amount thereof, and the name of the person in whose favor the same was drawn, and it shall be the duty of the treasurer to prepare and keep a well bound book, with proper headings and rulings, in which he shall make a record of each warrant of the territory outstanding on the first day of May, A. D. 1887, in the order in which the same may have been issued, stating in such record the number of the warrant, the date of the warrant, and the name of the person in whose favor drawn, and the amount thereof, and such warrants shall be paid by the treasurer of the territory at his office, in the order of their issue.

SEC. 4. On and after May 1st, A. SEC. 5. None of the foregoing provisions shall apply to any warrants of this territory, issued under the provisions of an act of the legislative assembly of this territory, approved the 28th day of January, A. D. 1867, entitled 'An Act to amend an act entitled, 'Militia.'

SEC. 6. All persons holding any county warrants on the first day of May, A. D. 1887, may on or before the first day of July, A. D. 1887, report the same to the treasurer of the county, giving him the number and date of such warrant, the amount thereof, and the name of the person in whose favor the same was drawn, and it shall be the duty of the treasurer of each county to prepare and keep a well bound book, with proper headings and rulings, in which he shall make a record of each county warrant outstanding on the first day of May, A. SEC. 7. On and after May 1st, A. D. 1887, it shall be the duty of the board of county commissioners in each county in this territory to report to the treasurer of their respective county all warrants drawn on such treasurer on and after that date, giving the number of such warrant, the date thereof, the name of the person in whose favor drawn, the amount there of, and stating the purposes for which drawn, which shall be recorded by the said treasurer, under the proper head, in the book required to be kept by him in accordance with section six of this act, and said warrants shall be paid by him in the order of their issue: Provided, that if any warrants that may be outstanding prior to the first day of May, A. D. 1887 shall be reported to him by any person holding the same after the first day of July, A. D. 1887, the same shall be recorded by him in said book, on the day he receives the report thereof, and they shall be paid in the order as if they had been issued on the day of the receipt of said report.

SEC. 8. This act shall be in force and effect from and after the first day of May, A. D. 1887, and all laws and parts of laws in conflict herewith are hereby repealed from and after said first day of May, A. D. 1887. Approved February 24, 1887.

CHAPTER XLVII.

FIREMEN.

AN ACT entitle on act relative to volunteer firemen.

Be it enacted by the Legislative Assembly of the Territory of New Mexico:

SECTION 1. That all persons who are bona fide members of any volunteer hose company, hook and ladder

company, or any fire department or company in this territory, who serve without compensation, as members of such fire companies, be and are hereby declared to be exempt from service as jurors in any court in this territory, also from service in the militia of said territory.

SEC. 2. Any person who is a member of any of the above organizations, when called upon to serve as a juror, or to act as a militiaman, shall produce a certificate stating of what organization or company he is a member, when he became a member of such company or organization, that he is a member in good standing and signed by the secretary of his company or organization, and the chief of the fire department to which said company or organization belong; and the said certificate shall be received as prima facie evidence in any court of this territory that the said person is a volunteer fireman, and entitled to the benefit of this act.

SEC. 3. That the foregoing sections shall only apply shall not apply and inure to the benfit of active members of said organizations, and any such member who shall not have been in active duty for a period of time equal to three consecutive months, shall be deemed to have forfeited his right to the above exemption, and that said exemption shall in no manner be claimed or construed to apply to any honorary or nonactive member of any such organization.

SEC. 4. This act shall take effect from and after its passage, and approval.

CHAPTER XLVIII.

HISTORICAL ARTICLES.

AN ACT to aid in the preservation and exhibition of articles of historic value and interest in New Mexico.

Appropriation.

Be it enacted by the Legislative Assembly of the Territory of New Mexico:

SECTION 1. The sum of $400, per annum, is hereby appropriated to the Historical Society of New Mexico, to be expended in the care and preservation of the collection of articles of historic interest, in its possession, and in the purchase, erection and repair of suitable cases, shelving, files and other appliances required for its work. rooms of the said society shall be kept open to the public, free of any charge, at suitable hours, every day. Said society shall make a report of its operations, at each session of the legislature.

SEC. 2. The territorial auditor shall draw his warrant on the treasurer of the territory, in favor of the treasurer of the said society, for the sum of $100, on the first days of February, May, August and November, of each year, in payment of the above appropriation.

SEC. 3. This act shall take effect immediately.

AN ACT adopting an official index to the compiled laws of New Mexico.

Be it enacted by the Legislative Assembly of the Territory of New Mexico:

SECTION 1. That the following index to the compiled laws of New Mexico of 1884 be and the same is hereby adopted as the official index of said laws. That the territorial auditor be and he hereby is directed to draw his warrant upon the territorial treasurer for the sum of one hundred and fifty dollars in favor of H. Burns for his services in the preparation of such index.
