Remarks by the C.-in-C. on the trial of Enss. Davidson and Collingwood, H. M.'s 78th Highlanders.

After due deliberation, I have confirmed the decisions of the court-martial on these trials without directing a revision; but I cannot wholly concur in the finding in either case, and I deem the sentences in both most inadequate.

The Court, in acquitting Ens. Collingwood of the first instance of the charge, has misapprehended the real circumstances of the case, and the application of evidence in relation to that officer. For although he may not have actually entered the quarters of Ens. Maclean on the night of the 20th of January last, it is clearly established that he was on the top of the house, and within the premises, aiding and abetting the acts of Ens. Davidson, by which he became fully implicated in what was done by the latter.

The concluding modification of the Court in the finding on the 3rd instance in both cases, appears to me to be wholly irrevalent and unsupported, as the prisoners are charged with conduct tending to excite or provoke a challenge, without reference to their intention, to which, however, very conclusive proof may be drawn from the highly culpable act of which they have been declared guilty.

With these circumstances before me, I feel imperatively called on to express my disapproval of the undeserved lenity of the Court in the sentences which it has passed, as they are in both cases improperly incommensurate even with the qualified findings. Courts-martial in their capacity of judges are bound to administer justice by awarding a penalty proportionate to the nature and degree of the offence of which the prisoner has been convicted, uninfluenced by mitigating circumstances, which should in a recommendation be brought under the consideration of the confirming authority, in whom alone the exercise of mercy is vested by the sovereign. ENS. RALPH DUDGEON, H. M. 17th REGT. Head- Quarters, Bombay, 14th April, 1845.-At a general court. martial holden at Poona, March 7, 1845, Ens. R. Dudgeon, H.M. 17th regt., was arraigned upon the following charge, viz. : Charge. For conduct subversive of good order and military discipline, and for contempt of the authority of me, his commanding officer, in having, at Ahmednuggur, in a letter addressed to Lieut. G. H. Messiter, staff-officer of the wing, dated Feb. 6, 1845, refused to obey my positive order, conveyed to him in a letter from Lieut. Messiter, dated Feb. 5, 1845, to immediately send away the wife of the serjeant-major of the 1st batt. of Bombay artillery, who was avowedly residing under his (Ens. Dudgeon's) unauthorized protection. Ahmednuggur,

Dudgeon, viz. : For disgraceful conduct, highly unbecoming the character of an officer and a gentleman, in having in the officers' lines at Ahmednuggur, on or about the evening of the 7th February, 1845, violently assaulted Lascar Dwarko Mallee, belonging to the regiment of Bombay Artillery, by striking him (the said Dwarko Mallee) with his fists, and otherwise illtreating him. Upon which charges the Court came to the following decision:

Finding and Sentence.-The Court having maturely weighed and considered all that has been adduced in support of the prosecution, as well as what has been brought forward on the defence, are of opinion, that with respect to the first charge, he, Ens. R. Dudgeon, is guilty.

With respect to the additional charge, that he, Ens. R. Dudgeon, is not guilty, and do therefore fully and honourably acquit him of the same.

The Court having found the prisoner guilty to the extent specified, do sentence him, the said Ens. R. Dudgeon, to be severely reprimanded, in such manner as his Excellency the Commander-in-Chief may deem fit.

REMARKS BY THE COMMANDER-IN-CHIEF.

The original charge in the present case, on which the Court has passed an unqualified verdict of guilty, sets forth an offence of the most dangerous consequences to the discipline of the army, and a delinquency of such a nature called for a punishment far exceeding the severest censure which could be recorded.

I feel compelled to notice with marked disapprobation the highly improper and unsupported assertions contained in Ensign,

Dudgeon's address in his defence, in respect to the alleged treatment which he received from Major Gordon and the officers of the left wing of H.M.'s 17th regt. after his last trial, and which might be made the subject of another charge against him. I therefore regret that the Court did not, in the exercise of its undoubted control over its proceedings, summarily expunge the whole of the objectionable matter, when the prisoner only partially complied with its recommendation on that point.

