On motion of Mr. Long,

Ordered, That said report do lie on the table.

Mr. Hamilton, from the committee on the Judiciary to which bill No. 7, (of this House) was referred, entitled " a bill to pro. vide for the punishment of embezzling public money," reported the same with several amendments.

Which was read the second time.

Mr. Hamilton, from the same committee, to which bill No. 5, of this House was referred, entitled "a bill concerning justices of the peace," reported the same without amendment.

The House proceeded to consider the message on the table, when the undermentioned bills from the Council were read the first and second times, to wit:

No. 13, "a bill fixing the time of holding the annual sessions of the Legislative Assembly and for other purposes," and

No. 16, "a bill to repeal so much of the several acts of the Legislative Assembly of this Territory as authorizes the sale of any portion of the lands granted to the Territory by the act of Congress of June 18, 1838, to aid in the construction of the Milwaukee and Rock river canal, and to amend an act approv ed February 19th, 1841, supplementary to the several acts in relation to said canal."

The message of the Council returning bill No. 7, [C. F.] en. titled "a bill to authorize Henry Thien to build a dam on the Milwaukee river," with non-concurrence in the amendments of the House, was read, when on motion of Mr. Hamilton, the same was referred to the committee of the whole House.

The House then resolved itself into the committee of the whole House, Mr. Tripp in the chair, having the message of the Coun. cil relative to the said bill under consideration. After somo time the committee rose and reported that the committee had made some progress and desired leave to sit again, which was granted.

Mr. Long, from the joint committee on enrolment, made the following report:

The committee of enrolment report that they did on this day present to His Excellency the Governor, for his approval, reso. lutions entitled "joint resolution to authorize the cancelling of certain canal bonds," and that they were requested by his Excellency to report that he did not receive them.

On motion of Mr. Meeker,

Ordered, That bill No. 1, entitled "a bill to change the time of holding courts in certain counties of the second judicial dis. trict," be referred to the committee on the judiciary. And then the House adjourned until 2 o'clock, P. M.

TWO O'CLOCK, P. M.

On motion of Mr. Hamilton,

Ordered, That the Council be requested to transmit to this House all petitions relating to bill No. 7, (C. F.) entitled “a bill to authorize Henry Thien to build a dam on the Milwaukee river."

Mr. Capron offered the following resolution:

Resolved, the Council concurring, That a committee of three from each House be appointed to confer with the Ex. ecutive relative to the disagreement between the Executive and Legislative Assembly.

Mr. Walker moved that the resolution be rejected.
Pending the question on the resolution, and

On motion of Mr. Manahan,

A call of the House was made, and the sergeant-at-arms sent to procure the attendance of Messrs. Agry, Judson and Meek

er.

The sergeant-at-arms reported that Mr. Agry was indisposed, and that Messrs. Judson and Meeker were in their seats.

Mr. Platt moved that the sergeant.at-arms be directed to bring Mr. Agry to the House.

Which was agreed to; and

A division being called, there were ayes 18, noes not counted.

Mr. Agry having appeared in his seat, further proceedings in the call of the House were dispensed with.

The question was then taken on the motion of Mr. Walker to reject the resolution and determined in the negative.

And the ayes and noes having been called for,

Those who voted in the affirmative, are

Messrs. Crossman, Masters, Platt, Parsons, Tripp, and Walk. er-6.

Those who voted in the negative, are,

Messrs. Agry, Bartlett, Capron, Darling, Elmore, Hamilton, Hicks, Hopkins, Hunkins, Judson, Long, Manahan, Meeker, Olin, Palmer, Price, Thompson, Trowbridge, Van Vleet and Ellis, (Speaker.)--20.

The question then recurred on the adoption of the resolution, And the ayes and noes being called for,

Those voting in the affirmative, are

Messrs. Agry, Bartlett, Capron, Darling, Elmore, Hamilton, Hicks, Hopkins, Hunkins, Judson,Long, Manahan, Meeker Olin, Palmer, Price, Thompson, Trowbridge, Van Vleet, and Ellis, (Speaker.)-20.

Those who voted in the negative, are

Messrs. Crossman, Masters, Platt, Parsons, Tripp, and Walker-6.

So the resolution was adopted.

On motion of Mr. Tripp,

Resolved, That the committee to be appointed to wait upon the Executive be instructed to make a written report, and that such report be submitted to the Executive for his approval before it is submitted to the two Houses.

The Speaker appointed Messrs. Capron, Hunkins and Darling of the committee on the part of the House (under the said resolution.

Mr. Meeker obtained leave of absence for this afternoon.

On motion of Mr. Hamilton,

Leave of absence was granted Mr. Agry for this afternoon. On motion of Mi, Darling,

Bill No. 6, (H. of R. file,) "a bill to divide the town of War. ren in the county of Milwaukee, and to establish the town of Nemahbin," returned from the Council with amendments, was referred to the committee of the whole House.

The House then went into committee of the whole for the consideration of the said bill, Mr. Hamilton in the chair.

And pending the report of the committee the secretary of the Council being announced, the Speaker took the chair, when the following message was received;

"Mr. Speaker-In pursuance of a request of this House, I am directed by the Council to transmit the petition of Henry Thein relative to a dam across the Milwaukee river, which I herewith present.

The committee again resumed their session, and after some time spent therein, the committee rose and reported the bill back with amendments to the amendments of the Council. Which were concurred in by the House.

On motion of Mr. Hamilton,

The committee of the whole again resumed its session on bill No. 7, (C. F.) entitled, "a bill to authorise Henry Thien to build a dam on the Milwaukee river," Mr. Tripp in the chair.

After a short time the committee rose, and Mr. Tripp report. ed that the committee of the whole recommend that the House insist on its amendment.

On motion of Mr. Hamilton,

A call of the House was made, when it appeared that Messrs. Hunkins, Judson, Olin, Palmer, Trowbridge, and Van Vleet were not in their seats.

On motion of Mr. Long,

Mr. Judson was excused from further attendance on the House this afternoon on account of illness,

The sergeant-at-arms was sent to notify those absent without leave that their attendance was desired in the House.

Several of the absentees having taken their seats, further proceedings in the call of the House were dispensed with.

The question was then put in these words,
"Will the House insist on its amendment?"
And the ayes and noes being called for,

Those who voted in the affirmative, are

Messre. Bartlett, Capron, Crossman, Darling, Hamilton, Hicks, Long, Manahan, Masters, Meeker, Olin, Price, and Ellis, (Speaker)-13.

Those who voted in the negative, are

Messrs. Elmore, Hopkins, Hunkins, Platt, Parsons, Thompson Tripp, Trowbridge, Van Vleet and Walker-10.

On motion of Mr. Darling,

The House took up the report of the committee on enrolment, relative to the presentation to the Governor of "joint resolution to authorize the cancelling of certain canal bonds," and on his motion the following resolution was agreed to:
