of the transcribing Clerks under the direction of the Secretary of the House of Representatives, or of the Council, as the bill may bave originated in the one or the other House, before it shall be presented to the Governor of the Territory. VI. When bills are enrolled, they shall be examined by a joint committee of two from the Council, and two from the House of Representatives, appointed as a standing committee for that purpose, who shall carefully compare the enrolment with the engrossed bills, as passed in the two Houses, and, correcting any errors that may be discovered in the enrolled bills, make their report forthwith to the respective Houses.

VII. After examination and report, each bill shall be signed in the respective Houses, first by the Speaker of the House of Representatives, then by the President of the Council.

VIII. After a bill shall have been thus signed in each House, it shall be presented by the said committee to the Governor of the Territory for his approval, it being first endorsed on the back of the roll, certifying in which House the same originated, which endorsement shall be signed by the Secretary of the House in which the same did originate, and shall be entered on the journal of each House; the said committee shall report the day of presentation to the Governor, which shall also be eutered on the journal of each House.

IX. All orders, resolutions, and votes, which are to be presented to the Governor, for his approval, shall also, in the same manner, be previously enrolled, examined, and signed; and shall be presented in the same manner, and by the same committee, as provided in cases of bills.

X. When a bill or resolution, which shall have passed in one House, is rejected in the other, notice thereof is to be given to the House in which the same may have passed.

XI. When a bill or resolution, which has been passed in one House, is rejected in the other, it is not to be again brought in during the same session, without notice of five days, and leave of two thirds of that House in which it shall be renewed.

XII. Each House shall transmit to the other all papers on which any bill or resolution shall be founded.

XIII. After each House shall have adhered to their disagreement, a bill or resolution is lost.

XIV. No bill that shall have passed one House, shall be sent to the other for concurrence, on the last day of the session.

XV. No bill or resolution that shall have passed the Council and House of Representatives, shall be presented to the Governor for his approval on the last day of the session.

DOCUMENT NO. 4.

Rules and Regulations of the Wisconsin Library.

I. The Librarian shall provide, in the town of Burlington, a proper room for the safe keeping of the books, papers, and documents belonging or appertaining to the Territorial Library, and which shall be entrusted to his care. He shall keep a Register, in which he shall enter the name of every person to whom he shall deliver any book, paper, or document, the time when the same was delivered, when returned, and the title of the work and number of volumes delivered.

11. The members of the Council and House of Representatives, and their officers; the Governor of the Territory; the Judges of the Supreme Court; the Secretary of the Territory; the United States Attorney of the Territory; the Attorney General of the Territory; the Marshal of the Territory; the Delegates in Congress from the Territory; ex-members of the Legislative Assembly; and the Clerk of the Supreme Court shall have free access to said Library during regular hours of the day.

III. Strangers may be introduced to the Library by the Governor, Secretary of the Secretary of the Territory, Judges of the Supreme Court, or members of either branch of the Legislative Assembly.

IV. Any person having the privilege of the Library, may take therefrom any number of volumes not exceeding the number of five, for his own use, and shall be accountable to the Librarian for the return of the same in good order.

V. No person shall be allowed to keep in his possession any work belonging to said Library a longer period of time than three days, under a penalty of five dollars; and in case any volume shall be lost or damaged, the volume so lost, and the actual damage done, shall be paid to the Librarian, who is hereby authorized to receive the same and shall account therefor.

VI. The Library shall be open for the accommodation of all privileged persons from the hours of nine to twelve, A. M., and from two to ten, P. M., during the session of the Legislative Assembly. In the recess of the Legislative Assembly, the time shall be regulated by the Librarian.

VII. The Librarian shall have authority to appoint, during the session of the Legislative Assembly, an Assistant Librarian, who may perform the duties assigned to the Librarian, and for whose acts the Librarian shall be personally responsible.

VIII. The Librarian shall, at the close of the session, report to the Council and House of Representatives, a true account of all expenses incurred during the session for rent of room, fuel, candles, and other incidental expenses, (including the employment of an Assistant,) which shall be paid out of any moneys appropriated by Congress to defray the expenses of the Legislative Assembly.

Mr. McKnight, from the committee on Elections, to whom was referred the memorial of Alexander J. Irwin, contesting the right of Joseph Dickinson to a seat in the Council, made the following report:

The committee on Elections, to whom was referred the memorial of Alexander J. Irwin, contesting the seat of Joseph Dickinson in this Council, have had the same under consideration, and now beg leave to make their report.

The committee, on examination of the eighth section of the law establishing the Territorial Government of Wisconsin, approved the 20th of April, 1836, by the President of the United States, Andrew Jackson, in the eighth section of said law, are the following words: "No person holding a commission under the United States or any of its officers, except as a militia officer, shall be a member of said Council, or shall hold any office under the government of said Territory." Your committee having had satisfactory testimony before them, showing that Joseph Dickinson, before named, was, on the thirtieth day of September last, a post master at Green Bay; and agreeably to the best information before the

committee the said Joseph Dickinson is yet a post master in said post office at Green Bay, in Brown county, in the Territory of Wisconsin;

And your committee having come to the conclusion that the said Joseph Dickinson is not legally entitled to a seat in this Council, therefore beg leave to report the following resolution for the consideration of the Council:

Resolved, That in the opinion of the committee, the seat now held and occupied by Mr. Joseph Dickinson in this Council be vacated, and that Alexander J. Irwin be entitled to the same.

Documents in relation to the contested election of Joseph Dickinson.

To the Honorable the Council of the Legislative Assembly of the Territory of Wisconsin:

The undersigned respectfully informs your honorable body that he contests the right of Joseph Dickinson, who has received a certificate of election as a member of the (Legislative) Council, for the County of Brown to his seat as such, and claims the right to be admitted as a member duly elected from the said county of Brown, instead of the said Joseph Dickinson.

The undersigned respectfully states the grounds for contesting the seat of the said Joseph Dickinson, to wit:

That the said Joseph Dickinson did at the time of holding the election, on the 2d day of September last, for the election of a member of the Council to supply the vacancy occasioned by the resignation of H. S. Baird, Esq., and still does hold a commission under the Post Master General of the United States, as Post Master at Navarino, in the county of Brown; which commission disqualifies him from being a member, or holding any office under the government of said Territory.

And that for a precedent, I will respecifully refer your honorable body to the journal of the House of Representatives, for the following resolution, passed on the 7th day of December, 1836, on the contest between myself, and George McWilliams, upon the same point:

"Resolved, That in the opinion of this House, no person who is at the time of election ineligible to office, can render himself eligible to the office to which he is elected by resigning said office after election."

The undersigned respectfully requests that a committee may be appointed to examine the returns of election of the county of Brown, as well as the organic law of this Territory; and report, among other things, whether Postmasters are eligible or not to office. If the objections here stated are sustained by your honorable body, I must claim the right to the seat, or the election referred back to the people to decide.

"TERRITORY OF WISCONSIN,

County of Brown.

I, Charles Tuller, Sheriff of the county of Brown, aforesaid, do upon oath depose and say: That I did receive from the post office at Navarino in the county aforesaid, on the first Monday following the election, a letter purporting to be the returns from the inspectors of the election held at Sheboyagan on Saturday the second day of September last, for the election of a member of the Council and House of Representatives, and that according to said returns, as near as my recollection serves me, Alexander J, Irwin was represented to bave received sixty-six votes, and William Dickinson one vote, for the Council, and that Charles C. Sholes received sixty-five votes, and Jesse Saunders one vote, for the House of Representatives. That after opening the communication I showed it

to Mr. A. G. Ellis, Thomas Green, and several other persons. And that during the evening of the same day, I inadvertently mislaid or lost the said letter, and that it was out of my power to return the same to the Clerk of the court: that the said returns were certified to by three persons as Inspectors, and one person as Clerk, with a poll list of the votes; that the said returns were received in due season to have returned them to the Clerk of the court, to have them canvassed with the returns from the other precincts on the first Thursday succeeding the election.

All which, I do solemnly and sincerely swear, is true according to my best knowledge and belief. So help me God.

At a meeting of the qualified electors of Sheboyagan, held at Farnsworth & Burk's mill, in the town of Sheboyagan, on Saturday, the second day of September, A. D. 1837, for one member of the Legislative Council, and one member of the House of Representatives of the Territory, to fill the vacancies occasioned by the resignation of Henry S. Baird, and Albert G. Ellis, Esqs., in pursuance of a notice given by the Sheriff of the county of Brown, Mason C. Darling, William Farmin, and A. G. Dye, were chosen viva voce of and by the qualified voters present, as Inspectors of the said election, and took the requisite oath according to law, &c. Estes H. Sandford was appointed as Clerk. The polls were opened at eleven o'clock in the forenoon, by proclamation, and in like manner closed at six o'clock in the afternoon, whereupon the Inspectors proceeding to canvass the votes. It was ascertained that the whole number of votes polled for member of Council was sixty-seven (67,) of which sixty-six (66) were for" Alexander J. Irwin," and one for "William Dickson." That the whole number of votes polled for member of the House of Representatives, was sixtysix (66,) of which sixty-five were for " Charles C. Sholes," and one for "Jesse Sanders,"

We, the undersigned, Inspectors of election held at Farnsworth & Brush's mill, in the town of Sheboyagan, on Saturday, the second day of September, A. D. 1837, for one member of the Legislative Council, and one member of the House of Representatives of this Territory, to fill the vacancies occasioned by the resignation of Henry S. Baird and Albert G. Ellis, Esqrs., in pursuance of a notice given by the Sheriff of Brown county, do certify that the whole number of votes polled for member of the Council was sixty-seven (67,) of which" Alexander J. Irwin" received sixty-six votes (66,) and " William Dickson" received one vote (1) That the whole number of votes polled for member of the House of Representatives was sixty-six, of which Charles C. Sholes received sixty-five votes (65,) and "Jesse Sanders" received one vote.

Personally appeared before me the undersigned, a Justice of the Peace in and for caid county, Ester H. Sanford, who, being duly sworn according to law, on his said oath declares and says that he officiated as Clerk at an election as set forth in the above certificate, that the above is a true canvass of the votes given at said election. And that returns, properly certified and authenticated, were forwarded to the Sheriff of Brown county, the second day of September last. Sworn and subscribed before me, this 27th day of September, A.