The Court having recorded a very inadequate sentence, nothing now remains for me but to convey to Ensign Dudgeon the severe reprimand which has been adjudged, and to express my hope that some change may exist; that the very great leniency which he has now experienced will not pass unheeded by him, or be unproductive of beneficial effects on his future (Signed) THOMAS MCMAHON, Lieut.-gen. and Commander-in-Chief. A Malay prahu, which arrived here on Monday, from Pulo Aor, brought three Chinese passengers, who state that they are the only survivors of the crew of a Chinese junk, which was lost on the passage from Java to China. It appears from their account, that this junk left Canton in 1843 for Batavia, where they arrived in due time and remained three months-then they went to Benea and received 140 passengers for Chinanext reached Hainan, where 100 of the passengers disembarked and then left for Canton with ninety persons on 'board. The day after leaving Hainan the junk experienced a severe typhoon, which occasioned the loss of the vessel, and all perished excepting seven men, who sought safety on the junk's water-tank, carrying with them a small quantity of rice which lasted them ten days. In this singular craft they state that they floated about for fifty days, at the mercy of the wind and tide, subsisting latterly on sea-fowls which they caught occasionally, when they alighted on it-on a few fish which they captured, and on rain water, when they could get it. Four of their fellow-sufferers died, and their square craft was at length drifted towards Pulo Aor, where it was discovered by some fishermen, who took them into their boats, and conveyed them on shore, where they were treated humanely by them, and remained four months. The junk was probably lost in November, supposing that the survivors were fifteen days at sea, instead of fifty days, as they state. One of the men persists very positively in his statement-the number of days they were afloat in their strange barque; the others speak less positively on this point, appearing not to have a very clear idea of the length of time, but in every other particular they all agree-Singapore Free Press.

The French vessels of war La Cleopatra and La Victoreuse,

and the steamer L'Archimede arrived here on Thursday last, his Excellency M. Legrerne, the Ambassador and Plenipotentiary from the King of the French to the Emperor of China, being on board the Cleopatra. His excellency with his family landed on Saturday under the usual salute, and was received at the landing place by the Governor and public functionaries with a guard of honour, and proceeded to the Government Bungalaw, where they are sojourning with the Governor and his lady. We believe his excellency takes his departure for Batavia to-morrow, and will afterwards visit different parts of the Archipelago, about June returning to Singapore to meet the Marquis de Farrien, who is expected to arrive about that time from France with the ratified treaty, when the French Mission will return to China. We do not know whether his excellency will then make an attempt to be allowed to go to Pekin.

It will be recollected, that some months ago an officer and boat's crew, belonging to the French frigate Sabine, were cut off at Basilan, one of the Sooloo islands, the officer being killed, and the rest made prisoners. On the occasion of their recent visit to Manilla, the French vessels of war, in conjunction with a Spanish frigate, proceeded to Basilan, where, after ransoming the prisoners,they commenced operations against the piratical natives. They destroyed the houses, cattle, and crops, and burnt a boatbuilding establishment, which is said to be the principal place where all the piratical prahus which swarm in that part are built. The inhabitants fled to the mountains, so that the loss of life was inconsiderable.-Ibid, March 20.

HONG-KONG, February 6th, 1845. Since the dispatch of my last the September mail has come to hand; but as there are now three mails due, there is still great stagnation of business, and, in particular, a great dearth of information from the non-arrival of expected advices. We continue to have winterly weather, very similar to the same month in a very mild English winter, with occasional very heavy falls of rain. The health of the colony continues to improve. This week occurs the Chinese festival of the new year, and the great object of ambition amongst our interesting neighbours appears to be the providing brilliant displays of fireworks, lanterns, and numberless contrivances classed under the denomination (which none but your Chinese readers will appreciate), “ josspidgeon." For this purpose, and to enable them to visit their native place often, at the expense of a journey of hundreds of miles, the Chinese are most anxious to collect all the money they can raise at this time in the year; accounts are universally settled, stocks sold off, and many curious and interesting specimens of Chinese industry are to be purchased cheaper than at any other time of the year.

