HENRY DODGE.

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of adopting some general regulations with reference to the mode of procedure in the several District Courts of this Territory, and to report by bill or otherwise.

On motion of Mr. Sweet,

Resolved, That the Chairman on territorial affairs be instructed to inquire into the expediency of memorializing Congress for an appropriation of money, or donation of land, in some of the latest purchases, to aid this Territory inbuilding a penitentiary.

Mr. Ardnt presented the report of the commissioners for the erection of the public buildings at the seat of government.

Referred to committee on public expenditures.

Mr. Arndt, from the committee on Engrossment reported the following bills to be correctly engrossed, viz:

No. 26, A bill to amend an act entitled "An act to incorporate the Bank of Wisconsin."

No. 29, A bill to locate the scat of justice of Rock county; and,

No. 31, A bill to establish the several towns in the counties of Milwaukee, Brown and Racine, and the counties thereto attched for judicial purposes.

Mr. Ardot, according to notice previously given, obtained leave to introduce bill No. 42, entitled "A bill to incorporate the Marquette and Kentucky City Canal Company,"-which being read,

Mr. Knapp moved to refer to the committee on Internal Improvement.

And pending the question thereon, the Clerk of the House of Representatives was announced, who delivered the following message:

Mr. President-The House of Representatives have concurred in the resolution of Council authorizing the President thereof to draw his warrant in favor of Jeremiah Smith, for the sum therein mentioned.

The House of Representatives have passed a resolution authorizing the ap pointment of a joint committee to memorialize Congress on the subject of remunerating Major Jeremiah Smith and others for the loss sustained by them by the late fire; and have appointed Messrs. Childs, Engle and Sheldon, the committee on the part of the House of Representatives. The concurrence of the Council is requested therein.

And then he withdrew.

The President thereupon drew his warrant on the Secretary of the Territory for the amount stated in the resolution.

The question being on the motion of Mr. Knapp to refer the bill No. 42 to the committee on Internal Improvement.

Mr. Teas moved to amend the motion, by substituting the committee on Incorporations. The motion to amend was lost.

The question then recurred on the original motion of Mr. Knapp, which was determined in the affirmative.

Mr. Teas, from the judiciary committee, reported bill No. 41, entitled "A bill concerning grand and petit jurors."

Mr. Sweet. from the select committee to which had been referred the report of the joint committee appointed to report a system of county and township government for this Territory, reported bill No. 43, entitled "A bill to license and regulate taverns."

Mr. McKnight, according to previous notice given, obtained leave to introduce bill No. 44, entitled "A bill for the benefit of the towns of Belview and Peru in the original county of Du Buque."

Which bills were severally read a first and second time and committed as follows:

Nos. 41 and 43, to the committee of the whole on Tuesday next.
No. 44, to the committee of the whole on Thursday next.

Mr. Sweet from the committee on Internal Improvement, to which were referred bill No. 2, (H. R. file,) entitled "A bill to lay out a Territorial road from the White Oak Springs and for other purposes," and No. 41, (H. R. file,) entitled "A bill to lay out a Territorial road east of the Mississippi, and for other purposes."

Reported the same back again to the Council without amendment.

Ordered, to be committed to the committee of the whole on Wednesday

next.

Mr. Knapp, from the committee on Incorporations, to which was re-committed bill No. 11, entitled "A bill to incorporate the stockholders of the bank of Racine," reported the same with amendments.

The amendments were read, and ordered to be incorporated in the bill, and committed to the committee of the whole on Tuesday next.

On motion of Mr. Sweet.

Ordered, That the regulations for the daily transaction of business be suspended, and that the Council do now proceed to the third reading of bills.

Bill No. 14, entitled "A bill to autorize the building a dam across the Manitoowoc river," was thereupon read a third time; and, on the question, "shall the bill pass?"

On motion of Mr. Foley,

Ordered, that the bill be committed to the committee on Incorporations. No. 2, entitled "A bill to incorporate the Milwaukee Mutual Insurance Company," was read the third time and passed; and, the title having been read, Mr. Sweet moved to amend the same, so as to read "A bill to incorporate the Milwaukee and Racine Mutual Insurance Companies;" which was agreed to.

Ordered, That the Secretary present the same to the House of Representatives for concurrence.

Engrossed bills as follows:

No. 22, A bill providing for the recording of town plats.

No. 26, A bill to amend an act entitled "An act to incorporate the Bank of Wisconsin."

No. 29, A bill to locate the seat of justice of Rock county.

No. 30, A bill to divorce Abraham Jones and Lucinda Jones from the bonds of matrimony, and for other purposes.

No. 31, A bill to establish the several towns in the counties of Milwaukee, Brown and Racine, and the counties thereto attached for judicial purposés ; and,

No. 32, A bill to divorce Martha Newton from her husband John C. Newton;
Were severally read a third time, passed, and their titles agreed to.
Ordered, to be sent to the House of Representatives for concurrence.
The Council adjourned till 3 o'clock, P. M.

THREE O'CLOCK, P. M.

On motion of Mr. Sweet, the Council resolved itself into the committee of the whole for the consideration of bill No. 18, entitled "A bill for opening and repairing, or vacating public roads and highways," Mr. Foley in the chair. The committee arose after some time, and, by their Chairman, reported progress, and asked leave to sit again.

Leave was granted.

The Council adjourned.

SATURDAY, December 16, 1637.

On motion of Mr. Teas,

Resolved, That the thanks of this Council be presented to the Hon. James P. Cox, of the House of Representatives, Dr. George Beatty, John S. Rockwell, Esq., Henry F. Cox, and D. D. Wells, for their promptitude in rescuing the furniture and papers of this body from the fire, by which the Capitol was consumed on Wednesday last.

Mr. Knapp, from the committee on Incorporations, to which was referred bill No. 36, entitled "A bill to incorporate the Root River Rail Road Company," reported the same with an amendment.

Mr. Terry, from the committee on Finance, to which had been referred bill No. 30, (H. R. file,) entitled “A bill to authorise the town of Milwaukee on the west side of Milwaukee river, to borrow money for the purpose therein mentioned, reported the same with an amendment.

Ordered, That the bills be severally committed to a committee of the whole. Mr. Arndt, from the committee on Terrritorial Affairs, to which had been referred the memorial to the Secretary of War, from the House of Representatives, in relation to the defence of the frontier, reported a substitute therefor; which was read, adopted, and is as follows:

To the Honorable Joel R. Poinsett, Secretary of War.

Your memorialists would respectfully solicit of your Honor a supply of four thousand stand of arms, one-half rifles and the remainder muskets; also two hundred pistols and swords for the use of the volunteer companies of dragoons. Also, four light brass field pieces, three pounders not to exceed three hundred pounds each, with fixed ammunition for a compaign of four months.

Your memorialists would further represent, That the hazardous situation of the frontier inhabitants, exposed to numerous tribes of Indians located on our borders, renders it important that protection should be afforded them by Government. This protection can ouly be afforded by having a mounted force stationed at some suitable point on the Upper Mississippi, in advance of our most exposed settlements. Two hundred mounted troops, properly officered, would be sufficient to range the country from the Mississippi to the Red Cedar, Iowa and Des Moines rivers; this movement of troops would be a direct check on the Indians who might be engaged in war with each other. Mounted troops ranging the country east of the Mississippi and south of the Wisconsin river to fort Winnebago, would prevent the frequent incursions of the Indians in the weak and unprotected settlements bordering on that frontier.

Owing to the restless disposition of all Indians, it is difficult to determine when to expect their attack, and your memorialists would therefore respectfully request your Honor to furnish a mounted force posted in advance of the frontier settlement, as early in the spring season as the grass will sustain the horses. And your memorialists as in duty bound will ever pray.

Ordered, To be sent to the House of Representatives for concurrence.

Mr. Sweet, from the committee on Internal Improvement, reported bill No. 45, entitled "A bill to establish and regulate ferries in the county of Milwaukee;” which was read a first and second time, and ordered to be committed to a committee of the whole on Wednesday next.

A message from the House of Representatives, by the Clerk thereof:

Mr. President-I am directed to present for your signature a bill entitled "An act to establish the boundaries of the counties of Lee, Van Buren, Des Moines Henry, Louisa, Wayne, and Slaughter, to locate the seats of justice of said counties, and for other purposes," which has been signed by the Speaker of the House of Representatives.

The House of Representatives have concurred in the substitute of the Council for the resolution passed by the House of Representatives, authorizing the Secretary of the Territory to procure to be drafted maps of this Territory, &c.: also, in bill No. 1, entitled “A bill to locate and establish a Territorial road from the town of Milwaukee to Janesville."

