Ordered, That the bills be sent to the House of Representatives for concurrence. The resolution from the House of Representatives, viz:

Resolved, by the Council and House of Representatives of the Territory of Wisconsin, that the Secretary of this Territory be authorized to provide proper seals for the use of the several Judges of Probate, and of the Clerks of the boards of county commissioners of this Territory, having been read,

Mr. Arndt moved that the Council concur therein; which was agreed to.

Bill No. 43, (H. R. file,) entitled "A bill to incorporate the stockholders of the North-west Mining Company," was read a first and second time, and ordered to be committed to a committee of the whole.

A message from the House of Representatives, by the Clerk thereof;

Mr. President,-The House of Representatives have agreed to all the amendments made by the Council to bill No. 77, entitled "A bill to organize the county of Walworth, and to establish the seat of justice thereof," except the following, viz: to strike out in the seventh line of section 2 the words "qualified voters," and insert "male inhabitants of the age of twenty-one years, who are actual residents of the said county, and have complied with the regulations of the different claim committees."

The amendments made by the Council to bill No. 42, entitled "An act to incorporate the town of Green Bay," were severally agreed to, except the following, viz; insert after the word "age" in the second section the words " and being a citizen of the United States," which was amended as follows; strike out the words "a citizen," in the second line of the second section, and insert in place thereof, the word" citizens."

The House of Representatiues have receded from all their amendments made to No. 18, (C. file,) entitled "A bill for opening and repairing or vacating public roads and highways to which the Council had disagreed, except the following, viz: in section 56, line 5, strike out "privileges," and insert "liabilities," which was adhered to.

The House requests a conference on the said disagreement and have appointed Messrs. Sholes and Engle a committee to confer with a similar committee to be appointed by this House.

I am further directed to inform you that the House of Representatives, have adhered to the first amendmennt to each of the following bills, and have receded from the second, (to which the Council had disagreed,) viz: to bill No. 41, (Council file,) entitled "A bill concerning grand and petit jurors;" 1st amendment, strike out all after the word "Gospel" in the 13th line, to the word "gates" in the 47th line inclusive; 2nd amendment, in the 6th line of the 4th section strike out the words "of America" after the words "United States."

To bill No. 61, entitled "A bill to change the corporate powers of the village of Milwaukee." 1st amendment-in the fourth line of section twelve, strike out "twenty-five to forty," and insert "sixteen to twenty-four;" 2nd amendment -add a new section to the bill, to be called sec. 20.

The House of Representatives have passed a memorial and bills of the following titles, viz:

Memorial to Congress praying for an appropriation to construct a road from Prairie du Chien to the northern boundary line of Missouri, on the west side of the Mississippi river;

No. 131, A bill to prevent trespass and other injuries being done to the possessions of settlers on the public domain, and to define the extent of the right of possession on said lands;

No. 114, A bill to incorporate the city of Burlington;

No. 51, A bill to incorporate the Davenport Manual Labor College;

In which bills I am directed to ask the concurrence of this House;
And then he withdrew.

The amendment of the House of Representatives to the amendment of the Council to bill No. 42, (H. R. file,) entitled A bill to incorporate the borough of Green Bay," was read and concurred in.

The message from the House of Representatives, notifying the Council that they had receded from all their amendments to bill No. 18, entitled "A bill for opening and repairing, or vacating public roads and highways, which had been

disagreed to by the Council, except the following, viz: in the fourth line of the 56th section, to strike out "privileges," and insert "liabilities" in place thereof, was read, and

On motion of Mr. Arndt,

Ordered, That the Council recede from the disagreeing vote thereto.

The amendment of the Council to bill No. 77, (H. R. file,) entitled “A bill to organize the county of Walworth, and to establish the seat of justice thereof," viz in the seventh line of the second section to strike out the words "qualified voters," and insert "male inhabitants of the age of twenty-one years, who are actual residents of the said county and have complied with the regulations of the different claim committees ;" to which the House of Representatives had disagreed, having been read,

Messrs. Knapp and Irwin were appointed the committee of conference on the part of the Council relative thereto,

The message from the House of Representatives, notifying the Council that they adhere to their amendment made to bill No. 41, (Council file,) entitled "A bill concerning grand and petit jurors," and which had been disagreed to by the Council, viz; to strike out in the first section as follows; "officers of colleges (not including trustees or directors thereof,) and preceptors and teachers of incorporated academies or universities, and one teacher in each common school, practising physicians and surgeons regularly licensed, licensed ferrymen, supervisors of public highways, attenders of grist mills, attenders of toll bridges and turnpike having been read,

On motion of Mr. Arndt,

Ordered that the Council insist upon their disagreeing vote thereon, and that a committee of conference be requested.

Messrs. Arndt and Sweet were appointed the committee of conference on the part of the Council relative thereto.

Mr. Arndt moved to adjourn; which was disagreed to-ayes 5, noes 7.
The ayes and noes being called for,

Those who voted in the affirmative are, Messrs. Arndt, McCraney, Smith, Teas, Inghram, (Pres't.)

Those who voted in the negative are, Messrs. Brigham, Foley, Irwin, Knapp, McCraney, McKnight, Terry.

Bill No. 54, (H. R. file,) entitled "A bill to authorize the board of county commissioners of the county of Jackson to build a bridge and levy a tax to pay for the same," was read a first and second time, and ordered to be committed to the committee of the whole.

On motion of Mr. Knapp, bill No. 112, (H. R. file,) entitled "A bill to establish the boundaries of the counties of Lee, Van Buren, Des Moines, Henry, Louisa, Muscatine and Slaughter, and for other purposes,' was taken up. Mr. Teas moved to refer it to a select committee.

The motion was disagreed to.

The Council thereupon resolved itself into a committe of the whole, Mr. Arndt in the chair for the consideration of said bill.

After some time the committee arose and reported the bill without amendment.

The report of the committee having been received,

Mr. Teas moved to amend the third section of the bill as follows: Strike out all after the words "to the place of beginning," and insert in place thereof and the seat of justice of said county shall be located by three disinterested commissioners, who shall take into consideration the present and future population of said county, and make the location as near the centre thereof as a suitable site may be had; and when the location aforesaid shall be made, it shall be the duty ot the said commissioners to certify the same to the board of county commissioners, who shall record the said return; and the place so selected shall be the seat of justice for the county of Des Moines ;" Which was determined in the negative-ayes 4, noes 8.

The ayes and noss being called for; those who voted in the affirmative are, Messrs. Smith, Sweet, Teas, Inghram, Pres't.

Those who voted in the negative are, Messrs. Arndt, Brigham, Foley, Irwin, Kapp, McCraney, McKnight, Terry.

The bill was then ordered to be read a third time on to-morrow.

And then the Council adjourned.

FRIDAY, January 12, 1838.

The President presented the account of George W. Kelley for sheet iron, for the use of the Council.

Read and referred to the committee on Public Expenditures.

Mr. Brigham, from the committee on Eurolment, reported the following to be correctly enrolled, viz:"

An act to abolish imprisonment for debt, and for other purposes:

An act defining the boundaries of Portage county, and for other purposes;

An act to locate and establish a Territorial road from fort Howard to fort Winnebago, on the west side of Fox river, and for other purposes;

An act for the benefit of the towns of Belleview and Peru, in the original county of Du Buque ;

A memorial to Congress for the relief of Jeremiah Smith;

A memorial to Congress for an appropriation for a road from Racine to the Mississippi river; and,

An act to divorce Louisa Ann Sibley from Wm. T. Sibley.

Mr. Teas moved that the Council do now reconsider the vote of yesterday, by which the further consideration of bill No. 13, (H. R. file,) entitled "A bill to incorporate the Rochester and Des Moines Hydraulic and Manufacturing Company" was postponed, which was agreed to.

Mr. Terry, from the select committee, to which was referred bill No. 87, (H. R. file,) entitled "A bill to organize the county of Green, and to extend the boundaries thereof," reported the same back again to the Council with amend

ments.

The amendments were received; and the bill was read a second time and ordered to be considered in committee of the whole, Mr. Irwin in the chair. The committee arose and reported the bill as amended by the select committee.

The bill was then ordered to be read a third time.

On motion of Mr. Terry,

Ordered, That the 16th rule be suspended, in order that the bill may be read a third time now.

The bill was then read a third time and passed.

The title of the bill having been read, Mr. Brigham moved to amend the same, by striking out the words" and to extend the boundaries thereof;" which was agreed to.

Ordered, That the House of Representatives be informed accordingly.
Mr. Sweet, by leave submitted the following:

Resolved, That the Secretary of the Council be instructed to call upon the House of Representatives for the report of the commissioners appointed to superintend the public buildings at Madison, Dane county; and also the report of the acting commissioner of the same board of Commissioners;

Which was adopted.

Bills from the House of Representatives, viz:

No. 110, A bill to establish the Philandrian College in the town of Denmark, Des Moines county;

No. 116, A bill to incorporate the several seminaries herein named ; No. 131, A bill to prevent trespass and other injuries being done to the possessions of settlers on the public domain, and to define the extent of the right of possesion on the said lands;

No. 114, A bill to incorporate the city of Burlington ;

No. 51, A bill to incorporate the Davenport Manual Labor College;
Were severally read a first and second time, and committed as follows:
Nos. 110, 116, 114, and 51, to the committee of the whole.

