garanties.

There is authorized to be appropriated annually an amount to restore in whole or in part any realised impairment to the capital used in carrying on the authority to make informational media guaranties, as provided in subsection (e), through the end of the last completed fiscal year.

(2) Such impairment shall consist of the amount by which the losses incurred and interest accrued on notes exceed the revenue earned and any previous appropriations made for the restoration of impairment. Losses shall include the dollar losses on foreign cur rencies sold, and the dollar cost of foreign currencies which (a) the Secretary of the Treasury, after consultation with the Director, has determined to be unavailable for, in excess of, requirements of the United States, or (b) have been transferred to other accounts with out reimbursement to the special account.

(3) Dollars appropriated pursuant to this section shall be applied to the payment of interest and in satisfaction of notes issued or as sumed hereunder, and to the extent of such application to the prin cipal of the notes, the Director is authorized to issue notes to the Secretary of the Treasury which will bear interest at a rate to be determined by the Secretary of the Treasury, taking into consider ation the current average market yields of outstanding marketable obligations of the United States having maturities comparable to the guaranties. The currencies determined to be unavailable for, or in excess of requirements of the United States as provided above shall be transferred to the Secretary of the Treasury to be held until disposed of, and any dollar proceeds realized from such dis position shall be deposited in miscellaneous receipts.

(4) 105 Section 701(a) of this Act shall not apply with respect to any amounts appropriated under this section for the purpose of he uidating the notes (and any accrued interest thereon) which were assumed in the operation of the informational media guaranty pro gram under this section and which were outstanding on the data of enactment of this paragraph.

AN ACT Making certain provisions with respect to internationally
recognized human rights, refugees, and foreign relations.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1.1 SHORT TITLE.

This Act may be cited as the "Human Rights, Refugee, and Other Foreign Relations Provisions Act of 1996".

SEC. 102.3 CONDUCT OF CERTAIN EDUCATIONAL AND CULTURAL EXCHANGE PROGRAMS.

In carrying out programs of educational and cultural exchange in countries whose people do not fully enjoy freedom and democracy (including but not limited to China, Vietnam, Cambodia, Tibet, and Burma), the Director of the United States Information Agency shall take appropriate steps to provide opportunities for participation in such programs to human rights and democracy leaders of such countries.

SEC. 103. EDUCATIONAL AND CULTURAL EXCHANGES AND SCHOLARSHIPS FOR TIBETANS AND BURMESE.

(a) ESTABLISHMENT OF EDUCATIONAL AND CULTURAL EXCHANGE FOR TIBETANS.-The Director of the United States Information Agency shall establish programs of educational and cultural exchange between the United States and the people of Tibet. Such programs shall include opportunities for training and, as the Director considers appropriate, may include the assignment of personnel and resources abroad.

(b) SCHOLARSHIPS FOR TIBETANS AND BURMESE.—

(1) Subject to the availability of appropriations, for fiscal year 1997 at least 30 scholarships shall be made available to Tibetan students and professionals who are outside Tibet, and

at least 15 scholarships shall be made available to Burmese students and professionals who are outside Burma.

(2) WAIVER.-Paragraph (1) shall not apply to the extent that the Director of the United States Information Agency determines that there are not enough qualified students to fulfill such allocation requirement.

(3) SCHOLARSHIP DEFINED.-For the purposes of this section, the term "scholarship" means an amount to be used for full or partial support of tuition and fees to attend an educational institution, and may include fees, books, and supplies, equipment required for courses at an educational institution, living expenses at a United States educational institution, and travel expenses to and from, and within, the United States.

SEC. 104. INTERNATIONAL BOUNDARY AND WATER COMMISSION. The Act of May 13, 1924 (49 Stat. 660, 22 U.S.C. 277-277f), is amended in section 3 (22 U.S.C. 277b) by adding at the end the following new subsection:

"(d) Pursuant to the authority of subsection (a) and in order to facilitate further compliance with the terms of the Convention for Equitable Distribution of the Waters of the Rio Grande, May 21, 1906, United States-Mexico, the Secretary of State, acting through the United States Commissioner of the International Boundary and Water Commission, may make improvements to the Rio Grande Canalization Project, originally authorized by the Act of August 29, 1935 (49 Stat. 961). Such improvements may include all such works as may be needed to stabilize the Rio Grande in the reach between the Percha Diversion Dam in New Mexico and the American Diversion Dam in El Paso.".

