conditioned as aforesaid, and for a breach of said bond, shall be subject to the same proceedings, and subject to the same penalties, that are prescribed in the seventh section of this act against delinquent collectors.

SEC. 9. That said Board shall fix, by law, the rate of com pensation to all of her subordinate officers; and shall have authority to sue for and recover all penalties annexed to a breach of their ordinances and by-laws, before a Justice of the Peace, or other proper tribunal, having jurisdiction thereof.

CHAP. 157.--AN ACT to authorize the Trustees of the town of Princeton to levy a tax to improve the streets.

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That the Trustees of the town of Princeton, in Caldwell county, shall have full power and authority to levy a tax upon all property, permanently situated within the limits of said town, for the purpose of paving or M'Adamizing the streets of the same, whenever it shall appear to the satisfaction of said Trustees, or a majority of them, that the individuals claiming or holding such property on any street or streets proposed to be improved shall be in favor of the measure.

CHAP. 158.-AN ACT for the benefit of David Armer.

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That the Auditor of Public Accounts be, and he is hereby requested to issue his warrant on the Treasurer in favor of David Armer for the sum of six dollars, and the Treas urer is hereby authorized to pay over the said sum to the said Armer, out of any money in the Treasury not otherwise appropriated.

CHAP. 159. AN ACT to extend the bounds of the Germantown Precinct, in the county of Mason.

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That the bounds of the Germantown Precinct,

1837. in the county of Mason, may be extended so as to embrace the northern bounds, commencing at the mouth of Pummell; thence up the north fork to the mouth of Clark's run; thence up the same to the forks thereof; thence up the west fork until it reaches Marshall's road; thence with said road to a road leading on between Alexander M'Intire and Samuel Worthington to the Minerva road; thence with the Minerva road to the ⚫ present boundary of said precinct.

CHAP. 160.-AN ACT for the benefit of Jeremiah Baker..

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That the marriage contract heretofore existing between Jeremiah Baker and his wife, Dicy, is forever dissolved, so far as respects said Jeremiah, and that he be, and is hereby restored to all the rights and privileges of an unmarried man. CHAP. 161.--AN ACT for the benefit of Peter Jones, of Livingston county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That it shall be lawful for Peter Jones, of Livingston county, to enter or cause to be entered in the Receiver's office at Waidsboro,' in the same manner and for the same price, that other lands are now subject to entry in the land district west of the Tennessee river, the north east fraction of quarter section 26, township 7, range 3, east of the meridian, containing nine acres and one hundred and twenty poles: Provided, That this act shall not be construed to authorize an entry of any other land than the quantity aforesaid, and upon which the said Peter Jones has now an improvement.

CHAP. 162.--AN ACT for the benefit of Thomas Wood.

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That Thomas Wood be, and he is hereby absolved from all the obligations consequent upon the marriage contract heretofore existing between him and Katharine, his former wife, and that his intermarriage with Harriet Johnson be, and is here.. by confirmed and legalized.

CHAP. 163. AN ACT to reduce the number of Justices of the Peace in Nelson county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That it shall not be lawful for the county court of Nelson, to nominate for appointment, persons to fill existing vacancies, nor any vacancy that may hereafter occur by death, resignation, removal or otherwise until the whole number of Justices of the Peace in said county shall be reduced to seventeen in number, and thereafter, the number of Justices of the Peace in said county shall be seventeen, instead of the number now provided by law.

CHAP. 164.--AN ACT to establish an Election Precinct in Cumberland county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That from and after the passage of this act, there is established upon Marrowbone creek, in Cumberland county, an election precinct, and that the place of voting shall be at the store of Thomas Strange.

CHAP. 165.--AN ACT for the benefit of Mason Morris.

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That the marriage contract heretofore existing between Mason Morris, and his wife Malinda Morris, is forever dissolved, so far as respects said Mason, who is hereby restored to all the rights and privileges of an unmarried man: Provided however, That the said Mason Morris shall not have said divorce until he shall restore to his said wife all the personal and real estate derived from her; and in the event that he should elect the divorce aforesaid, upon the terms aforesaid, he may file a bill in chancery, in the Clarke circuit court, against his said wife, and the said court shall, after the regular service of process, cause an account to be taken by a Commissioner, of the estate of the said Malinda Morris, at the time of her intermar riage with said Mason Morris, and when said estimate is reported and confirmed by said court, and the said Mason Morris shall execute proper deeds of conveyance for the said property, to be approved by said court, and shall deliver the possession of said property to his said wife, then the said court shall enter a decree for the divorce aforesaid.

CHAP. 166.-AN ACT to authorize the county court of Monroe county, to ap propriate $100 of the money arising from the sale of the vacant lands in said county, to finishing the court house of said county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That the county court of Monroe county be, and they are hereby authorized, a majority of all the Justices in said county being present, to appropriate the sum of one hundred dollars of any money arising from the sale of vacant land in said county, to the finishing of the court house in said county. CHAP. 167.-AN ACT for the benefit of Elizabeth Keaton.

Be it enacted by the General Assembly of the Commonwealth of Kentucky, That Elizabeth Keaton, the wife of John Keaton be, and she is hereby restored to all the rights and privileges of an unmarried woman; and that in future her name shall he Eliza beth Shelton.

CHAP. 168.--AN ACT to establish a State road from Cadiz in Trigg county', through Eddyville, to Salem in Livingston county, and for other purposes.

SEC. 1. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That Robert Baker, of Trigg county, Commission- Graves Howard and Delaney Hall, of Caldwell county, and ers appointed Bryant Bennett, of Livingston county, be, and they are hereby appointed Commissioners, to view and mark the best and most practicable route, for a State road from Cadiz in Trigg county, to Salem in Livingston county, by way of Eddyville in Caldwell county; who, or a majority of whom, shall meet in the said town of Cadiz, on the first Monday in May next, or as soon therewhere they are after as practicable, and proceed to view and mark the route for said road, giving notice thereof to those over whose land the road is proposed to run; provided they be known to said Commissioners; and if desired by said owner or owners, they shall estimate the damages he, she, or they may sustain by the esTo estimate, tablishment of the road; and shall report their proceedings to damages if de- the county courts of Trigg, Caldwell and Livingston, stating also the number of days they have been employed, by the provis ions of this act, in discharge of the duty assigned them.

SEC. 2. That if any proprietor of land, over which the road may be establised, should fail to require an assessment of damages by the Commissioners, and should apply to the county court, of the county in which the land may lie, the said court shall make an order for the assessment of dama

SEC. 3. That if the several county courts, of the coun⚫ ties through which the proposed road is to run, shall agree laid off into to pay the damages which may be assessed in their tive counties, they shall proceed to lay off said road into convenient sections or precincts, within their respective coun ties, and appoint overseers, and a sufficient number of hands, to open and keep said road in repair twenty feet in width.

SEC. 4. SEC. 6. That John Mercer, Mathew Lyon and Peter Fite, be, and the same are hereby appointed Commissioners, to procure the construction of a bridge across Eddy creek, at the point where said road crosses said creek; and it shall be the duty of said Commissioners, or a majority of creek, them, to draft the plan of said bridge, and open a subscription for the purpose of procuring funds for the erection of the same. SEC. 7. That when, in the opinion of the Commissioners, or a majority of them, a sufficient amount of money has been subscribed, it shall be the duty of the Commis. sioners to enter into contract for the building of the same; taking bond with approved security, for the performance of the contract within one year after the contract is entered into.