No. 131, to select committee, consisting of Messrs. Sweet, Irwin and Teas. The memorial from the House of Representatives, entitled "A memorial to Congress praying for an appropriation to construct a road from Prairie du Chien to the nothern boundary line of Missouri, on the west side of the Mississsippi river" was read and concurred in.

The amendment by the House of Representatives to bill No. 61, entitled "A bill to change the corporate powers of the village of Milwaukee,” (which had been disagreed to by the Council and adhered to by the House) having been read,

Mr. Sweet moved that the Council recede from the disagreement thereto, and that the amendment be concurred in; which was agreed to.

Mr. Sweet from the select committee to which had been referred the amendments of the House of Representatives to bill No. 15, entitled "A bill for assessing and collecting county revenue," made a verbal report thereon, and returned the amendments with the bill back again to the Council.

The amendments were then read severally, and concurred in; except the following, viz:

1st amendment, sec. 1, line seventh, strike out "two hundred" and insert "seventy-five." 9th amendment, sec. 1, line eighth, after the words hundred dollars" insert" and excepting libraries, tools of mechanics, and agricultural implements." 14th amendment, sec. 9, lines nine and ten, strike out" three years" and insert "one year." 27th amendment, sec. 4, strike out "auctioneer" in the first line, and the words "public aution or," in the third and fourth lines; which were disagreed to.

The 12th amendment, viz: to strike out all after the word "made" in the fifth line of the 6th sec. to the word "and" in the eighth line thereof was amended, as follows:-retain the words "and correct all double or imperfect listing, or errors in rates, descriptions, or qualities of lands or lots" and insert above the same the words "examine the assessment rolls."

Ordered, That the Secretary acquaint the House of Representatives therewith.

A message from the House of Representatives, by the Clerk thereof: Mr. President-the House of Representatives have passed bills of the following titles:

No. 88, A bill to prevent disasters on steamboats navigating the waters within the Territory of Wisconsin;

No. 121, A bill to incorporate the town of fort Madison, in Lee county; No. 4, A bill entitled an act relating to the militia and public defence of the Territory of Wisconsin;

In which bills I am directed to ask the concurrence of this house.

I am further directed to present for your signature the following acts and memorials, which have been signed by the Speaker of the House of Representatives, viz :

An act for the benefit of the towns of Belleview and Peru, in the original county of Du Buque ;

An act to locate and establish a Territorial road from fort Howard to fort Winnebago, on the west side of Fox river, and for other purposes;

An act to abolish imprisonment for debt, and for other purposes;

An act establishing a county to be called Portage, defining its Territory, &c.; An act concerning debtors and their sureties;

An act to divorce Louisa Ann Sibley from her husband William T. Sibley; Memorial to Congress for the relief of Major Jeremiah Smith; and

A memorial to Congress for an appropriation for a road from Racine to the Mississippi river.

The House of Representatives has concurred in the following memorial, viz: Memorial to Congress for a donation of " inundated land" in Illinois, to be sold, and the proceeds to be applied to the making of roads and bridges through the same; and also, in the amendment of the Council to the amendment of the House to a resolution respecting the printing of the laws passed at the present session of the Legislative Assembly.

And then he withdrew.

The President signed the acts and memorials referred to in the foregoing

message.

Bill No. 62, entitled "A bill for the punishment of the crime of bribery," was considered in committee of the whole, Mr. Sweet in the chair.

The committee arose, and reported the bill with an amendment.

The amendment was concurred in, and the bill was ordered to be engrossed for a third reading.

The Council resolved itself into a committee of the whole for the consideration of bill No. 63, entitled “A bill to locate and establish the several Territorial roads therein named," Mr. Knapp in the chair.

The committee arose, after some time, and reported the bill with an amend

ment.

The amendment was concurred in, and the bill was ordered to be engrossed for a third reading.

On motion of Mr. Arndt, the Council adjourned until 3 o'clock, P. M.

THREE O'CLOCK, P. M.

The President announced a communication from the Governor, notifying the Council that he did, on yesterday, examine and approve the following acts,

An act to amend an act, entitled an act, to incorporate the Fox River Hydrau

lic Company;

An act to amend an act, entitled an act, to incorporate the La Fontaine Rail Road Company;

An Act to authorize John Dowling and James Sproule to erect a toll bridge across the West Fork of the Pekatoneka river; and

An act to incorporate the Root River Rail Road Company.

Bill no 22, (H. R. file) entitled "A bill to prevent and punish gambling," was considered in committee of the whole, Mr. Teas in the chair.

The committee arose and reported the bill without amendment, and it was ordered to be read a third time on to-morrow.

Mr. Brigham, from the committee on Enrolment, reported the following to have been presented to the Governor for his approval, viz:
