Nos. 3 and 4, each entitled, "Memorial to Congress concern. ing pre-emption rights to miners."

After some time the committee rose and reported the said bill and memorials with amendments to cach.

On the question to agree to the report of the committee on bill No. 25, the ayes and nays were called for, by Mr. Shew, and were as follows:

Ayes-Messrs. Baldwin, Beardsley, Blackstone, Bracken, Childs, Hoyt, Jenkins, Longstreet, Newman, Ray, Story, Street, Suther land, Wells and Whiton, speaker-15.

Noes-Messrs. Billings, Brunson, Conroc, Craig, Cruson, Dew. ey, McGregor, Shackelford, Shew, Sholes and Stevens-11. So the report of the committee was agreed tɔ.

The question then recurred on ordering the bill to be engrossed for a third reading, and the ayes and noes being called, were as follows:

Ayes--Messrs. Baldwin, Beardsley, Blackstone, Bracken,Childs, Hoyt, Jenkins, Longstreet, Newman, Ray, Story, Street, Suther land, Wells and Whiton, speaker--15.

Noes-Messrs. Billings, Brunson, Conroc, Craig, Cruson, Dew. ey, McGregor, Shackelford, Shew, Sholes and Stevens--11.

So the said bill was ordered to be engrossed.

The report of the committee on the said memorials was then agreed to, and they were severally ordered to be laid on the ta ble.

Mr. Dewey, from the select committee on roads, reported á bill, No. 43, which was read the first and second time and ordered to be printed, entitled,

"A bill to lay out and establish certain Territorial roads therein named."

On motion of Mr. Wells,

The House went into committee of the whole, Mr. Childs in the chair, for the consideration of bills of the following titles, viz: No. 32, "A bill in relation to assessors.'

No. 33, “A bill relative to the writ of mandamus, and for other purposes." And,

No. 36, "A bill to establish the towns of Pewaukee and Gran. ville, in the county of Milwaukee."

After a short time the committee rose and reported bill No. 32 with, and Nos. 33 and 36 without amendment.

The amendments of the committee to bill No. 32 were agreed to, and the said bill ordered to be engrossed for the third read ing.

Mr. Shackelford moved that bill No. 33 be laid on the table, which was disagreed to; and the said bill, and bill No. 36, were then severally ordered to be engrossed for the third reading.

Mr. Beardsley gave notice that, on a future day, he should, by leave, introduce a bill relating to the register of deeds of Rock county.

On motion of Mr. Shew,

The House adjourned.

MONDAY, January 6, 1840.

Mr. Brunson presented a petition from citizens of Prairie du Chien, relating to the appointment of a superintendent of educa. tion.

Referred to the committee on schools.

Mr. Beardsley presented a petition and two remonstrances, from citizens of Rock county, relating to the removal of the seat of justice of said county.

Referred to the select committee to which petitions relating to the same subject were referred on the 31st Dec. last, viz:

Messrs. Beardsley, Story and Billings.

Mr. Wells, from the committee on the judiciary, reported the following bills, which were read the first and second time and ordered to be printed, viz:

No. 44, "A bill to provide for establishing the seat of justice of Racine county."

No. 45, "A bill concerning the duties of clerks of the boards of county commissioners."

No. 46, "A bill to change the time of holding courts in the second judicial district."

No. 47, "A bill to amend an act, entitled, An act to provide for assessing and collecting county revenue.'”

Mr. Childs, from the committee on engrossed bills, reported the following to be correctly engrossed, viz :

No. 25, "A bill to amend An act to provide for aiding in the construction of the Milwaukee and Rock river canal.'

No. 32, "A bill in relation to assessors."

No. 33, "A bill relative to the writ of mandamus, and for other purposes."

No. 36, "A bill to establish the towns of Pewaukee and Granville, in the county of Milwaukee."

Mr. Bracken presented the accounts of Moses M. Strong; one for services as attorney in suits of the Territory of Wisconsin vs. the commissioners of the public buildings, and James Morrison and sureties, and the other for expenses as fiscal agent.

Mr. Sholes presented the account of E. Childs, for stationary purchased for the Legislative Assembly at its last session.

Ordered, That the said accounts be referred to the committee on claims.

Mr. Shackelford offered the following resolution, which was adopted:

Resolved, That Moses M. Strong be requested to report to this House an account of all moneys disbursed by him as fiscal agent, and on what appropriations.

Mr. Sholes, from the joint committee to whom the subject was referred, made the following report:

The joint committee of conference, appointed to take into consideration the disagreeing vote of the two Houses, on bill No. 16, (Council file,) entitled, "A bill to prevent the sale of intoxicating liquors to Indians," have conferred on the subject referred to them, and have agreed to propose to their respective Houses the following amendment in lieu of the one adopted by this House.

Strike out in the first section of the original bill, all after the

word "any," in the second line, to the word "this," in the third line, and insert in lieu thereof the words "Indian in."

On motion of Mr. Sholes,

The report of the committee was agreed to.

The House then proceeded to the orders of the day, when the undermentioned bills were severally read a third time, passed and the tiles agreed to, viz:

No. 22, "A bill to license teamsters."

The ayes and noes were called on the passage of said bill, and were as follows:

Ayes-Messrs. Baldwin, Blackstone, Bracken, Brunson, Childs, Craig, Hoyt, Jenkins, Longstreet, Ray, Shackelford, Sholes, Story, Street and Wells-15.

No. 32, A bill in relation to assessors.

The title of said bill was amended by adding the words "and supervisors of roads."

No. 33, "A bill relative to the writ of mandamus, and for other purposes."

The ayes and noes were called on the passage of said bill, and were as follows, viz:

Ordered, That the chief clerk request the concurrence of the Council in said bills.

On motion of Mr. Wells,

Ordered, That the following bills be committed to the commit. tee of the whole now,

No. 28, "A bill to amend an act of the Revised Statutes of the Territory of Wisconsin, entitled, An act concerning judgments and executions.'

No. 29, (Council file,) "A bill to establish the town of Bristol, in the county of Racine."

The House then went into the committee of the whole, on said bills, Mr. Wells in the chair.

After some time the committee rose and reported bills Nos. 28 and 34 with amendments, and bill No. 29 without amend. ment.

Bill No. 29 was ordered to the third reading.

Mr. Beardsley offered the following amendment to bill No. 34:

Strike out in section 6, all after the word "act," and insert "the taker up shall, at the end of one year from the time of taking
