Senator Phelan moved to amend section four by striking out the fourth subdivision thereof; which was not agreed to.

Senator Murray offered the following:

Amend by striking out the words "and Messenger," wherever they occur in the fourth subdivision; which was agreed to.

The fifth section was then read.

Senator Read moved to fill the blank by inserting "$2."

Senator Young moved to amend by inserting "$3;" which was not agreed to.

Senator Mosby moved to amend by inserting "$2.50;" which was agreed to.

The bill, as amended, was read a second time and ordered to be engrossed.

The President laid before the Senate a petition from the St. Louis, Iron Mountain and Southren Railroad Company; which was read, and, on motion of Senator Pope, referred to Judiciary Committee.

By Senator Burkeholder: Senate bill No. 15, entitled An act entitled an act to amend section 21, chapter 144, General Statutes of Missouri, in regard to service of subpoenas; read first time.

By Senator Wilson: Senate bill No. 16, entitled An act permitting defendants or the husband or wife of the accused to testify in criminal cases; read first time.

By Senator Pope: Senate bill No. 17, entitled An act to amend section 2, chapter 15 of the General Statutes of Missouri, the same being section 2 of chapter 129 of Wagner's Missouri Statutes, for the

purpose of directing the Secretary of State to place certain copies of Wagner's Statutes of Missouri, and hereafter the Revised Statutes in the library for the use of the General Assembly during its sessions, and to repeal said section as it now stands; read first time.

By Senator Parrish: Senate bill No. 18, entitled An act to provide for and regulate continuance in civil and criminal cases, and to repeal all acts and parts of acts inconsistent therewith; read first time.

By Senator Phelan: Senate bill No. 19, entitled An act to amend chapter 89 of the General Statutes, entitled "Of Savings Banks and Fund Companies; " read first time.

By Senator Wallace: Senate bill No. 20, entitled An act to amend section 9, chapter 169, General Statutes of Missouri, being section 9, article 9, chapter 110, Wagner's Missouri Statutes; read first time.

By Senator Wear: Senate bill No. 21, entitled An act entitled an act to amend section 14 of chapter 56 of Wagner's Statutes; read first time.

Senator Thompson, on leave, introduced Senate joint and concurrent resolution No. 7, entitled A resolution concerning the archives in the office of the United States records of land titles in Missouri; read first time.

House concurrent resolution No. 5, Providing for a joint committee for the revision of the laws, was taken up, pending the consideration of which, on motion of Senator Perkins, the Senate adjourned.

AFTERNOON SESSION.

Senate met pursuant to adjournment.

A quorum present.

The Senate resumed the consideration of House concurrent resolution No. 5.

Senator Murray offered the following amendment:

Amend by striking out all after the word "that," in the third line, and inserting in lieu thereof as follows:

A commission of three, to be composed of ex-Governor Charles. H. Hardin, ex-Justice David Wagner and Hon. Willard P. Hall, who shall have authority to revise the statutes of this State of a general character, as required by the 41st section of the 4th article of the Constitution; and that in case of a vacancy the Governor shall have power to fill same; that the compensation of said commissioners shall not exceed dollars, and that said commission shall report their work to the Governor ninety days before the assembling of the next General Assembly of this State, to be by the Governor laid before that body, with such comments and recommendations as to him may seem proper.

After debate, Senator Claiborne moved the previous question, which was seconded, and the question being, "Shall the main question be now put?" The same was decided in the negative, and the resolution and amendment laid over until to-morrow under the rule.

The Senate then proceeded to the consideration of the joint rules for the government of both Houses as adopted by the House, and reported to the Senate for its action.

Senator Wallace moved that the rules be read seriatim, and passed upon section by section. Carried.

The same was considered by sections and adopted, and, on motion of Senator Read, referred to Committee on Printing.

Senator Wear moved that when the Senate adjourn, it adjourn to Monday morning at ten o'clock; the motion was not agreed to.