TITLE II-UNITED STATES INFORMATIONAL,

PART A-AUTHORIZATION OF APPROPRIATIONS

SEC. 201. AUTHORIZATION OF APPROPRIATIONS.

(a) IN GENERAL.-The following amounts are authorized to be appropriated to carry out international information activities, and educational and cultural exchange programs under the United States Information and Educational Exchange Act of 1948, the Mutual Educational and Cultural Exchange Act of 1961, Reorganization Plan Number 2 of 1977, the Radio Broadcasting to Cuba Act, the Television Broadcasting to Cuba Act, the Board for International Broadcasting Act, the Inspector General Act of 1978, the Center for Cultural and Technical Interchange Between North and South Act, the National Endowment for Democracy Act, and to carry out other authorities in law consistent with such purposes:

(1) SALARIES AND EXPENSES.-For "Salaries and Expenses", $487,988,000 for the fiscal year 1994 and $494,862,000 for the fiscal year 1995.

(2) 2 EDUCATIONAL AND CULTURAL EXCHANGE PROGRAMS.—

Title II, chapter 2 of the Emergency Supplemental Appropriations Act of 1994 (Public Law 103-211; 108 Stat. 16) required that $2,000,000 of the funds made available under this heading in Public Law 103-121 to be used to carry out projects involving security construction and related improvements for Agency facilities not physically located together with Department of State facilities abroad. Title III, chapter 2 of the same Act (108 Stat. 27), rescinded $2,000,000 from salaries and expenses.

(A) FULBRIGHT ACADEMIC EXCHANGE PROGRAMS.-For the "Fulbright Academic Exchange Programs", $130,538,000 for the fiscal year 1994 and $126,312,000 for the fiscal year 1995.

(B) OTHER PROGRAMS.-For "Hubert H. Humphrey Fellowship Program", "Edmund S. Muskie Fellowship Program", "International Visitors Program", "Israeli-Arab Scholarship Program", "Mike Mansfield Fellowship Program", "Claude and Mildred Pepper Scholarship Program of the Washington Workshops Foundation", "Citizen Exchange Programs", "Congress-Bundestag Exchange Program "Newly Independent States and Eastern Europe Training", "Institute for Representative Government", "American Studies Collections", "South Pacific Exchanges" "East Timorese Scholarships", "Cambodian Scholarships", and "Arts America", $96,962,000 for the fiscal year 1994 and $97,046,000 for the fiscal year 1995.

(3)3 BROADCASTING TO CUBA.-For "Broadcasting to Cuba", $21,000,000 for the fiscal year 1994 and $27,609,000 for the fiscal year 1995.

(4) INTERNATIONAL BROADCASTING Activities.-For "International Broadcasting Activities" under title III, $541,676,000 for the fiscal year 1994, and $609,740,000 for the fiscal year 1995.

For fiscal year 1995, the Department of State and Related Agencies Appropriations Act, 1995 (Public Law 103-317; 108 Stat. 1770) provided $468,796,000.

The Department of State and Related Agencies Appropriations Act, 1994 (title V of Public Law 103-121; 108 Stat. 1190), provided $4,247,000 for the Office of Inspector General.

For fiscal year 1995, the Department of State and Related Agencies Appropriations Act, 1995 (title V of Public Law 103-317; 108 Stat. 1769), provided $4,300,000.

The Department of State and Related Agencies Appropriations Act, 1994 (title V of Public Law 103-121; 108 Stat. 1191), provided $26,000,000 for the East-West Center.

For fiscal year 1995, the Department of State and Related Agencies Appropriations Act, 1995 (title V of Public Law 103-317; 108 Stat. 1772), provided $24,500,000.

The Department of State and Related Agencies Appropriations Act, 1994 (title V of Public Law 103-121; 108 Stat. 1194), provided $35,000,000 for the National Endowment for Democ
