On motion of Mr. Terry, the Council resolved itself into a committee of the whole, Mr. Knapp in the chair, for the consideration of the following bills, viz: bill No. 24, (H. R. file,) entitled A bill to locate a Territorial road on the east side of the Mississippi river; No. 25, (H. R. file,) entitled "A bill to locate a Territorial road in the county of Iowa;" and No. 27, (H. R. file,) entitled "A bill to amend an act regulating marriages, approved April 23rd 1834, and

After some time the commitee arose and reported the same without amendment.

The report of the committee was concurred in.

On motion of Mr. Knapp,

Ordered, That the 16th of the standing rules be suspended, in order that the bills may be put upon their final passage now.

The bills were thereupon severally read a third time, passed, and the titles agreed to.

Ordered, That the Secretary acquaint the House of Representatives therewith.

Mr. Brigham from the committee on Enrolments reported the following to have been presented to the Governor for his approval, June 23d, viz :

An act to annul the marriage contract of Jonathan J. King and Abigal King, his wife;

An act to make legal the acts of certain justices of the peace.
Message from the House of Representatives by the Clerk thereof, viz:

Mr. President-The House of Representatives have passed a resolution to authorize Jesse B. Webber to make sale of the furniture of the Legislative Assembly.

The Council concurred in the resolution.

On motion of Mr. Irwin,

Ordered, That the Council take a recess of half an hour.

The Council was called to order at 11 o'clock.

Mr. Brigham from the committee on Enrolment, reported the following to have been presented to the Governor for his approval, viz:

An act to establish the seat of justice for Scott county;

An act to authorize James Claiborn to keep a ferrry across the Mississippi river at the town of Camanche;

An act supplementary to an act to locate and establish a road from the town of White Oak Springs, in Iowa county, to the Blue Mounds, in Dane county; An act to locate a Territorial road in Grant and Iowa counties;

An act supplementary to an act to locate and establish a Territorial road east of the Mississippi river;

Also, the following to be correctly enrolled, viz:

An act postponing the next general election;

An act to authorize Alexis Phelps and Stephen S. Phelps, to establish a ferry across the Mississippi river, opposite the town of Oquawka.

On motion of Mr. Irwin,

Council adjourned to 2 o'clock, P. M.

TWO O'CLOCK, P. M.

Message from the House of Representatives, by the Clerk thereof, viz: Mr. President-I am directed to present for your signature the following acts, which have been signed by the Speaker of the House of Representatives, viz: "An act to to authorize Alexis Phelps and Stephen S. Phelps to establish a ferry across the Mississippi river opposite the town of Oquawka;"

"An act postponing the next general election in this Territory."

The House of Representatives has concurred in bill No. 12 of this Council, entitled, "A bill to district the Territory of Wisconsin into election districts, and to apportion the representation of each," with amendments; in which amendments I am directed to ask the concurrence of the Council.

The House of Representatives have adhered to the disagreement of the two Houses in relation to the resolution of the Council fixing the day of adjournment of the Legislative Assembly, and I am directed to request a conference thereon.

Messrs. Engle and McWilliams have been appointed the committee of conference on the part of the House.

And then he withdrew.

The President signed the acts referred to in the foregoing message.

The amendments of the House of Representatives to bill No. 12, entitled "A bill to district the Territory of Wisconsin into election districts, and to apportion the representation of each," were read and concurred in.

The message from the House of Representatives, notifying the Council that they adhered to their amendment to the "Resolution relative to the adjournment of the Legislative Assembly," was read.

Mr. Foley moved that the Council do recede from their disagreeing vote thereto, and that the amendment be concurred in.

Which was agreed to.

Mr. Brigham, from the committee on Enrolment, reported the following to have been presented to the Governor for his approval, viz:

An act postponing the next general election in this Territory;

An act authorizing Alexis Phelps and Stephen S. Phelps to establish a ferry across the Mississippi river, opposite the town of Aquawka.

Also, that the following were correctly enrolled, viz:

An act extending the time limited to David James for the establishment of a ferry across the Mississippi river;

An act directing the annual session of the Legislative Assembly of Wisconsin to be held at Madison, in the county of Dane.

