SEC. 2. Be it further enacted, That said court shall appoint two house keepers of Scott county, who shall report on oath, their opinion of the value of said land, and whether it would be to the interest of said infants, that the same should be sold, and the proceeds vested as prayed for in said petition; and if pointed to valthe court shall be satisfied, that it would redound to the in- ue land. terest of the infants, that a sale should be made, a decree shall' be rendered, appointing a commissioner to make said sale; and also to make a conveyance, on such terms, and on such credits, as will best promote the interest of said infants.

SEC. 3. CHAP. 79.-AN ACT allowing an additional Justice of the Peace to the county of Todd, and for other purposes.

SEC. 1. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That there shall be allowed to the justice of the county of Todd, one Justice of the Peace, in addition to the peace to Todd number now allowed by law, to said county; and the county court, of said county, may, at such time as they think proper, select, and recommend to the Governor, for appointment, some suitable person of said county, having due regard to the convenience of the people of said county.

SEC. 2. Be it further enacted, That the act of Assemby, approved the eleventh day of February, eighteen hundred and thirty-six, entitled, an act to appropriate the fines and forfeitures of Green county, to the New Athens Academy, be, and the same is hereby repealed.

CHAP. 80.--AN ACT for the benefit of Andrew M'Clane.

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That the Auditor of Public Accounts, shall issue his

warrant upon the Treasury, in favor of Andrew M'Clane, for the sum of one hundred dollars, for the keeping and maintaining of Martha M'Clane, a person of unsound mind, from the first of December, eighteen hundred and thirty-five, to the first of December, eighteen hundred and thirty-seven.

CHAP. 81.--AN ACT for the benefit of Warner Crow, late Sheriff of Daviess county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That Warner Crow, late Sheriff of Daviess county, be allowed until the first day of June, 1837, to return his delinquent list of militia fines in said county; and that said list of delinquents, if duly returned by him by the first day of June, 1837, shall be as legal, in all respects, as if returned within the time now prescribed by law.

CHAP. 82.--AN ACT to incorporate the Graves Academy, and for other pur

poses.

SEC. 1. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That John Eaker, John Anderson, Jesse Wells, Samuel Maham and Joseph B. Travis, gentlemen, shall be, and they are hereby constituted a body politic and corporate, to be known by the name of the Trustees of the Graves Academy; and by that name shall have perpetual succession, and a common seal, and as a body corporate, shall be authorized to exercise all the powers and privileges now enjoyed by the trustees of any academy in this Commonwealth; and on the death, resignation, removal, or other disqualification of any May fill va of the said Trustees, or their successors, a majority of those remaining shall fill such vacancy, and the person or persons so appointed, shall be vested with the same power and authority, as if named specially in this act; and by the name and style of the Trustees of Graves Academy, may sue and be sued, implead and be impleaded, in any court of law or equity in this Commonwealth.

SEC. 2. Be it further enacted, That the lands granted to the county of Graves by the provisions of an act, entitled, an act appropriating a portion of the vacant lands, in the district of country west of the Tennessee river, for the purpose of education, approved, January 30, 1834, shall be, and the same are hereby vested in the Trustees of the Graves Academy; and it shall be the duty of the Register of the Land Office, at any Register to time when the said Trustees shall file in his office the original issue patents. certificate of entry, to issue patents thereon to said Trustees.

Be it further enacted, That the said Trustees may, and they are hereby authorized, to sell and convey to the respective purchasers thereof, all the lands, or any part thereof, vested in them by the second section of this act, either for sell lands. cash, or upon such credit as to them may seem fit and convenient: Provided however, That on all sales made on a credit, the purchaser shall pay interest on the amount of the purchase money from the date of the contract: And provided further, That the said Trustees shall be responsible in their individual. capacity for the amount of both principal and interest.