Under the rule Senate bills on second reading were disposed of as follows:

Senate bill No. 13; referred to Committee on Claims.

Senate bill No. 12; referred to Committee on Criminal Jurisprudence.

Senate bill No. 11; referred to Committee on Judiciary.

To HON. HENRY C. BROCKMEYER, Lieut. Governor and President of Senate: SIR: I herby acknowledge the receipt of a copy of a resolution adopted by the Senate, requiring me to furnish each Senator, for use during this session of the General Assembly, with a copy of Wagner's Statutes.

I have given to each committee of the Senate and House a copy of Wagner's Statutes for use during the present session; this leaves in my custody just eleven copies for general use.

Senator Morrisson called up the resolution authorizing each of the following committees to employ a clerk: On Judiciary, Criminal Jurisprudence, Ways and Means, Banks and Corporations, Education, Internal Improvements, Penitentiary and Accounts.

The question being on the amendment of Senator Young to include the Committees on Insurance and Printing,

Senator Thompson offered an amendment to strike out the Committee on Printing, and insert the Committee on Engrossing and Printing. Agreed to.

The ayes and noes were then called on the amendment of Senator Young as amended by Senator Thompson, and the amendment was lost by the following vote:

AYES-Senators Ake, Claiborne, Major, Morrisson, Murray, Phelan, Thompson, Wear, Wilson and Young-10.

NOES-Senators Abney, Biggs, Coleman, Edwards of Lafayette, Flood, Hudson, Mosby, Parrish, Parsons, Paxton, Perkins, Pope, Read, Rubey, Seay, Shelby, Wallace and Wight-18.

The ayes and noes were then taken on the question of the adoption of the original resolution, and the resolution was lost by the following

Senator Seay offered the following resolution:

Resolved, That the chairmen of all the committees be and they are hereby permitted to employ clerks, when the services of the same may be needed, and shall have full authority to discharge such clerk or clerks for incompetency, or when his or their services can be dispensed with.

Senator Rubey moved to amend by inserting after the words "employ clerks," the words "with the consent of the Senate;" the amendment was agreed to.

Senator Read offered the following substitute to Senator Seay's resolution :

That the chairmen of the standing committees be authorized to employ two clerks, one who shall attend each session of the various committees, etc.

Senator Major moved to refer motion and amendments to a special committee; which was not agreed to.

On motion of Senator Thompson, the substitute offered by Senator Read was laid on the table.

Senator Wight offered the following resolution:

Resolved, Whenever any committee of the Senate unanimously recommend the appointment of a clerk for their committee, then they shall be authorized by the Senate to employ such clerk; the motion was agreed to.

Senator Morrisson moved that the vote by which the joint rules for the government of the Senate and House of Representatives passed, be reconsidered; which was agreed to.

Senator Thompson moved that when the Senate adjourn, it adjourn until Monday morning at ten o'clock; the motion was not agreed to. Leave of absence was granted Senator Hudson.

On motion of Senator Perkins, the Senate adjourned.

MORNING SESSION.

Senate met pursuant to adjournment.

Senator Phelan offered the following resolution:

Resolved, That when the Senate adjourn, it adjourns to meet Monday morning, at 10 o'clock; which was agreed to.

The President announced the additional appointments on the Committee on Ways and Means: Senators Edwards of Lafayette and Young.

Leave of absence granted Senators Flood and Thompson.

The President laid before the Senate sealed depositions on behalf of Senator Wallace, in the matter of the contest for the seat in the Senate of the Twenty-ninth General Assembly from the Twenty-first Senatorial District, between Senator Wallace and James L. Rush, of Laclede.

On motion of Senator Perkins, the papers were referred to the Committee on Elections.

Senator Rubey, from the Cominittee on Printing, submitted the following report:

MR. PRESIDENT: Your Committee on Printing, to whom was referred

Senate resolution, entitled Resolution in relation to employing clerk, beg leave to report that they have considered the same, and recommend that it do not pass.
