House concurrent resolution No. 9, entitled Concurrent resolution in regard to the special tax imposed by Congress on leaf tobacco, was taken up and read first time.

Senator Edwards of St. Charles, from the Committee on Engrossed Bills, submitted the following report:

MR. PRESIDENT: Your Committee on Engrossed Bills, to whom was referred Senate bill No. 64, entitled An act to amend section 1 of chapter 154 of General Statutes, the same being section 1 of chapter 134 of Wagner's Statutes, in relation to trusts and trustees, beg leave to report that they have considered the same, and find it to be truly engrossed, and that the printed copies thereof furnished to the Senators are correct.

Senator Thompson moved that the Senate now resolve itself into executive session. Carried.

Senate resumed regular session at 10:30 o'clock.

Senator Abney laid before the Senate a memorial from the Patronsof Husbandry; which was referred to the Committee on Ways and. Means.

Senator Morrisson, from the Committee on State University, submitted the following report:

MR. PRESIDENT: Your Committee on the State University, to whom was referred Senate bill No. 47, entitled An act to repeal sections 22: and 31, and to amend section 41 of chapter 45 of title 16 of the General Statutes of Missouri, in relation to the State University, and to create a Board of Curators for said University, as required by the Constitution of 1875, prescribing their duties, have considered the same, and instructed me to report the same to the Senate with the accom. panying substitute, and to recommend that the substitute do pass. T. J. O. MORRISSON, Chairman.

The substitute, as reported by the committee, was read and. adopted, and on motion of Senator Lakenan, laid over until Tuesday next, at 10 o'clock.

Senator Wilson, from the Committee on Criminal Jurisprudence,. submitted the following report:

MR. PRESIDENT: Your Committee, to whom was referred the resolution to inquire as to the acceptance and use of free passes, etc., on railroads by the Railroad Commissioners of the State, beg leave to report that they have considered the same, and submit the accompanying report; and having fully discharged the duties devolved upon them by the resolution, your committee reco.nmend that no further action is necessary in the premises.

Which was read.

Senator Phelan moved the report of the Committee be received. Carried.

Senator Wight moved that 50 copies of the report be printed for the use of the Senate.

Senator Rubey moved to amend the motion to print, as follows:

Resolved, That the report be recommitted to the Committee, with instructions to examine the Commissioners, or others, upon the following interrogatories, to wit:

First-Have either of the Commissioners ever traveled upon any railroad in the State, since the adoption of the new Constitution, without paying the full fare as usually charged by such road, or roads, to other travelers; and,

Second-Whether they, or either of them have, in said time, ever traveled on any such roads free of charge, when not directly, and only in the discharge of other official duties.

The amendment was lost.

The question recurring upon the motion of Senator Wight to print 50 copies of the report, it was agreed to.

Senator Wilson, from the Committee on Criminal Jurisprudence, submitted the following report:

MR. PRESIDENT: Your Committee on Criminal Jurisprudence, to whom was referred Senate bill No. 49, entitled An act to protect government lights and lighthouse stations on the navigable waters of this State, beg leave to report that they have considered the same, and recommend that the accompanying substitute do pass.

Senator Wilson, on leave, introduced Senate bill No. 114, entitled An act to amend section 2, and to repeal section 13 of chapter 153 of the General Statutes; read first time.

Senator Wilson, on leave, introduced Senate bill No. 115, entitled An act authorizing the Warden of the Penitentiary to hire out unemployed convicts on the line of the Pacific Railroad and its branches, to work in coal mining; read first time.

Senator Claiborne introduced Senate bill No. 116, entitled An act to better regulate fire insurance companies doing business in the State of Missouri; read first time.

Senator Flood introduced Senate bill No. 117, entitled An act to amend section 1 of an act entitled an act to amend sections 29, 31, 36, 39, 46, and 51 of an act entitled an act for the incorporation and regulation of life insurance companies, approved March 10, 1869, the same being sections 29, 31, 36, 39, 46, and 51 of article 2 of chapter 76 of Wagner's Statutes of the State of Missouri, entitled insurance," Life," approved March 28, 1874; read first time.

Senator Parrish introduced Senate bill No. 118, entitled An act to provide for the drainage and reclamation of swamp and overflowed lands, and for the protection of lands bordering on rivers; read first time.

Senator Burkeholder, from the Special Committee appointed to visit the Industrial Home of Orphans' and Indigent Children, made report, which was received, and 50 copies ordered printed.

Senator Thompson called up Senate bill No. 1, it being the special order for 2 o'clock.

Amendment No. 1, as reported by Committee of the Whole, as fol

lows: Amend by striking out third section and insert the following: "Each of said commissioners shall receive for his services the sum of $250 per month for the time actually employed, which shall not be for a longer period than twelve months; was read first and second time and adopted.

Amendment No. 2, as reported by Committee of the Whole, as follows: Amend section 5, by inserting after the words "who shall cause," the following: "Such parts of said report as may relate to the practice in civil and criminal cases," so that said section shall read, as follows: Sec. 5. Said commissioners shall report to the Governor, every two months, such portions of their work as they have completed, and the Governor shall file such report in the office of Secretary of State, who shall cause such parts of said report as may relate to the practice in civil and criminal cases to be printed and distributed as the laws and journals are printed and distributed; was read first and second time.

Senator Lakenan moved to amend the amendment recommended by Committee of the Whole, by inserting after the words "criminal cases in section 5, in lieu of the words "the laws in relation to the revenue, common school and roads and bighways."

The amendment to the amendment was adopted, and the amendment as amended rejected.

Amendment No. 3, to "strike out section 6," read and adopted.

Senator Terry moved to amend by adding a new section, as follows: Section 6. Said Board of Commissioners may employ a clerk, with a salary not exceeding $100 per month for the time actually employed.

The amendment was adopted.

Senator Burkeholder moved to amend by inserting the word "regular" before the word "session," in line next to last line in section 2. The amendment was rejected.

Senator Pope moved to amend section 1, by striking out all after the figure "1," and insert in lieu thereof, the following: (-) and (-) and ( (- .) are hereby appointed and constituted a commission whose duty shall be to prepare for adoption and promulgation, a revision and digest of the general laws of this State, and of such other laws as are herein provided to be revised.

The amendment was not agreed to.

Senator Phelan moved to amend by adding to the end of section 5, as follows: "Provided, The printing, binding and press-work, shall not exceed the sum of $2,000."

Amendment adopted.

Senator Rubey moved to amend by striking out section 5; not agreed to.

The bill as amended was then ordered to engrossment.

Senator Wight introduced Senate bill No. 119, entitled An act to provide for the levy of a special tax to create a sinking fund for the payment of county bonded indebtedness; read first time.

Senator Rubey offered the following resolution:

Resolved, That the Committee on Penitentiary be, and it is here. by instructed to report a bill revising and amending the laws now in force in regard to the management of the State Penitentiary, and among other necessary changes, provide necessary rules for the general conduct of said institution, and fixing the monthly pay of all officers and employees.
