On motion of Mr. Sholes,

The House adjourned until Monday next, at 10 o'clock A. M.

MONDAY, December 23, 1839.

Mr. Childs presented the petition of citizens of Dane county, praying that an additional term of the district court may be held in April of each year.

On motion of Mr. Childs,

Ordered, That the said petition be referred to a select committee.

The Speaker appointed Messrs. Childs, Jenkins and Dewey.

Mr. Longstreet, from the joint committee on enrolment, reported that the said committee did, on the 20th inst., submit to the Governor for his approval, an act entitled

"An act to establish a Territorial road from Madison to Frankfort in Dodge county."

Mr. Shackelford, from the select committee to which a petition of citizens of Brown county, relating to the seat of justice of said county, was referred, reported the following bill:

No. 21, "A bill relative to the seat of justice of Brown coun

1y."

Which was read a first and second time, and

Ordered, That the same do lie on the table and be printed. Mr. Childs, from the committee on engrossed bills, reported the following to be correctly engrossed, viz:

No. 1," A memorial of the Legislative Assembly, in behalf of the settlers upon the even sections, reserved to the United States by the law granting a quantity of lands to aid in the construction of the Milwaukee and Rock river canal."

No. 3, "A substitute for a bill entitled 'A bill relating to the duties of the register of deeds of the county of Rock.' No. 7, "A bill to provide for laying out and establishing certain Territorial roads therein referred to."

Mr. Shackelford, from the joint committee on enrolled bills, reported resolution No. 8, entitled

"A resolution relative to the distribution of the local laws," to be correctly enrolled.

When the Speaker signed the same.

The Speaker laid before the House a message from the Execu tive, stating that he did on the 21st inst., exa nine and approve "An act to establish a Territorial road from Madison to Frankfort in Dodge county."

The Speaker also laid before the House a memorial of the Milwaukee and Rock river canal company.

(See Appendix, document G.) Which was read, and,

On motion of Mr. Sholes,

Ordered, That the same be referred to the select committee to which all the papers and documents in relation to the Milwaukee and Rock river canal were referred on the 20th inst., consisting of Messrs. Shew, Childs, Stevens, Beardsley, Sutherland, Bald. win, Dewey and Brunson.

The House then proceeded to the orders of the day; when No. 9. Resolution relating to the fiscal agency of Moses M. Strong," was read a second time.

No. 3, Substitute for a bill entitled, A bill relating to the register of deeds of the county of Rock,' was recommitted to the committee on engrossed bills.

The following bill and memorial were severally read the third time, passed and titles agreed to, entitled as follows:

No. 7, "A bill to provide for laying out and establishing cer. tain Territorial roads therein referred to."

No. 1, "A memorial of the Legislative Assembly, in behalf of the settlers upon the even sections reserved to the United States by the law granting a quantity of lands to aid in the construction of the Milwaukee and Rock river canal."

Ordered, That the concurrence of the Council be requested in the said bill and memorial.

On motion of Mr. Billings,

The House resolved itself into the committee of the whole, Mr. Baldwin in the chair, having under consideration memorials of the Council as follows:

No. 2, "Memorial to Congress for appropriation for har. bors."

No. 4, "Memorial to Congress for an appropriation for the es. tablishment of a penitentiary."

After a short time the committee rose, and by their chairman reported the said memorials to the House without amend.

ments.

The said memorials were then severally ordered to the third reading, and were read a third time, passed and the titles thereof agreed to.

Ordered, That the Council be acquainted therewith.

On motion of Mr. Street,

The House took up and considered the report of the com. mittee on corporations, relating to the Bank of Mineral Point and the Milwaukee Fire Insurance Company..

Mr. Bracken moved the adoption of the following resolu

tion:

Resolved, That so much of the report of the committee on corporations, as relates to the Bank of Mineral Point, be referred to. a select committee of three, with instructions to report a resolu... tion for the appointment of a committee to examine into the affairs of the Bank of Mineral Point, and report to the Governor for the information of the citizens of the Territory, the situation of said Bank, and further to report to the Governor the arrangement entered into by the said Bank with the State Bank of Missouri, for the redemption of Mineral Point Bank bills at the counter of the said State Bank of Missouri, and all other matters and things touching said Bank, which would be calculated to give confidence to the citizens of this Territory in the bills of said Bank, to the t end that the bills of the only bank in the Territory may pass at their par value throughout the Territory.

Mr. Sholes moved to amend the said resolution offered by Mr.

Bracken, by striking out all after the word "Resolved," and inserting the following in lieu thereof:

"That the cashier of the Bank of Mineral Point be required to transmit to this House forthwith, under oath, such statements in relation to the condition of the institution as he is required to by the charter, and that he be also requested to transmit a copy of the agreement which exists, if any, between the bank of which he is the cashier, and the Bank of Missouri, in relation to the redemp tion of the notes of the former by the latter."

The ayes and roes being called on the question to agree to said amendment were taken and were as follows:

Ayes-Messrs. Beardsley, Conroe, Cruson, Dewey, Jenkins, McGregor, Shackelford, Shew, Sholes and Story--10.

Noes-Messrs. Baldwin, Billings, Bracken, Brunson, Childs, Craig, Hoyt, Longstreet, Newman, Ray, Stevens, Street, Welis and Whiton, speaker-13.

So the amendment was lost.

Mr. Story moved to amend the resolution as follows, strike out all after the word "and," in the 14th line and insert the following words:

"All other necessary information with respect to the condition of the bank that may come to the knowledge of the committee, which may be considered by them as important to be communicated."

The said amendment was agreed to.

The question then recurred on the passage of the resolution as amended, and the ayes and noes being called for, were taken and were as follows:

Ayes-Messrs. Baldwin, Beardsley, Billings, Bracken, Brun. son, Childs, Conroe, Craig, Cruson, Hoyt, Longstreet, McGre gor, Newman, Ray, Stevens, Story, Street, Wells and Whiton, speaker-19.

Noes-Messrs. Dewey, Jenkins, Shackelford, Shew, and Sholes

So the said resolution was adopted.

The question then recurred on that part of the report relating

to the Milwaukee Fire Insurance Company, which reads as fol. lows:

"Resolved, That the Attorney-General of the Territory be requested to report to this House, as soon as possible, all information in, or that may come into his possession, relative to the banking operations of the Wisconsin Marine and Fire Insurance Com. pany."

Mr. Street moved the following amendment. Add to the resolution the words,

"And that the chief clerk of the House furnish the Attorney. General with a copy of this resolution."

Mr. Bracken moved to postpone the resolution and amendment, and pending the question thereon,

The House adjourned until 3 o'clock P. M.

AFTERNOON SESSION.

Three o'clock.

The House resumed the consideration of the resolution relating to the Wisconsin Marine and Fire Insurance Company.

Mr. Bracken moved the following resolution:

Resolved, That so much of the report of the committee on cor. porations, and the resolution by them reported, touching the Wisconsin Marine and Fire Insurance Company, be referred back to the said committee, with instructions to report a resolution for the appointment of a committee of three persons, to be appointed by this House, to examine into the affairs of said company and to report to the Governor-Whether the affairs of the said company have been conducted in conformity to the 2d, 6th and 10th sec. tions of their charter: whether any policies of insurance have been granted by the said company to any citizen of this Territory, either on land or water; and whether the intention of the Legis. lature in granting the said Marine and Fire Insurance Company has not clearly been avoided, by the president and directors discounting, either at Milwaukee or elsewhere, negociable notes, for