SEC. 4. Be it further enacted, That the monies arising from the sales of said lands shall be, by the said Trustees, loaned out, on good personal security, from year to year, and at the the end of every year the interest shall be added to the principal, and loaned out in like manner, from year to year, until the first day of January, 1847: Provided however, That said Trustees shall always be responsible in their individual capacity, jointly or severally, for all sums so loaned out, both principal and interest: And provided further, That the said Trustees, before they enter upon the duties of their office, take oath and shall take an oath faithfully, to discharge the duties enjoined on give bond. them by this act, and enter into bond, in the county court of Graves, with security to be approved of by the said county. court of Graves, in the penalty of five thousand dollars, conditioned that they will truly and, faithfully fulfil the duties enjoined on them by this act.

SEC. 6. Be it further enacted, That the Trustees aforesaid, shall make out a report, in writing, on the first day of November, annually, stating the quantity of land sold, and the person or persons to whom it was sold, together with the price for which it was sold; which said report shall be lodged with the Clerk of the Graves county court, to be by him carefully filed away and preserved, subject to the inspection of those whose interest or duty it may be to be informed of its contents.

CHAP. 83.--AN ACT for the benefit of Samuel Sanders, late Sheriff of Edmon

son county.

Be it enacted by the General Assembly of the Commonwealth of A credit to Kentucky, That the Auditor of Public Accounts be, and he is be allowed be hereby directed to allow to Samuel Sanders, late Sheriff of the Auditor:

1837. Edmonson county, a credit of one hundred and thirty-four dol lars and thirteen cents, as paid 29th January, 1834, against the judgment recovered by the Commonwealth at the July term, 1831, against said Sanders, as Sheriff aforesaid, and his securities, for the revenue tax collected by him in the year 1833; and in case the amount above directed to be credited against said judgment has been collected and paid into the public Treasury, the Auditor shall issue to said Samuel Sanders a warrant on the Treasurer for said one hundred and thirty-four dollars and thirteen cents, and the interest which accrued thereon after the 29th day of January, 1831, and which was collected by virtue of said judgment.

CHAP. 84.-AN ACT for the benefit of Isaac Swim and Sarah Swim, of Fleming county.

SEC. 1. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That the Auditor of Public Accounts be, and he is hereby directed to issue to Sarah Swim, the mother of Isaac Swim, a warrant on the public Treasury for seventyfive dollars, as a compensation to her for keeping the said Isaac Swim, a person of unsound mind, for the eighteen months last past.

SEC. 2. Be it further enacted, That the Fleming circuit court be hereby authorized to make such allowance out of the public Treasury, from time to time, for the support of said Isaac Swim, as the circuit courts have authority to make for idiots. Approved, January 13, 1837.

CHAP. 85,--AN ACT to establish the line between the counties of Morgan and
Lawrence,

Be it enacted by the General Assembly of the Commonwealth of* Kentucky, That the line between the counties of Morgan and Lawrence, shall be, and is hereby established as follows, towit: from the mouth of Newcomb's fork of Little Sandy river, said line shall run down said river to the mouth of Caney creek; thence up said creek, and the main south fork thereof, to the top of the ridge at the head of said fork and Christy's fork of Triplett's creek; thence with the ridge next above said Chris: ty's fork of Triplett's creek to the Fleming county line; and in all other respects said line shall remain as now established by law.

CHAP. 86-AN ACT for the benefit of Dempsey White, late Sheriff of Hick

man county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That the Auditor of Public Accounts, shall not be required to institute a motion in the general court against Dempsey White, Sheriff of Hickman county, or his securities, until after the first day of May, 1837, on account of the failure of said Sheriff to pay into the public Treasury the revenue tax due from said county in the year 1836: Provided, That said Sheriff shall pay, within the time prescribed by law, the whole of said revenue tax, except the sum of two hundred dollars.

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That Abraham Ramsey be restored to all the rights and privileges of an unmarried man.

CHAP. 88.--AN ACT for the benefit of Telitha Thatcher.

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That the marriage contract existing between Telitha Thatcher and Jonathan Thatcher, her husband, bè, and the same is hereby dissolved; and that the said Tolitha Thatcher be restored to all the rights and privileges of an unmarried woman; and that she be allowed to assume her former name of Telitha Vannay.
