Mr. Brigham from the committee on Enrolment, reported the following, as having been presented to the Governor for his approval, viz:

An act to amend an act, entitled "An act to incorporate the Portage Canal Company," passed by the Legislative Council of the Territory of Michigan, and approved March 7th, 1834.

An act to render legal the acts of the county commissioners of the counties of Clayton and Du Buque.

Resolution to authorize the purchase of three hundred copies of Maj. Cooper's book on Tactics, for the use of the militia of this Territory.

Bills from the House of Representatives, viz:

No. 17, A bill to annul the marriage contract of Jonathan J. King and Abigail King, his wife; and,

No. 18, A bill to authorize James Clayborn to keep a ferry across the Mississippi river, at the town of Camanche, were read a first and second time, and ordered to be committed to the committee of the whole House.

The Council then resolved itself into committee of the whole, Mr. Knapp in the chair, for the consideration of the said bills; and, after some time the committee arose and reported unfavorably on bill No. 17, and bill No. 18, without amendment.

And the question being first taken on disagreeing to the report of the committee on bill No. 17, it was decided in the negative-ayes 6, noes 6.

Those who voted in the affirmative are, Messrs. Arndt, Irwin, McCraney, Sweet, Teas, Terry.

Those who voted in the negative are, Messrs Brigham, Foley, Knapp, McKnight, Vineyard, Inghram, (Pres't.)

So the report of the committee was concurred in.

The question was then put on agreeing to the report of the committee on bill No. 18, and pending the same,

On motion of Mr. Sweet, the ninth line of the first section was amended by inserting the word "by" before the word "law."

The bill was thereupon ordered to a third reading.

Mr. Sweet moved that the Council do now proceed to the consideration of the resolution relative to printing three hundred copies of the report of the committee to examine into the affairs and condition of the Miners' Bank of Du Buque. And pending the question thereon,

On motion of Mr. Knapp, the Council adjourned.

THURSDAY, June 21, 1838.

The minutes of yesterday were read and corrected.

Message from the House of Representatives by the Clerk thereof.

Mr. President-The House of Representatives have passed the following resolution and bill, viz:

A resolution on the subject of making the apportionment for the Territory, for the east side of the Mississippi.

Bill No. 20, A bill to establish the seat of justice of Scott county, in which bill and resolution I am directed to ask the concurrence of this House.

And then he withdrew.

Mr. Teas presented the petition of citizens of the county of Van Buren, praying that Thomas C. Pickett may be divorced from his wife.

Mr. Sweet moved the reference of the petition to the committee on the Judiciary.

Mr. Foley moved to amend the motion so as to refer the petition to the committee on Incorporations.

The motion to amend was disagreed to; and the question then being on the motion to refer to the committee on the Judiciary, it was also disagreed to. The petition was then read, and,

On motion of Mr. Arndt,

Ordered, That the same be laid on the table.

Mr. Sweet offered the following, viz:

Resolved, That a committee of three be appointed who are hereby authorized and required to inquire into and examine the affairs of the Wisconsin, Mineral Point, and Milwaukee Banks; and the said committee shall have power to hold their sessions at such times and such places as may be determined upon by a majority of their board; and said committee are hereby empowered to send for persons and papers for the purpose of carrying into effect the object before named; and may appoint a clerk to serve said board and remove the same at pleasure; and all reports, documents, and testimony introduced before the committee shall be carefully preserved and laid before this Council, together with the report of the said committee at full length at the meeting of the next session of the Legislative Assembly; and the committee shall be appointed from the members residing on the east side of the Mississippi river, in this Territory.

And pending the question thereon, the following message was received from the House of Representatives, by the Clerk thereof:

Mr. President-I have been directed by the House of Representatives to request the Council to furnish to the House of Representatives all papers, &c. in relation to the Miners' Bank of Du Buque other than the report of the joint committee on that subject.

The amendments made by the Council to bills No. 7, 15, and 9, (H. R. file,) have been concurred in by the House of Representatives, the latter with an amendment to the amendment, in which the concurrence of this House is requested.

And then he withdrew.

The Council resumed the consideration of the resolution, and pending the question on the adoption of the same, while debating said motion, Mr. Sweet was called to order by the President, for introducing matters irrelevant to the subject before the Council.

