The Senate met pursuant to adjournment.

The journal of yesterday was read and approved.

Senator Stephens presented a memorial from the Board of Curators of University of the State of Missouri, praying for an additional appropriation; which was read and 300 copies ordered printed.

Senator Dobyns presented a petition from citizens of Shelby county, Missouri, praying for an amendment to the Constitution prohibiting the importation, manufacture and sale of intoxicating liquors in this State.

Senator Manistre introduced Senate bill No. 210, entitled "An act to repeal section three of an act entitled 'An act concerning street railroads in the city of St. Louis,' approved January 16th, 1860;'" which was read first time and 50 copies ordered printed.

Senator DeArmond introduced Senate bill No. 211, entitled "An act in relation to the sale and leasing of real the estate of persons of unsound mind, and the reinvestment and other disposition of the proceeds thereof; which was read first time and ordered not printed.

Senator DeArmond introduced Senate bill No. 212, entitled "An act to amend section 3318, chupter 52, Revised Statutes, 'Of mortgages and deeds of trust;" which was read first time and ordered not printed. Senator DeArmond introduced Senate bill No. 213, entitled "An act to define the mode and manner of publishing notices of sale of real and personal estate by sheriffs, mortgagees, trustees and others;" which was read first time and ordered not printed.

Senator DeArmond introduced Senate bill No. 214, entitled “An act to declare the meaning of the word 'vocation' in certain cases;" whice was read first time and ordered not printed.

Senator Stephens introduced Senate bill No. 215, entitled "An act in relation to the assessment of real estate on county lines ;" which was read first time and 50 copies ordered printed.

Senator Walker introduced Senate bill No. 216, entitled "An act to prohibit corporations that operate parallel and competing lines of

railroads from consolidating, and to prohibit the officers of the one from being the officers of the other;" which was read first time and 50 copies ordered printed.

Senator Morrison introduced Senate bill No. 217, entitled "An act for the relief of James S. Rollins, and to appropriate money therefor;" which was read first time and 50 copies ordered printed.

Senator Heard introduced Senate bill No. 218, entitled "An act to amend section 1486, article 6, chapter 24, Revised Statutes, concerning 'Crimes and criminal procedure;'" which was read first time and 50 copies ordered printed.

Senator Edwards of St. Charles submitted the following report from the Committee on Engrossed Bills, which was read:

MR. PRESIDENT: Your Committee on Engrossed Bills, to whom was referred Senate bill No. 104, entitled "An act to amed section 818, chapter 21, article 2, Revised Statutes, entitled 'Railroad companies;"" beg leave to report that they have compared the same and find it to be truly engrossed, and that the printed copies thereof furnished to the Senators are correct.

Senator Byrns submitted the following report from the Committee on Criminal Jurisprudence, which was read:

MR. PRESIDENT: Your Committee on Criminal Jurisprudence, to whom was referred Senate bill No. 151, entitled "An act to authorize the appointment of stenographers in courts exercising criminal jurisdiction in cases of felony in cities having a population of more than one hundred thousand inhabitants," beg leave to report that they have considered the same, and recommend that it do pass with accompanying amendment.

The following amendment, offered by the committee to the Senate bill No. 151, was read twice and adopted and the bill ordered engrossed:

Amend section 5 by adding at the end thereof the following: "And provided that in cases of appeal, and on motions for new trials, the transcripts of the evidence shall be furnished to the defendand upon the order of the court without costs to said defendant."

Senator Manring submitted the following report from the Committee on Township Organization ;" which was read:

MR. PRESIDENT: Your Committtee on Township Organization to whom was referred Senate bill No. 190, entitled "An act to amend article 8, chapter 162 Revised Statutes, entitled 'Of township organization,' by adding a new section thereto in reference to procuring

record books and stationery," beg leave to report that they have considered the same, and recommend that it do pass.