The Supreme Court met on the 1st. inst., for dispatch of civil business. Few cases of interest have as yet come before them, but there are one or two causes for trial in which Chinese are concerned, and it is extremely gratifying to find, that the native residents begin to appreciate and place confidence in the English law as administered in this colony; the right of arrest of debtors about to abscond from the island appears to meet their views especially. One instance occurred lately when, to make sure of their object, the creditors first secured the delinquent, and then the sheriff's officer was applied to, who found the unfortunate debtor (an English builder and contractor) carefully guarded by three indignant creditors, bludgeon in hand.

The Agincourt, 72, with the Vixen steamer, has arrived from the north. The Vestal, 26, sailed on the 29th for Trincomalee. The Wolf, 18, is expected to leave for Calcutta in a few days.

The Sapphire sailed on the 30th for Chusan, with a detachment of the 98th regt. ; the remainder of that regiment at present quartered here is to follow her immediately, and to be relieved by the 18th Royal Irish from the north.

February 8th, 1845. As the Zoé has been detained till this day, I am enabled to give you the arrivals of shipping to this date. I have no further news to communicate, except that the festivities of the Chinese new year are continued in a most quiet and respectable manner

and are marked chiefly by the closing of the shops and general cessation of employment, and the superior dresses displayed by all classes.

March 4, 1845.

On the 24th ult. the November overland mail reached us; the October and December mails are both expected in the course of a few days. The course of the post is so irregular during the north-west monsoon, that we more than ever feel the want of the improved communication to be effected by the employment of steam-power-a measure so essential to the welfare of the community settled in China, that great anxiety is expressed as to the progress of the necessary arrangements.

We continue to have very favourable weather, and the general health of the colony calls for a most favourable report; among the troops an improvement has taken place in this respect, and we are all very sanguine that next season will find us better prepared to resist the ill effects of the climate. Houses still continue a favourite speculation, though I observe several completed, and unoccupied, while the high rents at first demanded are gradually reduced in rate; the public works and improvements continue to be carried on with spirit, especially those connected with the drainage of the town and streets; and two more lines of road are in course of formation, extending for several miles east and west from the town, opening several available tracts of ground, at present almost unknown to even the oldest resident here; the scenery traversed by these lines, so far as I have had an opportunity of inspecting, presents features of the most interesting and picturesque nature, deep ravines surrounded on all sides by lofty hills, rising in the centre of the island to a height of two thousand feet above the sea; while the innumerable streams that traverse the island give rise, in the driest seasons, to a series of graceful waterfalls, dashing over the rocks in their precipitate descent; vegetation is not very abundant, though a considerable number of cattle and sheep are fed upon the hills, where the pasture is worth anything.

It is understood that the Sceptre troop-ship shortly proceeds to Kolingsoo, which port is to be immediately abandoned. Mr. Levy, the consul there, proceeds to Amoy, and Mr. Alcock, viceconsul, to Foochowfoo. Captain Gifford has arrived, overland, to command the Wolverine, now at Singapore; the Wolf has gone to Bombay, with specie, to be converted into rupees, and returned here. Admiral Sir Thomas Cochrane has lately returned from an expedition to the Formosa coast, and has visited several ports, seldom, if ever, before explored by Europeans, and has discovered a most eligible harbour at the Piscadores. The 18th Royal Irish have established their head-quarters here, while the 98th go to the north; the 4th Madras N. I. expect to leave this for India shortly, and a corps of 1,000 strong are organizing in Madras for three years' service in China.

H. M. ship Agincourt and naval squadron left yesterday for a cruise.

Lieut. Macdonald, of the 98th, has been brought to a courtmartial, under rather anomalous circumstances. The police here are all drafted from that regiment, and one of them having risen to the post of bailiff of the Supreme Court, though still on the books of the regiment, and it happened that he had to serve a writ upon his superior officer. The case is certainly a novel one, involving some curious questions of regimental discipline versus contempt of court; the trial is still pending. Victoria has been particularly gay lately; favoured by the cool weather, several elegant balls have been given; and though we are at present, of course, blessed with a very limited muster of the fair sex, they have generally gone off well. The dances of course, not the ladies, though there is every prospect of a similar result in their

case.