The House of Representatives have passed bills of the following titles:

A bill relating the the militia and public defence of the Territory of

No. 18, A bill to abolish imprisonment for debt, and for other purposes. No. 29, A bill to locate a Territorial road from fort Howard to fort Winnebago, on the west side of Fox river, and for other purposes."

In which the concurrence of the Council is requested.

The House of Representatives, have adopted a substitute to bill No. 5, (Council file,) entitled "A bill to prevent trespasses and other injuries being done to the possessions of settlers on the public domain, and to define the extent of the right of possession on the said lands," in which substitute the concurrence of the Council is requested.

The Governor has notified the House of Representatives that he has approved and signed "An act to divorce Mary M'Arthur from her husband John M'Arthur."

And then he withdrew.

The President signed bill No. 35, (H. R. file,) entitled "An act to establish the boundaries of the counties of Lee, Van Buren, Des Moines, Henry, Louisa, Wayne, and Slaughter, to locate the seats of justice of said counties, and for other purposes.".

Mr. Arndt gave notice that he would at some future day ask leave to introduce a bill to establish and regulate ferries in the counties of Brown.

Mr. Teas gave notice that he would on Monday next ask leave to introduce a bill accepting the act of Congress, approved March 3d, 1837, modifying the several acts of the Legislative Assembly chartering the banks of Du Buque, Mineral Point, and Milwaukee, in this Territory, and for other purposes.

Mr. Terry gave notice that he would at some future day ask leave to introduce a bill establishing a Territorial road from Janesville to Mineral Point. Mr. Brigham obtained leave to introduce at some future day a bill defining the mode of locating and establishing Territorial roads.

On motion of Mr. Sweet, the regulations for the daily transaction of business were suspended, in order to take up the unfinished business of yesterday, being bill No. 18, entitled "A bill for opening and repairing or vacating public roads and highways."

The Council thereupon resolved itself into a committee of the whole, for the further consideration of the said bill, Mr. Foley in the chair.

The committee arose after some time, and reported the bill with amendments. The amendments were concurred in.

Mr. Arndt then moved to lay the bill on the table; which was agreed to. On motion of Mr. Arndt, the Council resolved itself into the committee of the whole, for the consideration of bill No. 20, entitled "A bill to amend and alter an act entitled An act to incorporate the Lafontaine Rail Road Company," "Mr. Smith in the chair.

The committee arose and reported the bill with amendments; which were concurred in.

And pending the question thereon, "Shall the bill be engrossed and read a third time?"

Mr. Foley moved to lay the bill on the table; which was agreed to.

Bill No. 23, entitled "A bill to authorize the receipt and disposition of real estate in the several counties in this Territory;" was considered in committee of the whole, Mr. Terry in the chair.

The committee arose after some time and reported the bill with an amendment; which was concurred in.

Mr. Sweet moved further to amend the bill by inserting after the word " travening," in the fourth line of the sixth section, the words " was agreed to.

The bill was then ordered to be engrossed for a third reading.

On motion of Mr. Terry, Messrs. Sweet and Arndt were temporally added to the committee on Public Expenditures.

Mr. Brigham, from the committee on Enrolment, reported bill No. 13, entitled "An act to provide for the election of county Treasurers, and to define their duties," to be correctly enrolled.

Mr. Arndt, from the committee on Engrossment, reported bill No. 15, entitled "A bill for assessing and collecting county revenue," to be correctly engrossed.

Mr. Arndt, from Committee on Internal Improvement, to which had been referred bill No. 42, entitled "A bill to incorporate the Marquette and Kentucky city Canal Company," reported the same without amendment.

Ordered, That the bill be printed, and committed to the committee of the whole on Tuesday, 26th inst.

Mr. Sweet, from the select committee to which was referred the report of the joint committee appointed to report a system of county and township gov ernment for this Territory, reported bill No. 46, entitled A bill to authorize the county commissioners to levy a tax for county purposes."

Mr. Brigham, by leave, introduced bill No. 47, entitled "A bill defining the mode of locating and establishing Territorial roads."

Mr. Knapp gave notice that he would at a future day ask leave to introduce a bill to locate a seminary of learning at Racine, in the county of Racine. On motion of Mr. Sweet, the Council resolved itself into the committee of the whole, Mr. McKnight in the chair; for the consideration of the following bills, viz :

No. 25, A bill to locate and establish a Territorial road from Beloit to Goodhue's Mills, in Rock county;
