terminating with the signature of the treaty of peace on the 29th August, 1842, twelve months' batta.

2nd. To those who served only in the Yeang Tsze Keang River, six months' batta.

3rd. To those who were retained in occupation of Hong-Kong and other stations on the coast of China, and thereby effectually, though less directly, contributed to the ultimate result of the war, six months' batta.

3. It is further H.M.'s pleasure that the payment should be made to the naval and military forces of H. M. and to those of the East-India Company, according to their corresponding ranks in the respective services.

4. The whole of the claims on the part of the royal navy, and of such regiments of the royal army as shall have returned to this country, excluding such officers and men as have remained in India, will be adjusted here, under the orders of the proper authorities of H.M.'s Government, and with the view of enabling us to issue the shares due to the naval portion of our service now in England, as well as those due to officers and men of our army who may have died or returned to England since August, 1841, we desire to be furnished, without loss of time, with returns of the names of all officers and men so circumstanced..

5. The claims of parties remaining in India will be adjusted by your government.

6. We herewith transmit copy of a letter from Mr. Trevelyan, dated 31st ult., requesting, by direction of the Lords Commissioners of H.M.'s Treasury, that the whole of the sums which have been or may be realized by the sale of property captured or detained during the progress of the war in China, whether the same were realized in India or China, shall be placed to the credit of H.M.'s Government in the account of the China expedition. COURT MARTIAL.

ENSIGN RALPH DUDGEON, H. M. 17TH REGT. Head-Quarters, Simla, 6th Nov. 1844.-At a General CourtMartial, holden at Poonah, on Friday, on the 4th day of October, 1844, Ens. Ralph Dudgeon, of her Majesty's 17th regt. was arraigned on the following charge :

Charge. For highly disgraceful conduct, unbecoming the character of an officer and a gentleman, in having, in the cantonment of Ahmednuggur, on or about the night of the 18th Aug. 1844, repeatedly made use of most grossly insulting language towards Ens. Bourke, of the same regiment.

Finding.-The Court, from the evidence before it, finds the prisoner, Ens. Ralph Dudgeon, of her Majesty's 17th regt. guilty of the charge preferred against him to the extent of disgraceful conduct, unbecoming the character of an officer and a gentleman; but acquits him of conduct highly disgraceful.

Sentence. The Court, having found the prisoner guilty of the charge to the extent above specified, which, being in breach of the articles of war, does adjudge him to be dismissed her Majesty's service.

Recommendation.-The Court, taking into consideration the provocation received by the prisoner, and making allowance for his excited feelings in an unguarded moment, strongly recommends him to the merciful consideration of his Excellency the Commander-in-Chief.

Remarks by the Commander-in-Chief in India.-The Commander-in-Chief, at the recommendation of the Court, is pleased to remit the sentence which Ens. Dudgeon has justly incurred, trusting that the peril he has been in will have due effect. Ens. Dudgeon must recollect that, not alone in public society, but equally in private life, courtesy and good breeding are absolutely essential to the character of a gentleman, that the strictest guard should be kept on conversation on all occasions, and that no language reflecting on the veracity of a brother officer can be tolerated.

The sentiments of the Commander-in-Chief are to be communicated to Ens. Dudgeon in the presence of the officers of her Majesty's 17th foot, by the officer commanding the regiment, who will further express his Excellency's extreme displeasure that Ens. Dudgeon should have been so unguarded in his language as has been proved on the present occasion.

Charge. For conduct unbecoming the character of an officer and a gentleman, and to the prejudice of good order and military discipline in the following instances:

First Instance.-In having in Trichinopoly, on the 24th of June, 1844, when at a dinner-party at the house of Lieuts. D. J. T. King and H. Acton, of the 4th light cavalry, and before the cloth was removed from the table, been in an extreme state of intoxication, thereby incapacitating himself from the performance of his duty as a medical officer in the event of his professional services having been required.

Second Instance.-In having at the time and place, and on the occasion set forth in the first instance or charge, submitted to be treated with great indignity, contempt, and insult by the aforesaid Lieut. Acton and other officers then and there present, who threw quantities of water and beer over him, while a servant, by Lieut. Acton's orders, threw a tumbler of beer in his face, he, the said Assist. surg. Currie, having neglected to take early and sufficient measures, and to use his best endeavours to procure explanation, apologies, and redress from the parties concerned for the indignities offered him, or to bring their conduct to the notice of his commanding officer, thereby betraying a culpable disregard for, and indifference to, his own reputation and ho

Currie, M.D., has urged in his defence, is of opinion :Finding on the First Instance of Charge. That the prisoner is guilty.

Sir, I have the honour, by order of the Most Noble the Commander-in-Chief, to return the proceedings of the general courtmartial upon the trial of Assist. surg. Currie, M. D., for the re-consideration of the Court.

I am instructed to state, that in the special finding of the Court, on the second instance of charge, the Court has found certain facts and acquitted the prisoner of the remainder of the instance in question, whereby it has in effect rejected the imputation grounded on those facts of the prisoner's conduct, being, as affirmed, unbecoming the character of an officer and a gentle

man.

As his lordship cannot conceive that this omission has been intentional on the part of the Court, and as a court-martial is bound to exhaust in its finding all and every part of the charge before it, I have been directed to return the proceedings for correction in this inaccuracy, whereby the finding on the second in

For conduct unbecoming the characters of officers and gentlemen, and to the prejudice of good order and military discipline, in having at Trichinopoly, on the 24th of June, 1844, at a dinner-party given at the house of the said Lieuts. King and Acton, treated Assist. surg. W.F. Currie, M.D., attached to the 4th It. cav., with great indignity, contempt, and insult, more particularly in having encouraged and directed servants to throw quantities of water and beer over him, and to offer him other indignities, thereby subjecting the said Assist. surg. W. F. Currie to insults not to be submitted to by an officer having due regard to his reputation and character.

The Court having most maturely weighed and considered the whole of the evidence brought forward in support of the prosecution on the charge, as well as what the prisoners, Lieut. D. J. T. Sentence.-The Court having found the prisoners guilty as above stated, doth sentence them, the said Lieut. D. J. T. King and Lieut. H. Acton, both of the 4th It. cav., to be dismissed the service.

WHISTLER, Deputy Judge Advocate Recommendation of the Court.-The Court throughout the trial in which it has been engaged, has had a most painful duty to perform, the conscientious discharge of which it has not shrunk from. Viewing, however, all the circumstances which have led to the present unfortunate result, the youth of the prisoners, their short period of service, their expression of deep regret which the Court believes to be sincere, coupled also with its belief that the subject of the charge was considered by the parties more as a boyish freak than premeditated insult, and that years and a greater experience in the service would have led to very different conduct on the part of those who have