The President announced a communication from the Governor, informing the Council that he had this day approved and signed the following, viz:

An act postponing the next general election in this Territory; and

An act authorizing Alexis Phelps and Stephen S. Phelps to establish a ferry across the Mississippi river opposite the town of Oquawka.

Message from the House of Representatives, by the Clerk thereof, viz: Mr. President-1 am direcred to present for your signature the following acts which have been signed by the Speaker of the House of Representatives, viz: An act to locate a Territorial road east of the Mississippi river;

Mr. Foley, from the committee on Enrolment, reported "An act to district the Territory of Wisconsin into election districts, and to apportion the representation of each," to be correctly enrolled.

Message from the House of Representatives by the Clerk thereof, viz:

Mr. President--The House of Representatives has passed bill No. 28, entitled "A bill to provide for the compensation of the officers of the Legislative Assembly, and for other purposes," in which I am directed to ask the concurrence of the Council.

And then he withdrew.

The bill from the House of Representatives, No. 28, entitled "A bill to provide for the compensation of the officers of the Legislative Assembly, and for other purposes," was read a first and second time, and committed to the committee of the whole, Mr. McKnight in the chair.

The committee arose after some time and reported the bill with sundry amendments, which were read and concurred in.

On motion of Mr. Terry, the 16th rule was suspended, that the bill may be read the third time now.

The bill was then read the third time, and the blanks before the word "days," wherever the same occur, was ordered to be filled with the word "fifteen." The bill was then passed, and the title agreed to.

Ordered, That the Secretary acquaint the House of Representatives therewith.

Message from the House of Representatives, by the Clerk thereof, viz: Mr. President-the House of Representatives have passed bill No. 29, entitled "A bill changing the time of the annual meeting of the Legislative Assembly"-in which I am directed to ask the concurrence of the Council.

The House has also concurred in the "Resolution relative to the Library." The Speaker of the House of Representatives has signed "An act to district the Territory of Wisconsin into election districts, and to apportion the representation of each ;" and I have been directed to present the same for your sig

nature.

And then he withdrew.

The President signed the act referred to in the foregoing message.

The act was thereupon placed in the hands of the committee on Enrolment, which, after a few minutes, by the chairman, Mr. Brigham, reported the same to have been presented to the Governor for his approval.

Bill No. 29, (H. R. file,) entitled "A bill changing the time of the annual meeting of the Legislative Assembly," was read the first time, and,

On motion of Mr. Brigham,

Ordered, To be laid on the table.

On motion of Mr. Foley,

Resolved, That five hundred copies of the bill passed by Congress, establishing the Territorial Government of Iowa, be printed for the use of the Council. On motion of Mr. Foley, the Council adjourned until 7 o'clock, P. M.

SEVEN O'CLOCK, P. M.

The President announced a communication from the Governor, on executive business.

Also, a communication, notifying the Council that he had examined and approved the following, viz:

An act extending the time limited to David James, for the establishment of a ferry across the Mississippi river;

An act directing the annual sessions of the Legislative Assembly to be held at Madison, in the county of Dane; and

An act to district the Territory of Wisconsin into election districts, and to apportion the representation of each.

Message from the House of Representatives, by the Clerk thereof, viz:

Mr. President-the House of Representatives have concurred in several of the amendments made by the Council to bill No. 28, entitled "A bill to provide for the compensation of the officers of the Legislative Assembly, and for other purposes," and have disagreed to all the remainder.

And then be withdrew.

The message from the House of Representatives was then read and considered, and,

On motion of Mr. Irwin, it was ordered that the Council do adhere to their amendment, and that a committee of Conference be requested in relation thereto.

Messrs. Irwin and Vineyard were appointed on the part of the Council.
Ordered, That the Secretary inform the House thereof.

On motion of Mr. Vineyard,

Resolved, That the Secretary of the Territory be directed to pay to Leander J. Lockwood, five dollars, additional room rent for F. J. Munger, one of the transcribing Clerks of this Council.

