The journal of yesterday read and approved.

Senator Edwards of St. Charles presented a petition from citizens of St. Charles and Portage township, of the county of St. Charles, against the renewal of the charter of the St. Charles and Marie Croche Rock Road Company; which was referred to the Committee on Banks and Corporations.

Senator Mackay presented a memorial from the First Congregational Church of Brookfield, Missouri, asking the submission of a constitutional amendment prohibiting the importation, manufacture and sale of intoxicating liquors in the State of Missouri; which was referred to the Committee on Constitutional Amendments.

Senator Dobyns was granted leave of absence until Tuesday.
Senator Perkins was granted leave of absence for one week.

Senator Naylor introduced Senate bill No. 110, entitled "An act to amend sections 6057 and 6060, art. 5, chap. 119 of Revised Statutes of Missouri, 'Of taxation of insurance companies;'" which was read first time and 50 copies ordered printed.

Senator Jacobs introduced Senate bill No. 111, entitled "An act to amend section 815, art. 2, chap. 21, Revised Statutes of Missouri, concerning discrimination allowed in the shipment of grain;" which was read first time and 50 copies ordered printed.

Senator Edwards of Lafayette introduced Senate bill No. 112, entitled "An act for the completion, improvement and furnishing necessary heating apparatus and furniture for the Normal School Building of the Second District, and to appropriate money therefor;"> which was read first time and 50 copies ordered printed.

Senator Rouse introduced Senate bill No. 113, entitled "An act to amend sections 3486, 3487, 3488 and 3489, art. 4, chap. 59, Revised Stat

utes, entitled 'Of practice in civil cases;'" which was read first time and 50 copies ordered printed.

Senator Byrns introduced Senate bill, No. 114, entitled "An act to amend section 3046, art. 9, chap. 44 of the Revised Statutes of Missouri entitled 'Of justices courts;'" which was read first time and 50 copies ordered printed.

Senator Byrns introduced Senate bill No. 115, entitled "An act to amend section 1819, article 18, chapter 24 of the Revised Statutes of Missouri, concerning Crimes and criminal procedure;'" which was read first time and 50 copies ordered printed.

Senator Mabrey introduced Senate bill No. 116, entitled "An act authorizing counties having a past due indebtedness for the the building of court houses and jails to refund the same and at a lower rate of interest;" which was read first time and 50 copies ordered printed.

Senator McMahan submitted the following report from the Committee on Agriculture; which was read:

MR. PRESIDENT: Your Committee on Agriculture to whom was referred Senate bill No. 28, entitled "An act to discourage the keeping of useless and sheep killing dogs, and to provide indemnity for damages done by same," beg leave to report that they have considered the same and have instructed me to report the same back to the Senate with the accompanying substitute, and recommend that the substitute

do pass.

The bill so reported, being Senate bill No. 28, not being called for, the substitute offered by the committee was taken up, read first and second times, adopted, and ordered engrossed.

Senator Stephens submitted the following report from the Committee on Roads and Highways, which was read:

MR. PRESIDENT: Your Committee on Roads and Highways to whom was referred Senate bills Nos. 42 and 44, entitled "An act to amend sections 4314, 4316, 4317, 4320, 4321, 4322 and 4323, chapter 84 of the Revised Statutes of Missouri, entitled 'Of bridges,"" beg leave to report that they have considered the same, and recommend that the accompanying substitute do pass.

The bills so reported, being Senate bills Nos. 42 and 44, not being called for, the substitute reported by the committee was taken up, read first and second times and adopted and the bill ordered engrossed.

Senator Cottey submitted the following report from the Committee on Ways and Means, which was laid over informally and 300 copies ordered for the use of the Senate:

MR. PRESIDENT: Your Committee on Ways and Means to whom

was referred the resolution hereto attached, referring to the accounts and settlement of the late Treasurer of the State of Missouri, Elijah Gates; beg leave to report that they have considered the same, and in answer to the inquiries therein made, would state for the information of the Senate:

1st. That the report of the committee appointed by Ex-Governor Phelps to settle with the State Auditor and State Treasurer, shows the condition of the finances of the State on the 31st day of December, 1880.

2d. That said report shows the amount of money turned over to Philip E. Chappell and also the amount deposited in the Bank of Commerce by Calvin F. Burns on the 10th day of January, 1881, without showing the receipts and disbursements for the first ten days of January, 1881.

3d. That the receipts of money into the treasury for the first 10 days of January, 1881, amounted to the sum of $10,180.19, that the disbursements of money from the treasury for the first 10 days of January, 1881, amounted to the sum of $22,927.03; that the disbursements for the first ten (10) days of January, 1881, exceeded the receipts for the said period in the sum of $12.746.84; all of which is more fully shown by the tabulated statement hereto appended, marked "Exhibit A,” and made a part of this report.

Senator Byrns submitted the following report from the Committee on Criminal Jurisprudence, which was read:

MR. PRESIDENT: Your Committee on Criminal Jurisprudence to whom was refarred Senate bill No. 40, entitled "An act to amend section 1318, article three of chapter twenty-four of the Revised Statutes of the State of Missouri, in relation to 'Crimes and criminal procedure,'" beg leave to report that they have considered the same, and recommend that the accompanying substitute do pass.

The bill so reported, being Senate bill No. 40, not being called for, substitute offered by the committee was taken up, read first and second times and Senator Rogers offered the following amendment:

Strike out the words "provided that no woman shall be punished by stripes;" which was read first and second times, and Senator Heaston moved to lay the amendment on the table.

The ayes and noes being demanded, the motion was lost by the following vote:

AYES-Senators Allen, Caldwell, Dungan, Gottschalk, Headlee, Heaston, Hutt, Jacobs, Lloyd, McMahar, Mabrey, Manistre, Rogers and Stephens-14.

Senator Jacobs moved that the further consideration of the bill be indefinitely postponed.

The ayes and noes being demanded, the motion was lost by the following vote:

AYES-Senators Allen, Caldwell, Dungan, Gottschalk, Headlee, Heaston, Hutt, Jacobs, Lloyd, McMahan, Mabrey, Manistre and Stephens-13.

The question then recurring upon the adoption of the amendment and the ayes and noes being demanded, it was lost by the following

Senator Bland offered the following amendment:

Amend by striking out the word "woman," in the last line of section one, and insert in lieu thereof the word "female;" which was read first and second times.

Senator Gottschalk moved to lay on the table.

The ayes and noes being demanded, the motion was lost by the following vote:

AYES-Senators Allen, Caldwell, Dungan, Gottschalk, Heaston, Hutt, Lloyd, Mabrey, Manistre and Stephens-10.
