"(b) The Director shall (1) develop plans for the formulation and execution of foreign information programs utilizing the Agency's overseas posts and all media designed to promote an intelligent understanding abroad of the status of the emergency within the United States and the efforts, policies, activities, needs, and aims of the United States in dealing with the international situation then existing; (2) develop emergency plans and programs, and emergency organizational structures required thereby, as an integral part of the continuing activities of the United States Information Agency on the basis that it will have the responsibility for carrying on such programs during an emergency; (3) provide and maintain the capability necessary for simultaneous direct radio broadcasting in major languages to all areas of the world, and wireless teletype to all United States Embassies; (4) provide advice to the executive branch on foreign opinion, and its implications for United States policies, programs, and official statements; (5) maintain liaison with the information agencies of friendly nations for the purpose of relating the United States Government information programs and facilities to those of such nations; (6) participate in the development of policy with regard to the psychological aspects of defense and develop plans for assisting the appropriate agencies in the execution of psychological operations with special attention to overseas crises short of war; (7) maintain United States Information Service staffs abroad for the conduct of public information for all agencies of the Government, recognizing that in a theater of operations the United States Information Agency would make available to the appropriate Commander all United States citizen personnel on the staff of the Agency, who agree to remain, to serve in support of psychological operations; and (8) lend appropriate support in psychological warfare to the military command in the theater or theaters of active military operations, and provide daily guidance and basic informational materials.

"(c) The Director shall insure development of appropriate plans necessary under this Part and issue emergency instructions required to implement all appropriate plans developed under this Part.”.

SEC. 20. (a) Executive Order No. 11522 of April 6, 1970, and Executive Order No. 11746 of November 7, 1973, are hereby superseded.

(b) Section 7 of Executive Order No. 11556 of September 4, 1970, is hereby superseded.

By virtue of the authority vested in me by the Migration and Refugee Assistance Act of 1962, as amended (Chapter 36 of Title 22 of the United States Code), and section 301 of title 3 of the United States Code, and as President of the United States

of America, Section 1 of Executive Order No. 11077 of January 22, 1963, is hereby amended by adding thereto the following:

“(d) Funds appropriated or otherwise made available to the President for the United States Emergency Refugee and Migration Assistance Fund established by Section 2(c) of the act (22 U.S.C. 2601) shall be deemed to be allocated without further action of the President to the Secretary of State, and the Secretary may allocate or transfer, as appropriate, such funds to any agency, or part thereof, for obligation or expenditure consistent with the provisions of this order, the act, and other applicable law: Provided, That such funds may not be transferred, obligated, or expended until the President shall have made the determinations provided for in Section 2(c) (1) of the act, which determinations are reserved to the President, and the designations and determinations provided for in Section 2(b)(2) of the act.”.

The Honorable Francis E. Meloy, Jr. and Robert O. Waring

As a special mark of respect to the memory of The Honorable Francis E. Meloy, Jr., Ambassador of the United States of America to the Republic of Lebanon, and Robert O. Waring, Economic Counselor of our Embassy in Lebanon, both killed while in the performance of their duty, it is hereby ordered, pursuant to the provisions of Section 4 of Proclamation 3044 of March 1, 1954, as amended, that on Monday, June 21, 1976, the flag of the United States shall be flown at half-staff on all buildings, grounds, and naval vessels of the Federal Government in the District of Columbia and throughout the United States and its Territories and possessions. I also direct that the flag shall be flown at half-staff on the same day at all United States embassies, consular offices, and other facilities abroad, including all military facilities and naval vessels and stations.

Exemption of Arthur S. Flemming From Mandatory Retirement

Arthur S. Flemming, Commissioner on Aging, Department of Health, Education, and Welfare, and Chairman, Commission on Civil Rights, became subject to mandatory retirement for age on June 30, 1975, under the provisions of Section 8335 of Title 5 of the United States Code unless exempted by Executive Order. Dr. Flemming was exempted from mandatory retirement until June 30, 1976, by Executive Order No. 11869 of June 24, 1975.

In my judgment, the public interest requires that Arthur S. Flemming continue to be exempted from such mandatory retirement.

NOW, THEREFORE, by virtue of the authority vested in me by subsection (c) of Section 8335 of Title 5 of the United States Code, I hereby exempt Arthur S. Flemming from mandatory retirement until June 30, 1977.

By virtue of the authority vested in me by section 5711(b) of Title 10 of the United States Code, and as President of the United States of America and Commander in Chief of the Armed Forces, Executive Order No. 11554 of August 29, 1970, as amended, is further amended by deleting "June 30, 1976” and inserting in lieu thereof "September 30, 1978".

The Vice Presidential Service Badge

July 19, 1976

By virtue of the authority vested in me as President of the United States of America, and as Commander in Chief of the Armed Forces of the United States, it is hereby ordered as follows:

SECTION 1. There is established a Vice Presidential Service Badge to be awarded in the name of the Vice President of the United States of America to members of the Army, Navy, Marine Corps, Air Force, and Coast Guard who have been assigned to duty in the Office of the Vice President for a period of at least one year subsequent to December 19, 1974.

SEC. 2. The Vice Presidential Service Badge may be awarded, upon recommendation of the Military Assistant to the Vice President, by the Secretary of the Army, the Secretary of the Navy, the Secretary of the Air Force, or, when the Coast Guard is not operating as a service in the Navy, the Secretary of Transportation, to military personnel of their respective services who have been assigned to duty in the Office of the Vice President.

SEC. 3. The Vice Presidential Service Badge shall be accompanied by a certificate, the design of which is attached hereto and is made a part of this Order. The Vice Presidential Service Badge shall consist of a white enameled disc surrounded by 27 gold rays radiating from the center, 115/16 inches in diameter overall. Superimposed on the white disc shall be a gold color device taken from the seal of the Vice President of the United States. The overall design of the badge shall be as shown at the top of the certificate which accompanies the Badge and which is attached to this Order.

SEC. 4. Upon award, the Vice Presidential Service Badge may be worn as a part of the uniform of an individual both during and after his assignment to duty in the Office of the Vice President.

SEC. 5. Only one Vice Presidential Service Badge shall be awarded to an individual. It may be awarded posthumously.

SEC. 6. Notwithstanding the provisions of Sections 1 and 2 of this Order, any member of the Army, Navy, Air Force, Marine Corps, and Coast Guard, who has been assigned to duty in the Office of the Vice President, is authorized to wear the Vice Presidential Service Badge on his uniform commencing on the first day of duty in the Office of the Vice President and thereafter while assigned to such duty.

SEC. 7. Executive Order No. 11544 of July 8, 1970, is hereby superseded; however, individuals previously awarded a Vice Presidential Service Badge under that Order are authorized to continue to wear such badge as part of their uniform.