The decision of the President was appealed from, and pending the question, "will the Council sustain the President in his decision?"

Mr. Vineyard moved to adjourn until 3 o'clock this afternoon, which was determined in the affirmative-ayes 8, noes 4.

The ayes and noes being called for,

Those who voted in the affirmative are, Messrs. Brigham, Foley, Irwin, McKnight, Smith, Teas, Vineyard, Inghram, (Pres't.)

Those who voted in the negative are, Messrs. Arndt, Knapp, Sweet, Terry. So the Council adjourned.

THREE O'CLOCK, P. M.

Mr. Brigham, from the committee on Enrolments, reported the following to ave been presented to the Governor for his approval, viz:

An act enlarging the boundaries of Rock county; An act to divorce James Gilbert from Letitia Gilbert, his wife; and An act to divorce Permelia Emeline Adams from Richard Adams, her husband.

Also, that the following have been correcctly enrolled: An act to amend an act to incorporate the Root River Rail Road Company; An act organizing the county of Johnson, and establishing the seat of justice of said county; and An act to establish a ferry across the Mississippi river in the county of Muscatine, in this Territory.

The unfinished business of the morning, being the consideration of the resolution offered by Mr. Sweet, was proceeded in, and the question being put, “will the Council sustain the President in his decision?"

It was determined in the affirmative-ayes 9, noes 1.

The ayes and noes being called for,

Those who voted in the affirmative are, Messrs. Brighom, Foley, Irwin, Knapp, McKnight, Teas, Vineyard.

Mr. Arndt voted in the negative.

So the Council sustained the President in his decision.

And pending the question on the adoption of the resolution, the following message was received from the House of Representatives, viz:

Mr. President-the House of Representatives have passed bills and resolution entitled as follows:

No. 21, A bill supplementary to an act to locate and establish a Territorial road from the town of White Oak Springs, in Iowa county, to the Blue Mounds, in Dane county.

No. 22, A bill to locate a Territorial road in Grant and Iowa counties.

No. 23, A bill supplementary to an act to locate and establish a Territorial road east of the Mississippi river.

Resolution to authorize the publication of 1300 copies of certain acts in pamphlet form.

In which bills and resolution I am directed to request the concurrence of this House.

The Governor has notified the House that he did on yesterday examine and approve the following resolution and acts, entitled as follows:

Resolution to authorize the purchase of 300 copies of Major Cooper's book on tactics, for the use of the militia of this Territory.

An act to render legal the acts of the county commissioners of the counties of Clayton and Du Buque.

An act to amend an act, entitled an act, to incorporate the Portage Canal Company, passed by the Legislative Council of the Territory of Michigan, and approved March 7th, 1834.

And then he withdrew.

The question on the resolution was then determined in the affirmative—ayes 9, noes 3.

The ayes and noes having been called for, those who voted in the affirmative are Messrs. Brigham, Foley, Knapp, McKnight, Sweet, Teas, Terry, Vineyard and Inghram, (Pres't.)

Those who voted in the negative are, Messrs. Arndt, Irwin and McCraney. So the resolution was adopted.

Mr Foley moved that Messrs, Terry, Knapp and Vineyard compose the committee under said resolution.

Mr. Sweet then moved that the motion be so amended as to leave the power of appointing the committee with the President.

Which was determined in the affirmative-ayes 9, noes 3.

The ayes and Does having been called for, those who voted in the affirmative are, Messrs. Arndt, Knapp, McKnight, Smith, Sweet, Teas, Terry, Vineyard, and Inghram, (Pres't.)

Those who voted in the negative are, Messrs. Brigham, Foley and Irwin.

The President appointed Messrs. Sweet, Vineyard and Knapp the committee under said resolution.

Mr. Vineyard moved a reconsideration of the vote by which the report of the committee of the whole, on bill No 17, (H. R. file, entitled "A bill to annul the marriage contract of Jonathan J. King and Abigal King, his wife," was yesterday disagreed to.

Which was carried in the affirmative,

The President announced a communication from the Governor on executive business, which was laid on the table until to-morrow.