Senator Manring submitted the following report from the Committee on Township Organization:

MR. PRESIDENT: Your Committee on Township Organization to whom was referred Senate bill No. 168, entitled "An act to amend section 7469, article 7, chapter 162, Revised Statutes of Missouri, 1879," beg leave to report that they have considered the same, and recommend that it do pass.

MR. PRESIDENT: Your Committee on Judiciary, to whom was referred Senate bill No. 147, entitled "An act to provide for the submission of Constitutional amendments to a vote of the people," beg leave to report that they have considered the same, and recommend that it do pass.

Senator DeArmond submitted the foliowing report from the Committee on Judiciary, which was read:

MR. PRESIDENT: Your Committee on Judiciary, to whom was referred Senate bill No. 204, entitled "An act to exempt the husband from payment of debts of the wife constracted before marriage," beg leave to report that have considered the same, and recommend that it do pass with the accompanying amendment.

Senate bill No. 204 was taken up and the following amendment reported by the committee was read twice and adopted and the bill ordered engrossed:

Amend section 1 by striking out "by virtue of the marriage," when it occurs between "wife" and "shall," in the ninth line of said section. Senator Byrns submitted the following report from the Committee on Criminal Jurisprudence:

MR. PRESIDENT: Your Committee on Criminal Jurisprudence, to whom was referred House bill No. 218, entitled "An act to amend sections 2798 and 2799 Revised Statutes, 'Of grand and petit jurors,"" beg leave to report that they have considered the same, and recommend that it do not pass.

House bill No. 218 was taken up and indefinitely postponed.

Senator DeArmond submitted the following report from the Committee on Judiciary, which was read:

MR. PRESIDENT: Your Committee on Judiciary, to whom was referred Senate bill No. 157, entitled "An act to amend section 5824, chapter 116, Revised Statutes, relating to insane persons," beg leave to report that they have considered the same, and a majority of the committee instruct me to report it back with the recommendation that it. do pass, with the accompanying amendment.

Senate bill No. 157 was taken up, and the following amendment, reported by the committee, was read first and second times, and the bill, as amended, ordered engrossed:

Amend section 1 by striking out "shall," where it occurs between “had” and “pay " in said section, and inserting in lieu thereof the following: "may in the discretion of the court, be required to."

Senator DeArmond submitted the following report from the Committee on Judiciary, which was read:

MR. PRESIDENT: Your Committee on Judiciary to whom was referred Senate bill No. 290, entitled "An act to amend sections 2724 and 2727, chapter 41, Revised Statutes, entitled 'Of interest,"" beg leave to report that they have considered the same, and a majority of

the committee instruct me to report it back with the recommendation

that it do pass.

Senate bill No. 200 was taken up, and ordered engrossed, by the following vote, the ayes and noes being demanded:

Senator Cottey moved to reconsider the vote by which the Senate refused to order the bill to engrossment.

The ayes and noes being demaded, the motion to reconsider prevailed by the following vote:

AYES-Senators Allen, Bryant, Byrns, Caldwell, Cottey, DeArmond, Dobyns, Edwards of St. Charles, Heard, Hutt, Mabrey, Manring, Morrisson, Rouse and Stephens-15.

NOES-Senators Bland, Cabell, Dungan, Gottschalk, Heaston, Jacobs, McGrath, Manistre, Naylor, Perkins, Rogers and Walker-12. ABSENT ON LEAVE-Senators Bradley, Edwards of Lafayette, Headlee, Lloyd, McMahan, Mackay and Pehle-7.

The bill was then ordered engrossed by the following vote:

An executive message was received from the Govornor through his private Secretary, Mr. Farr.

On second reading of Senate bills, substitute for Senate bill No. 11 was taken up, and laid over informally.

Senate bill No. 175, entitled "An act to amend section 5441, Revised Statutes, entitled 'Of dramshops,"" was taken up, and Senator Dungan offered the following amendment, which was read first and second times:
