudicier aucunement par là les droits que S. M. fe réferve de faire valoir. En foi de quoi ils ont figné le préfent acte, et chacune féparement des trois annexes et y ont appofé le sceau de leurs armes. i

Les lettres patentes du Roi de Sardaigne, publiées lors de la prife de poffeffion des Etats de Gênes qui a eulieu le 7 Janvier 1815 font datées du 30 Déc, 1814 et quant aux priviléges qui y font renfermés pour les Génois, entièrement conformes au projet d'articles placé plus haut p. 86. n. 2. a. Elles le trouvent dans le Journal de Francfort 1815 n. 20., comme auffi la Proclamation du Roi du 3 Janvier 1815 s'y trouve

In the Name of the most Holy and Undivided Trinity.

His Britannick Majefty and His Royal Highness the

Prince Regent of Portugal, being equally defirous to terminate amicably all the doubts which have arifen relative to the parts of the coaft of Africa with which the fubjects of the Crown of Portugal, under the laws of that Kingdom and the Treaty fubfifting with His Britannick Majefty, may lawfully carry on a Trade in Slaves: and whereas feveral fhips, the property of the faid fubjects of Portugal, have been detained and condemned, upon the alledged ground of being engaged in an illicit Traffic in Slaves; and whereas His Britannick Majefty, in_order_to_give to His intimate and faithful Ally the Prince Regent of Portugal, the moft unequivocal proof of His friendship and the regard Hepays to His Royal Highness's reclamations, and in confideration of regulations to be made by the Prince Regent of Portugal for avoiding hereafter fuch doubts, is defirous to adopt the most speedy and effectual meafures, and without the delays incident to the ordinary forms of law, to provide a liberal indemnity for the parties whofe property may have been fo detained under the doubts as aforefaid; in furtherance of the faid object, the High Contracting parties have appointed as

1815 their plenipotentiaries. viz; His Majesty the King of the United Kingdom of Great Britain and Ireland, the Right Honourable Robert Stewart Viscount Caftlereagh, Knight of the moft Noble Order of the Garter, a Member of His faid Majefty's moft Honourable Privy Council, a Member of Parliament, Colonel of the Regiment of Militia of Londonderry, His faid Majefty's Principal Secretary of State for Foreign Affairs, and His plenipotentiary at the Congrefs of Vienna; and His Royal Highness the Prince Regent of Portugal, the moft Illuftrious and moft Excellent Dom Pedro de Soufa Holftein Count of Palmella a Member of His Royal Highnefs's Council, Commander of the Order of Chrift, Captain of a Company of the Royal German LifeGuard; the most Illuftrious and moft Excellent Anthony de Saldanha da Gama, a Member of His Royal Highnefs's Council, and of His Council of Finance, Commander of the Military Order of St. Benedict of Aviz; and Dom Joachim Lobo de Silveira Member of His Council, and Commander of the Order of Christ, His plenipotentiaries at the Congrefs of Vienna; who, having mutually exchanged their full powers, found in good and due form, have agreed upon the following Articles *):

ART. I. Que la fomme de trois cent mille livres fera payée à Londres à telle perfonne que le Prince Régent de Portugal fixere pour la recevoir; laquelle fomme formera un fonds à employer, fous de tels arrangemens et de telle manière que le dit Prince Régent de Portugal fixera pour la décharge des réclamations pour vailleaux Portugais détenus par des armateurs Anglais avant le Juin 1814 par le motif allegué d'avoir exercé un commerce illioite d'efclaves.

ART. II. Que la dite fomme fera confidérée comme une pleine decharge de toutes les prétentions prove. nani de captures faites antérieurement au 1 Juin 1814; Sa Majesté Britannique renoncant à toute intervention quelconque relative à la dispofition de cette fomme.

ART. III. La préfente convention sera ratifiée et les ratifications feront échangées dans l'efpace de cinq mois ou plutôt s'il eft poflible.

ART.

ART. I. That the fam of three hundred thaufand 1815 pounds be paid in London, to fuch perfon as the Prince Regent of Portugal may appoint to receive the fame; which fum fhall conftitute a Fund to be employed under fuch regulations and in fuch manner as the faid Prince Regent of Portugal may direct, in discharge of claims for Portuguese ships detained by British cruizers previous to the first day of June, one thaufand eight hundred and fourteen, upon the alledged ground of carrying on an illicit traffic in Slaves.

ART. II. That the faid fum fhall be confidered to be in full difcharge of all claims arifing out of captures made previous to the first day of June, one thanfand eight hundred and fourteen; His Britannick Majefty renouncing any interference whatever in the disposal of this money.

ART. III. The prefent Convention shall be ratified, and the Ratifications fhall be exchanged in the space of five months, or fooner if poffible. In witness whereof the refpective plenipotentiaries have figned it, and have thereunto affixed the feals of their arms.

Done at Vienna this twenty-firft day of January, in the year of our Lord one thoufand eight hundred and fifteen.
