Senator Paxton introduced Senate bill No. 120, entitled An act to incorporate association for the mutual protection of its members against loss by fire; read first time.

Senator Pope introduced Senate bill No. 121, entitled An act to provide for the safe keeping of ballot-boxes and ballots, appertaining to elections, in other places than in the office of the clerk of the county court, as provided in section 1 of an act entitled an act to amend section 15 of chapter 2 of the General Statutes, concerning popular elections, approved March 3, 1875; read first time.

On motion of Senator Lakenan, the Senate adjourned.

Senator Rubey presented a memorial from the Macon county bar, asking amendments to practice act; which was referred to the Judiciary Committee.

The President laid before the Senate a communicatien from Prof. Schweitzer, of the State University, relating to a bill introduced in the House, in regard to fixing the "fire test" of petroleum oils; referred to Committee on Printing.

Senator Thompson from Judiciary Committee, submitted the following report:

Senator Morrisson moved to amend the pending bill by striking out all after the enacting clause of the same. Lost.

A message was received from the Governor, through his private secretary, Mr. Massey.

Senator Morrisson moved to amend the pending bill by striking out the words "more than five miles," in the seventh line thereof.

The vote was taken and a quorum not voting, Senator Thompson moved a call of the Senate. Carried.

The roll was called, and the following Senators answered to their

On motion of Senator Thompson, further proceedings under the call were dispensed with.

The message from the Governor requiring secrecy, on motion of Senator Phelan, the Senate at 11:10 o'clock, went into executive session.

At twenty minutes past eleven o'clock the Senate resumed regular session.

The question being upon amendment No. 1, as reported by the Judiciary Committee, to Senate bill No. 98, as follows: amend section 1 by striking out the following words in the second line of said section: "or by any executor, administrator, guardian, curator, commissioner or trustee;" it was adopted.

The second amendment as reported by the committee as follows: amend by striking out the word "five" in the seventh line of section 1, and inserting in lieu thereof the word "fifty;" was read and adopted.

The third amendment, as follows: amend section 1 by striking out in the twelfth line, after the word " provided," all of the words of said section, and insert in lieu thereof the following words: "that the surety shall not limit his liability for a less sum than one-fifth of

the principal of penalty of said bond;" was read first and second time and adopted.

Amendment No. 5, as follows: "Amend by striking out sections 2, 3, 4, 5, 6, 7, 8 and 9 of said bill;" was read first and second time.

Senator Thompson moved to amend the amendment by striking out figure or word" 2." The amendment to the amendment was agreed to, and the amendment as amended adopted.

Amendment No. 5, as follows: amend title of the bill by striking out all the words after the word "officers" in second line thereof; read first and second time and adopted.

The question being upon ordering the bill to engrossment, Senator Ballingal moved to lay the bill over informally. Lost.

Senator Rubey moved that the Senate adjourn. Lost.

Senator Edwards of St. Charles, moved the previous question. Carried.

The main question was then put, and the bill was not ordered to engrossment, by the following vote:
