§ 3. What salt spring lands can be sold. The salt 2 springs belonging to this state with the salt water exist3 ing on the Onondaga reservation, and the lands con4 tiguous thereto which are necessary and convenient to 5 the use of the salt springs and the public works thereon, 6 shall forever remain the property of the state. Lands 7 reserved or used for the manufacture of salt may be 8 sold as in this chapter, provided, under the direction of 9 the commissioners of the land office, with a view to the 10 exchange of the same for other lands more conveniently 11 located or in large quantity, in which the proceeds of 12 the lands so sold shall be invested; but the aggregate 13 quantity of lands appropriated to the manufacture of 14 salt shall not be diminished by such sale and purchase. 1 §. 4. Duty on salt.- A duty of one cent per bushel on 2 fifty-six pounds, shall be collected and paid to the 3 treasurer upon all salt manufactured in this state.

$5. Onondaga manufacturing districts.- The Onondaga 2 reservation shall be divided into such manufacturing 3 districts as the superintendent may prescribe; and he 4 may establish therein such public offices for the trans5 action of the business connected with the manufacture 6 of salt as he may deem convenient. Such offices shall 7 be kept open every day except Sundays and holidays 8 from sunrise to sunset and during such hours any 9 person may examine the books of entry kept by the 10 superintendent.

§ 6. Superintendent of Onondaga salt springs.-There 2 shall continue to be an officer known as the superin3 tendent of the Onondaga salt springs who shall be 4 appointed by the governor and hold office for the term 5 of three years and receive an annual salary of fifteen 6 hundred dollars.

Before entering upon the duties of his office and within 8 thirty days after notice of his appointment, he shall 9 give an official undertaking in the sum of thirty thou10 sand dollars with at least five sufficient sureties to be 11 approved by and filed in the office of the comptroller. $7. Powers of superintendent.

3 1. Have the possession, government and management of 4 all lands, wood, timber, trees, buildings, erections, pumps 5 and machinery of every kind, and of all water courses, 6 conduits, wells, aqueducts, springs and other property 7 belonging to the state on the Onondaga reservation, and 8 the Montezuma salt springs.

9 2. Superintend and have charge of the salt springs 10 and of the manufacture and inspection of salt and regu11 late and control the delivery of salt water to the salt 12 manufacturers.

13 3. Daily examine or cause to be examined the cisterns 14 attached to the several manufactories in order to dis15 cover any leaks or waste of salt water therefrom or 16 from the logs or conduits leading the water to them and 17 to discover any leak or waste of salt water, either by 18 negligence or design whether in the cisterns, logs or 19 conduits or in the use of the water in any manufactory, 20 or in letting the same into the cisterns, or in any other 21 manner; and shall order the owner or other person 22 occupying such manufactory or his agents or servants 23 who may be present to immediately stop such leak or 24 waste.

Cause any person wrongfully possessed of any land 26 or property on the Onondaga reservation or the Monte27 zuma salt springs to be removed therefrom and take 28 possession of the same and may sue in his name of 29 office for the recovery of damages for any injury to such 30 lands or property according to the nature of such 31 injury.

32 5. Keep in each of his offices regular books of entry 33 in which all of his accounts and transactions shall be 34 entered.

35 6. Provide suitable books of entry, blank books, blank 36 inspection bills, returns, forms and other stationery for 37 the use of himself and his deputies in the performance 38 of their official duties.

39 7. Receive all moneys payable to the state for the 40 duties, rents, fines or penalties specified in this chapter 41 or arising from the salt springs or property of the state 42 connected with the salt manufacture.

43 8. Deposit each week to the credit of the state 44 treasurer in such bank or banks as may be designated 45 by the comptroller all moneys received by him as super46 intendent and transmit every Monday to the comptroller 47 a statement showing the amount of the revenues 48 collected, received and deposited during the preceding 49 week.

50 9. Forward a statement to the comptroller on the first 51 Monday in each month exhibiting the whole amount of 52 revenue collected during the preceding month, and the 53 amount in each week, with a transcript of the receiver's 54 books in each of the manufacturing districts. 55 10. Prosecute in the name of the state all persons who 56 shall knowingly trespass upon or injure any of the lands 57 or property belonging to the state or who shall willfully 58 damage any of the machinery, erections, fixtures or other 59 property of the state and for the recovery of all such 60 sums forfeited to the state.

