July, 1841. At November term, 1842, judgment was obtained in Kentucky for $65; and upon ex- ecution the marshal returned, that he had moved out of the district. On the 13th July, 1844, dis- trict attorney was instructed to issue execution, di- rected to the marshal of Missouri, and send it to the district attorney for that district, who was di- rected, in his turn, to discontinue the suit brought in Missouri.

Upon failure of the usual efforts to collect by draft, suit was directed, 3d January, 1840. Suit abated as to Terry, but judgment was obtained, May, 1840, against the sureties, for the amount. Five execu- tions have issued, and no property has been found. Upon failure of the usual efforts to collect by draft, 360 21 suit was directed, and judgment was obtained against the sureties for the amount. The special agent, Mr. Green, has reported that the amount has been paid by the sureties; but the marshal, lately remov- ed for default, has not reported it, nor has evidence been obtained to charge him. The amount is con- sidered good in his hands.
Upon failure of the usual efforts to collect by draft, 1054 09 suit was directed, 10th October, 1839. Judgment was obtained, May, 1840, against the principal for $800, and against the sureties for $516 64, being the amount of the double estimate for the portion of the account not barred by the statute. The amount of the debt was $1,312 43. On the 30th March, 1841, the marshal paid over, as collected from the sureties, $237 20, leaving amount due as stated. At the session of 1841-'42, Congress released one- half of the judgment against the sureties, and on the 14th February, 1842, they paid $21 14, the bal- ance due on the other half. Fi. fa. was issued against Carter.
Upon failure of the usual efforts to collect by draft, suit was directed, 25th March, 1840. Judgment was obtained against the sureties, November, 1840, for $400, the amount of their bond. Execution issued, and was returned, "No estate," Novem- ber, 1840. It being ascertained that Dunlap had removed to the district of Missouri, suit was directed in it, 29th June, 1841. On the 29th November, 1841, $400 was made on the judgment in Kentucky; and Dunlap not being found in Missouri, on plu. ries capias, suit was dismissed.

Upon failure of the usual efforts to collect by draft, $88 71 suit was directed, 6th March, 1841. Judgment was obtained, November, 1842, against all, for the amount. Execution issued. On the 30th August, 1843, the late marshal made a return on three suc- cessive executions-the first not executed in conse- quence of an error in the name, and the other two not executed for want of time. No return has been received since.
Upon failure of the usual efforts to collect by draft, suit was directed, 17th June, 1842, and judgment was obtained against all the defendants, May, 1844, for the amount, with interest. The execution is- sued has not been returned.
