I, James Blaine, clerk of the circuit and county courts, and ex officio recorder within and for the county aforesaid, do hereby certify, that James Blaine, whose name is affixed to the foregoing affidavit, as the officer before whom the same was made, is, and was at the time of taking the same, an acting justice of the peace within and for the county aforesaid, duly commissioned and qualified, and that full faith and credit are due, and ought of right to be given, to all his official acts as such.

STATE OF ARKANSAS, County of Chicot:

Personally appeared before me, S. E. Jones, an acting justice of the peace within and for the county of Chicot aforesaid, Philip Booth, of said county, of lawful age, who, being duly sworn, states that in the year eighteen hundred and thirty-three, Thomas Barnard, by his negroes and overseer, cut down the cane and deadened the timber on a portion of the southeast quarter of section twenty-two, in township eighteen south, of range one west of the fifth principal meridian. That, having so cleared and prepared said portion of said quarter section for cultivation, he enclosed the same as a part of his plantation, and made a crop on it in the year eighteen hundred and thirty-four. That it was planted and so enclosed, and constituted a part of the plantation of said Barnard, on and before the nineteenth day of June, in the year eighteen hundred and thirty-four. That said Barnard has continued to cultivate the same every year since the year last aforesaid; and, as this deponent is well satisfied, now has the whole of said quarter section in cultivation, having greatly enlarged his plantation since the year eighteen hundred and thirty-four. This deponent further states, said Barnard has a large cotton gin and other valuable improvements on said plantation, and a large number of negroes; how many, this deponent cannot state with certainty, but is satisfied that there are as many as forty or fifty working hands. None of the houses and out-houses of said Barnard are situated on said quarter section, except a shed to shelter the negroes in time of rain, and for cotton and cotton baskets. The cotton gin aforesaid is placed near the line dividing said quarter section from the front and adjoining fractional quarter section. Further this deponent saith not. PHILIP BOOTH.

I, Alexander Kerr, acting clerk of the county court within and for the county and State aforesaid, do hereby certify, that Samuel E. Jones, whose name is subscribed to the foregoing deposition, as the magistrate before whom the same was made, is, and was at the time of taking the same, an acting justice of the peace in and for the county aforesaid, duly commissioned and qualified according to law, and that full faith and credit are due to all his official acts as such.

In testimony whereof, I have hereunto set my hand and affixed the seal of said court, at Columbia, this second day of January, one thou[L. s.] sand eight hundred and thirty-eight, and of the State of Arkansas the second year.

STATE OF ARKANSAS, County of Chicot :

This day personally appeared before me, S. E. Jones, an acting justice of the peace of the county of Chicot aforesaid, William Richmond, of the age of twenty-one years and upwards, and a resident of said couniy, who, being duly sworn, deposes and says, that in the year eighteen hundred and thirty-three, or the early part of said year, and until the month of February of said year of 1833, and also in the latter part of the year eighteen hundred and thirty-two, he was employed by Mr. Barnard, to wit, Thomas Barnard, to take charge of his plantation and negroes. That the number of negroes was then between twenty and thirty; that said plantation then included a body of land of twenty-five or thirty acres in cultivation, being planted in corn and pumpkins in 1832, and in cotton also in the year succeeding, and that there was also about a hundred and twenty or thirty acres cleared and prepared for cultivation, the cane and underwood having been cut down, and the timber deadened. That, in the year eighteen hundred and thirty-two, a small portion of the southeast quarter of section twentytwo, in township eighteen south, of range one west of the fifth principal meridian, which quarter was adjoining the said plantation of said Thomas Barnard, was cleared and prepared as above described for cultivation, and some corn and pumpkins were planted, but, the ground not being enclosed, they were not tended. That in the succeeding year, to wit, in the year eighteen hundred and thirty-three, a large portion of said quarter section was cleared in the same way as above described, and thus prepared for a crop for the next year, to wit, the year eighteen hundred and thirty-four. And this deponent is also confident, so far as his memory serves him, that the portion of said quarter section which was so cleared and prepared for a crop was also fenced in in the year eighteen hundred and thirty-three. This deponent further states, that on and before the nineteenth day of June, in the year eighteen hundred and thirty-four, said quarter section was enclosed, and constituted a part of the plantation of said Barnard, and was

planted either in cotton, or in corn and pumpkins, this deponent cannot now remember which. This deponent cannot tell how many acres were so cleared, fenced, and planted, on and before the said nineteenth day of June, in the year eighteen hundred and thirty-four, but states that it has been in cultivation every year since the year last aforesaid; and that, to the best of his knowledge and belief, the whole of said quarter section is now enclosed as a part of the plantation of said Barnard, and in actual cultivation by him. This deponent further states, that the house and out-houses of said Barnard were none of them on said quarter section, but on land adjoining the same. That, to the best of the knowledge and belief of this deponent, said Barnard has ever since the year eighteen hundred and thirty-two had an overseer and negroes on said plantation, and has kept the same in continual occupancy and cultivation to the present year, inclusively. Further this deponent saith not.

Personally appeared before me, acting justice of the peace for said county, Philip Booth, who, being duly sworn, upon oath, says the following are the facts, viz:

That, in the year eighteen hundred and thirty, he was well acquainted with the lands now owned by Thomas Barnard; and that in June, eighteen hundred and thirty-four, he was called on by Barnard to testify to his improving of the southeast quarter of section number twenty-two, in township eighteen south, of range one west. That, in the year eighteen hundred and thirty-two, said Barnard moved his negro hands on said farm or lands; and in eighteen hundred and thirty-three he improved the above named quarter, by clearing the land and fencing several acres; and in June, eighteen hundred and thirty-four, he saw the said quarter in cultivation of corn and pumpkins, &c.; and that said Barnard has continued to keep up said cultivation ever since, on said lands or farm, and has some four or five hundred acres under cultivation; and said quarter is comprised in near the centre of said farm, and has been in cultivation ever since, up to present date.

PRE-EMPTION ACT, 19TH JUNE, 1834.

LAND OFFICE, HELENA, August 10, 1835.

It is hereby certified, that, in pursuance of law, Thomas Barnard, of Chicot county, Territory of Arkansas, on this day purchased of the register of this office the lot or southeast quarter of section number twenty-two, in township number eighteen south, of range number one west, containing one hundred and sixty acres, at the rate of one dollar and twenty-five cents per acre, amounting to two hundred dollars and cents; for which the said Thomas Barnard has made payment in full, as required by law.

Now, therefore, be it known, that, on presentation of this certificate to the Commissioner of the General Land Office, the said Thomas Barnard shall be entitled to receive a patent for the lot above described.

Patent directed by Commissioner to issue, notwithstanding the outstanding patent on the Nooner donation claim, after calling for its surrender through either of the land officers at Little Rock, as in the case of Witherspoon and Edward Doughty. Personally appeared before me, acting justice of the peace for said county, Edward Doughty, who, being duly sworn, upon oath, saith, in the year eighteen hundred and twenty-eight, he was acquainted with the lands now owned by Thomas Barnard; and that in June, eighteen hundred and thirtyfour, he was called on by Barnard to see his improvements of the southeast quarter of section number twenty-two, in township eighteen south, of range one west. That in the year eighteen hundred and thirty-two I planted on the quarter adjoining the one above named, (that Barnard improved,) and that in eighteen hundred and thirty-two Barnard moved on his land with his negroes; and in eighteen hundred and thirty-three said quarter was cleared several acres, fifteen or twenty, and fenced for a crop, and in eighteen hundred and thirty-four, in June, I saw said southeast quarter planted in corn and pumpkins. The said Barnard has continued to keep up cultivation ever since on said farm or lands, and has some four hundred and fifty or five hundred acres in cultivation, and said quarter is comprised in near the centre of said farm. Said quarter has been in cultivation ever since, and is at this time. My knowledge of said improvements are, by living on the adjoining lands ever since Barnard moved on the land or farm.