The President announced, also, a communication from the Governor, infroming the Council that he had approved and signed the following:

An act to divorce James Gilbert from Letitia Gilbert, his wife;

An act to divorce Permelia Emeline Adams, from Richard Adams, her husband; and

An act enlarging the boundaries of Rock county.

On motion of Mr. Foley, the Council resolved itself into the committee of the whole, Mr. Brigham in the chair, for the consideration of bill No. 2, (H. R. file,) entitled "A bill to make legal the acts of certain justices of the peace; and after some time the committee arose and reported the same without amendment. The report of the committee was concurred in, and the bill was ordered to be read a third time.

On motion of Mr. Foley,

Ordered, That the 16th of the standing rules be suspended, in order that the bill may be read a third time now.

The bill was thereupon read a third time, passed, and the title agreed to. Ordered, That the Secretary acquaint the House of Representatives therewith.

On motion of Mr. Brigham, bill No. 17, (H. R. file,) entitled "A bill to annul the marriage contract of Jonathan J. King and Abigal King, his wife," was ordered to be re-commited to the committee of the whole.

The Council resolved itself into committee of the whole, Mr. Brigham in the chair, for the consideration of said bill; and, after some time the committee arose and reported the same without amendment.

The report of the committee was received, and pending the question on agreeing thereto.

Mr. Knapp moved to lay the report on the table. The motion was disagreed to.

The report of the committee was then concurred in, and the bill ordered to be read a third time.

On motion of Mr. Sweet,

Ordered, That the 16th of the standing rules be suspended, in order that the bill may be read a third time now.

The bill was then read the third time, passed, and the title was agreed to. Ordered, That the Secretary acquaint the House of Representatives therewith.

On motion of Mr. Arndt,

Resolved, if the House of Representatives concur, that the Council will adjourn on the 23rd inst. without day.

Ordered, That the concurrence of the House of Representatives be requested thereto.

Mr. Brigham obtained leave to introduce bill No. 15, entitled "A bill postponing the next general election in this Territory."

Which was read the first and second time, and ordered to be committed to the committee of the whole.

The Council adjourned until 8 o'clock to-morrow morning.

FRIDAY, June 22, 1838.

The minutes of yesterday were read and corrected.
Mr. Foley submitted the following:

Resolved, by the Council and House of Representatives, of the Territory of Wisconsin, That Thomas S. Wilson, James Fanning, and Matthias Ham, be and they are hereby appointed commissioners to examine, and inquire into the state of the affairs and condition of the Miners' Bank of Du Buque, whose term of service shall be until the end of the next session of the Legislative Assembly, or their successors shall be duly appointed and qualified, who are hereby authorized and required to call at the banking house of said bank, and proceed to the examination of the financial concerns of said bank. Said commissioners shall make quarterly examination, and publish the same in the newspaper published at Du Buque, or; should no papers be published at the said town of Du Buque, then in the nearest paper published in the Territory. And should the said commissioners find, in their opinion, that said bank is not conducted according to the strict provisions of the charter, then, in that case, they are hereby required to call on the district attorney, for said county, and direct the said attorney to sue out a writ of injunction against said bank.

Which was adopted.

Ordered, That the Secretary request the concurrence of the House of Representatives therein.

Mr. Sweet offered the following resolution:

Resolved, That the journal of yesterday be so corrected, (on the question of order, when the member from Milwaukee was called to order,) and an appeal was taken from the decision of the Chair, as appears on the journal, so as to read "on motion of ——, an appeal was taken," and

Which was rejected.

Mr. Teas, from committee on the Library, made a report in relation thereto, and submitted a catalogue of books not in the printed list, and also a list of books missing.

On motion of Mr. Terry, the report was laid on the table.

Mr. Sweet, from the joint committee, to which the subject had been referred, made a verbal report that the committee had entered into contract with James G. Edwards, for the printing of all the laws passed at the former sessions of the Legislative Assembly, and the laws of Michigan, to be printed as an appendix thereto, and delivery of the same at fort Madison, in seventy-five days from the 30th June, inst., and submitted the bond and contract made.

The report of the committee was adopted.

The President presented a message from the Governor, on executive business; Which was laid on the table.

The President also presented the communication of James G. Edwards, proposing to publish the journal of the Council.
