AN ACT

To constitute the village of Middlebury, in the county of Summit, an election district.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That in all elections of electors of president and vice president of the United States, of governor, representatives to congress, senators and representatives to the general assembly, and the several officers of the county of Summit, the village of Middlebury, in the county of Summit, shall be and the same is hereby declared to be an election district.

SEC. 2. That all elections to be holden under this act, and under the election laws of this state, the trustees of the village of Middlebury shall serve as judges, and the recorder of said village, and such other person as the judges shall choose having the qualifications of an elector, shall serve as clerks of the election, who, together with the judges aforesaid, shall receive one dollar per day, each, as a compensation for their services, to be paid out of the treasury of the county of Summit.

SEC. 3. That at all elections to be holden under this act, the judges and clerks of election are to be subject to, and governed and controlled by, the same laws as are the judges and clerks of the several election districts of this State.

AN ACT

To change the name of the German Catholic Cemetery Association of Cincinnati.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That the name of the German Catholic Cemetery Society, of Cincinnati, incorporated March tenth, one thousand eight huundred and forty three, be and the same is hereby changed to the German Catholic Congregation, of Cincinnati, and that the said society, by that name, shall possess and enjoy all the rights and privileges, and shall be subject to all the restrictions and limitations contained in said act of incorporation.

SEC. 2. That said incorporation shall be entitled to hold all property heretofore conveyed to or acquired by said corporation, and shall be liable for all debts contracted under its former name, which are now, or shall hereafter become due and remain unpaid, provided that no suit commenced against said corporation shall abate on account of said change of name.

AN ACT

To revive and continue the act to incorporate the Cincinnati Whitewater Canal Company.

Whereas, the Cincinnati and Whitewater Canal Company have been prevented by a breach in the tunnel on the canal from putting the same into complete operation within the time allowed by their charter; and, whereas, the said canal has now been fully completed and put in operation; therefore,

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That the said act of incorporation, and the time allowed by law for completing the operation, be revived and extended to said company, as fully in all respects as if the said canal had been finished and put into operation within the time heretofore allowed for that purpose.

AN ACT

To lay out and establish a State Road in the counties of Jackson and Scioto:

SEG. 1. Be it enacted by the General Assembly of the State of Ohio, That William Jackson and Samuel Boggs, of the county of Scioto, and Samuel Stephenson, of the county of Jackson, be and they are hereby appointed commissioners to lay out and establish a state road commencing at the Jackson Furnace, in Jackson county; thence to the north side of Edward Taylor's improvement, in Scioto county; thence to the south side of the improvement lately owned by Robert Snodgrass; thence to the north or south side of Elijah Browning's and John White's improvements; thence to intersect the county road leading from Oakhill to Bloom Furnace, at the school house, number three, in Jefferson township, Jackson county, near the Black Fork Bridge.

SEC. 2. That the commissioners, named in the first section of this act, shall be governed in all respects by the law now in force defining the mode of laying out and establishing state roads, passed March fourteenth, one thousand eight hundred and thirty one, and the act amendatory thereto, passed March twentieth, one thousand eight hundred and forty one.

SEC. 3. That if either of the commissioners aforesaid shall die, refuse to serve or remove out of their respective counties, the commissioners of the county where such vacancy may happen, shall, on application being made, fill such vacancy as often as it may occur.

AN ACT

For the sale of School Section Sixteen, in Washington Township, Hancock County.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That section sixteen in said township is hereby authorized to be sold according to the provisions of an act entitled "an act to regulate the sale of ministerial and school lands and the surrender of permanent leases thereto," passed February second, one thousand eight hundred and forty three; provided that said lands shall not be sold for less than five dollars per acre, nor less than the appraised value thereof.

AN ACT

To incorporate the Geneva Manufacturing Company.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That Heman P. Castle, John M'Cook, Perry Gee and Parley W. Gee, and their associates, be and they are hereby constituted and declared to be a body politic and corporate, to be known and distinguished by the name and style of the Geneva Manufacturing Company, and, by that name, they and their successors shall be a body politic and corporate, capable of contracting and being contracted with, suing and being sued, defending and being defended in all courts and places, in all manner of suits, actions, cases, matters and complaints whatsoever, and shall have and make a common seal and alter the same at pleasure; and said company shall, in law, be capable of purchasing, receiving, and holding, and engaging and of granting, selling and conveying, any estate, real, personal and mixed, necessary for promoting the objects of said company, which object is hereby declared to be the manufacture of castings of various kinds, millgearing, cotton and woollen machinery, agricultural implements, and such other articles as they may think proper.

SEC. 2. The stockholders shall have power to make such bylaws and rules for regulating the concerns of said company as they shall think necessary and expedient respecting the management and disposition of the stock, property and estate of said company, and duties of the officers, artificers and agents by them to be employed, the election of directors, and all such matters as appertain to the concerns of said company; provided, that such bylaws be not inconsistent with the constitution of the United States and of this state.

SEC. 3. The capital stock of said company shall not exceed twenty five thousand dollars, to be taken in shares of one hundred dollars each, to be subscribed for and paid at such time and in such proportion as shall be prescribed

by the bylaws and rules of said company, and that the stock of said company shall be considered personal estate, and in no case applied to banking.

SEC. 4. The stockholders shall be jointly and individually held liable for all the debts of the corporation; and as soon as five thousand dollars are subscribed the said company shall have liberty to meet and elect their officers and to go into possession of their chartered privileges.

SEC. 5. That said association shall be subject to all the provisions of the act entitled "an act instituting proceedings against corporations not possessing banking powers and the visitorial powers of courts, and to provide for the regulation of corporations generally," passed March seventh, one thousand eight hundred and forty two.

AN ACT

Speaker of the Senate.

To extend to the members of the Washington Fire Engine Company, of the town of Mount Vernon, the benefits of an act entitled "an act to encourage the organization of Fire Companies," passed March 13, 1843.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That all the privileges and exemptions named in the act entitled "an act to encourage the organization of Fire Companies," passed March thirteenth, one thousand eight hundred and forty three, and by said act conferred upon and secured to the members of fire companies, organized and under the control of the corporate authorities of cities and incorporated towns within this state, be and the same are hereby extended to, and conferred upcn, the members of the Washington Fire Engine Company, in the town of Mount Vernon, in the manner therein provided, except that the certificate required by the act aforesaid, to be presented to the clerk or recorder of an incorporated town, shall be presented to the clerk of the court of common pleas for the county of Knox, who shall give his certificate as is required by the act aforesaid, to be given by the clerk or recorder of other towns; and such certificate shall be received in all courts and places as evidence that the person, legally holding the same, is entitled to the exemptions named in the act aforesaid.

AN ACT

To authorize the County Commissioners of Summit County to levy an additional tax for County purposes.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That the county commissioners of Summit county be and they are hereby authorized to levy an additional tax on the grand levy of said county, not exceeding in any one year the sum of three mills on the dollar, for county purposes.

SEC. 2. That the sum so assessed and collected shall be expended in the current expenses of the county, and in the redemption of orders drawn on the treasurer of said county.

AN ACT

To establish a Free Turnpike Road from New Philadelphia, in the county of Tuscarawas, to the Ohio River, opposite Wellsburg, in Virginia.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That Thomas Odbert, Smiley H. Johnson, Matthew Thompson, Nat Dawson, of Jefferson county, Alexander Bines, Thomas Coplen, James Paten, of Harrison county, Samuel Dunlap and Thomas Price, of Carroll county, be and they are hereby appointed commissioners to lay out and establish a free turnpike road from New Philadelphia, in Tuscarawas county, through the towns of Leesburg and New Hagerstown, in Carroll county, and from thence to New Alexander, in Jefferson county, and from thence with the graded road to the Ohio River, opposite Wellsburg, in Virginia, which shall be constructed, repaired, and preserved in the manner pointed out in this

act.

SEC. 2. The said trustees shall appoint a superintendent or superintendents, and such other agents as they may deem necessary to carry into effect the provisions of this act; they shall keep a record of their proceedings, and a majority shall be a quorum, and shall be competent to exercise any of the powers herein granted.

SEC. 3. The said trustees shall meet in the town of Bloomfield, in Jefferson county, on the second Monday in May next, or at any time within one month thereafter, and organize by choosing one of their number to be president of said board; and they shall then take measures to view, locate and establish said road, and of all such locations they shall cause true copies to be filed in the auditor's office of the proper county.

SEC. 4. The said trustees shall have power to receive subscriptions and donations in money or property, real or personal, which shall be applied to