Message from the House of Representatives, by the Clerk thereof, viz:

Mr. President-the House of Representatives have adhered to their disagreement in relation to the amendments to bill No. 28, entitled "A bill to provide for the compensation of the officers of the Legislative Assembly, and for other purposes," and have appointed Messrs. Engle and Childs the committee of Conference on their part, in reference thereto.

And then he withdrew.

The chair having been vacated, the following resolution was submitted by Mr. Foley, and unanimously adopted, viz:

Resolved, That the thanks of this Council be tendered to the President thereof for the able and impartial manner in which he has performed the arduous duties of his station, during the present session.

The President resumed his seat, and the resolution of the Council, tendering him their thanks, having been read, he arose and replied as follows:

Gentlemen of the Council,

From a deep sense of the honor now conferred on me by your vote, approbating my official conduct in the chair, I feel prompted from duty, as well as courtesy, to make offer of my most unfeigned thanks.

I regret very much indeed to observe, that notwithstanding the short duration of the session now approaching to an end, that our deliberations were not characterized by that harmony and unanimity of feeling which I had reason to expect, and which at all times ought to pervade the operations of Legislative Assemblies. But to myself it is a source of infinite satisfaction to know, that I have at all times, and under every circumstance, been actuated with the purest motives and integrity of purpose, in discharge of the duties devolving upon me as

one of the honored representatives of the people; and if I have unfortunately fallen short of these duties, I beg leave to repeat here, what I have said on a former occasion, that if I erred or deviated from the rules of duty prescribed, that it was truly “an error in judgment and not of the heart." "To err is human-to forgive is divine."

It need hardly be observed, as of the fact you are already aware, that the bill introduced in Congress, for the division of our prosperous Territory passed both Houses, and doubtless, ere this time, received the sanction of the Executive. This will effect a great change in our local matters as well as in our political positions, and certainly cannot fail meeting the cordial approbation of the inhabitants of the Territory on both sides of the Mississippi.

Gentlemen, I again make offer and beg your acceptance of my hearty thanks, and may the Supreme Governor of the universe direct and protect all of you in safety to your places of abode.

Mr. Terry obtained leave to withdraw certain papers, belonging to the Secretary of the Territory, in the possession of the Council.

Message from the House of Representatives by the Clerk thereof, viz :

:

Mr. President-The House of Representatives has concurred in the resolution of the Council, appointing commissioners to investigate the condition and affairs of the Miners' bank of Du Buque, with amendments; in which amendments, I am directed to ask the concurrence of the Council.

Aud then he withdrew.

The amendments of the House of Representatives to the Resolution, appointing commissioners to investigate the condition and affairs of the Miners' bank of Du Buque were read, and

On motion of Mr. Foley, they were concurred in, and the Secretary was directed to inform the House of Representatives thereof.

Mr. Irwin, from the joint committee of Conference, to which the subject had been referred, made report as follows, viz :

The committee of Conference appointed on the disagreeing vote to the bill No. 28, (H. of R. file,) entitled "A bill to provide for the compensation of the officers of the Legislative Assembly, and for other purposes beg leave to report they have had the subject under consideration, and do recommend to the House of Representatives to recede from all their disagreements to the amendments of the Council, except the following:-1st, that changing the compensation of the Assisstant Clerk of the House of Representatives from six to four dollars per day; and 2nd, that changing the compensation of the door-keeper of the House of Representatives from six to four dollars per day; and, that the compensation of each of those officers be fixed at five dollars per day. They also recommend as an amendment that the pay of the door-keeper of the Council be raised from four to five dollars per day.

The report was read and adopted.

Ordered, That the Secretary inform the House of Representatives thereof. Mr. Brigham, from committee on Enrolment, reported a "Resolution appointing commissioners to examine into the affairs of the Miners' bank of Du Buque," to be correctly enrolled.

Message from the House of Representatives by the Clerk thereof, viz.

Mr. President, The House of Representatives have concurred in the report of the committee of Conference, in relation to bill No. 23, entitled "A bill to provide for the compensation of the officers of the Legislative Assembly, and for other purposes.' ""

And then he withdrew.

The Council adjourned until 10 o'clock, P. M.
