By Mr. Long: The petition of inhabitants of township three north, range fifteen east, in Walworth county, praying to be set off as a separate township for judicial purposes, by the name of Richmond.

By Mr. Long: The petition of inhabitants of Walworth county, asking a change of the present system of county governments Referred to the committee on Territorial affairs.

By Mr. Deming: A memorial of sundry inhabitants of South port, praying the passage of a law to provide for the establishment of a road district comprehending therein the southeast and southe west quarter of thirty-one, and the southwest fractional quarter of section thirty-two, in town two north, range twenty-three east, and the entire part of range twenty-three east, lying in town or north.

The Speaker announced the appointment of Messrs. Hackett and Rockwell of the joint committee on enrollment, under the 6th of the joint rules.

Ordered, That the Council be acquainted therewith.

Mr. Whiton, by leave, offered resolution No! 3, entitled "Re.

solution concerning the appointment of a joint committee to prepare the laws passed at the present session for publication;" Which was read and laid on the table.

On motion of Mr. Sutherland,

Resolved, That the committee on the judiciary be requested to inquire into the expediency of memorializing Congress to amend the law organizing this Territory, by authorising the appointment of an additional judge, that an impartial organization of the supreme court may be made, more in accordance with the principles of justice than the present.

Mr. Dunn offered the following joint resolution, which was read the first and second time by its title, viz:

1. No. 4. "Resolution concerning the appointment of a joint com. mittee."

Mr. Brown offered a preamble and resolution of the following title, which was read the first and second time, viz:

"Preamble and resolution relative to unsurveyed land."

The following resolution, introduced by Mr. Brunson, was read and adopted:

Resolved, That the committee on internal improvements be and hereby are instructed to inquire into the expediency of dissolving the present connection existing between the Territory and the Mil. waukee and Rock River Canal Company, and to place said work under the entire control of one or the other, and report by bill or otherwise.

On motion of Mr. Darling,

The House resolved itself into a committee of the whole, Mr. Dewey in the chair, for the consideration of bill No. 3, entitled "A bill concerning county officers in the county of Fon du Lac."

After a short time the committee rose and reported said bill with amendments;

Which were agreed to, and the bill ordered to be engrossed for the third reading.

And then the House adjourned.

Tuesday, December 15, 1840,

Mr. Dunn presented the petition of Peter Howard, praying for a divorce.

Read and referred to the committee on the judiciary.

Mr. Shepard gave notice of his intention or a future day to introduce a bill to amend an act entitled "An act concerning the duties of clerks of the boards of county commissioners." ·I

Mr. Barber presented the report of the Commissioners of the Milwaukee and Rock River Canal, [See Appendix, Doc. B.] which was read, five hundred copies thereof ordered to be printed, and the report referred to the select committee to which so much of the Governor's message was referred as relates to the same subject, viz:

Messrs. Barber, Ray and Gray.

Mr. Ray, from the committee on engrossed bills, reported as correctly engrossed, bill No. 3, entitled "A bill concerning county officers in the county of Fon du Lac."

Mr. Long, from the select committee to which a petition was referred, reported bill No. 4, entitled "A bill to divide the town of Whitewater, in Walworth county;"

Which was read the first and second time. em? suos to? A Mr. Dunn offered the following resolutions & a cit Resolved, That Horatio N. Wells and Moses M. Strong be appointed commissioners to take testimony relative to the contested election between Albert G. Ellis and William H. Bruce, and that they each be authorized to administer oaths, and compel the attend. ance of witnesses, and that the said Wells and Strong shall each be allowed such per diem compensation and mileage as is allowed to the members of this House, and such sum for their necessary expenses as the Legislative Assembly may allow.

Mr, Barber moved to amend the resolution by striking out all

after the word each,' in the 8th line, and inserting the following words: be allowed such compensation as shall be fixed by law.' The amendment was disagreed to, and the resolution was then adopted.

On motion of Mr. Whiton,

Resolution No. 3, entitled "Resolution concerning the appointment of a joint committee to prepare the laws passed at the present session, for publication," was read the first and second time.

The time allotted for morning business having expired, the House proceeded to the orders of the day.

Bill No. 3, entitled "A bill concerning county officers in the county of Fon du Lac," was read the third time, passed, and the title thereof agreed to.

Ordered, That the Clerk request the Council to concur therein. The House then resolved itself into committee of the whole, Mr. Whiton in the chair, having under consideration the follow. ing resolutions, viz :

No. 3. "Resolution concerning the appointment of a joint committee to prepare the laws passed at the present session for publication."

No. 4. "Resolution concerning the appointment of a joint committee;" and

No. 5. "Preamble and resolution relative to unsurveyed land." After some time spent therein, the committee reported resolu tions Nos. 3 and 4 with amendments, and resolution No. 5 without amendment,

The report of the committee was agreed to, and the resolutions severally ordered to be engrossed and read the third time. The House then adjourned.

Wednesday, December 16, 1840.

On motion of Mr. Darling,

Resolved, That fifty copies of all bills and memorials presented in this House, after a second reading, and before being considered in committee of the whole, be printed, unless otherwise specially ordered.

Mr. Hackett gave notice of his intention to introduce a bill on a future day to amend an act of the Revised Statutes concerning justices of the peace.

Mr. Darling, by leave, introduced resolution No. 6, entitled Resolution for the distribution of the territorial maps;"

Which was read the first and second time.

Mr. Ogden, by leave, introduced resolution No. 7, entitled "Resolution to appoint an agent to obtain money to defray the expenses of the Legislative Assembly and to disburse the same;" Which was read the first and second time.

On motion of Mr. Brunson, the following resolution was adopted:

Resolved, That Samuel B. Knapp, Fiscal Agent of this Ter ritory, be and hereby is instructed to report to this House as soon as practicable, the entire amount of moneys he has received and disbursed, relating to the expense of the Legislative Assembly, specifying each item of expense, and what balance, if any, remains in his hands.