61 11. Make a report annually to the comptroller on Sep62 tember thirtieth or within ten days thereafter, stating 63 the quantity of salt inspected during the previous year, 64 the amount of revenues accruing thereon and from other 65 sources, the expenditures made by the superintendent, 66 and the amount which in his judgment will be necessary 67 for the support of the salt springs for the ensuing year. 68 12. Make a report annually to the legislature on or 69 before January fifteenth, of his doings during the pre70 ceeding year embracing such information in regard to 71 the manufacture of salt and the situation of the public 72 works and submitting such recommendations for their 73 further improvement and extension as he shall deem 74 necessary and proper.

75 If the superintendent neglect to make the monthly 76 returns required by this section or to make or transmit 77 the certificate of such deposits to the comptroller, the 78 comptroller shall order the superintendent's bond to be 79 put in suit for the recovery of any moneys which may 80 be in his hands belonging to the state and such neglect 81 or omission of duty shall be deemed cause for the 82 removal of such superintendent by the governor.

$8. Further powers and duties of superintendent.— The 2 superintendent may :

3 1. Lease for not more than three years any of the lots 4 or lands of this state reserved for the manufacture of 5 salt and not lawfully held or occupied for that pur6 pose; but unoccupied grounds in the immediate 7 vicinity of a pump-house or other public works shall 8 hereafter be reserved for the use and convenience of the 9 state, and no lands so leased shall be underlet or used 10 by the lessee, and if so underlet or used the lessee shall 11 forfeit his interest in such lands.

12 2. Take possession of and occupy the lands and tene13 ments or any spring or well of salt water belonging to 14 any person or association or in his or its possession by 15 virtue of any lease or grant thereof, given or to be given 16 under any law of this state, which may be necessary for 17 the construction or erection of any reservoir, aqueduct, 18 pump, pump-house or other buildings therewith con19 nected, or for providing and furnishing the necessary 20 supply of salt water as directed by this chapter or for 21 procuring convenient access thereto, and the owner of 22 property so taken shall be paid the reasonable value 23 thereof to be fixed by agreement between him and the 24 superintendent; but in case of a well, not to exceed its - 25 original cost; and if the superintendent is unable to 26 agree with the owner for the purchase thereof, he may 27 acquire title thereto in the name of the state by con

28 demnation. The superintendent shall pay the amount 29 of damages so agreed upon or awarded, and the expenses 30 of the appraisers, if any be employed, and charge the 31 same in his account.

32 3. Administer oaths to his deputies, foremen and 33 employes in regard to returns of check-rolls and other 34 matters relating to their duties when he shall deem it 35 necessary.

36 4. Require the officers appointed by him to perform 37 such duties and services in behalf of the state as he may 38 consider appropriate and necessary and remove them 39 or either of them from office.

40 5. Establish and from time to time alter the bounda41 ries of the inspection districts so as to allow of the 42 inspection of salt at the offices most convenient to the 43 officers in charge and to the owners of the salt works. R. S., 795, § 8. (Post, p. 3094.)

$9. Rules and regulations.-The superintendent shall 2 annually, in the month of April, adopt rules and regula3 tions for the guidance and direction of the salt manu4 facturers for the ensuing year, and may also, from time 5 to time, establish such rules and regulations, not incon6 sistent with law, as he may deem expedient respecting: 7 1. The manufacture and inspection of salt and the col8 lection of duties thereon.

9 2. The manner and order of receiving salt water from 10 the state reservoirs and aqueducts, the mode of conduct11 ing it to the respective manufactories and erections and 12 securing it from waste and loss.

13 3. The examination of the several salt works and 14 manufactories by his deputies to determine whether the 15 provisions of the law are properly complied with.

4. The loading of salt in bulk, or otherwise, into boats 17 to be transported upon the canals, or the shipment of 18 salt by railway, or otherwise, to be conveyed to market.
