Messrs. Jenkins, Bracken and Shew.

On motion of Mr. Billings,

The House resolved itself into the committee of the whole, Mr. Baldwin in the chair, for the consideration of bills from the Council of the following titles, to wit:

No. 8, "A bill to create the office of superintendent of common schools, and to prescribe the duties of said office ;" and,

No. 10, "A bill to divide the town of Delevan, and for other purposes.

After some time the committee rose and reported the said bills without amendment.

Mr. Street moved to amend bill No. 8, by striking out the ninth specification in section 3, which was disagreed to.

Message from the Council by their Secretary:

"Mr. Speaker-The Council have passed the following bills, in which they request the concurrence of the House, viz:

“No. 25, A bill to amend an act entitled An act to change the corporate limits and powers of the town of Milwaukee;' and,

"No. 26, A bill to amend an act entitled 'An act to prescribe the mode of proceedings in chancery, and for other purpo

The question then recurred on ordering bill No. 8 to a third reading, and the ayes and noes being called, there were ayes 7,

noes 16.

Those who voted in the affirmative were, Messrs. Baldwin, Blackstone, Bracken, Brunson, Craig, Cruson and Street.

Those who voted in the negative were, Messrs. Beardsley, Childs, Conroe, Dewey, Hoyt, Jenkins, Longstreet, McGregor, Newman, Shew, Sholes, Stevens, Story, Sutherland, Wells and Whiton, speaker.

So the said bill was lost.

Bill No. 10 was then ordered to a third reading.

Mr. Street presented the account of John W. Griffith, sheriff of Clayton county, for taking census.

Ordered, That the said account be referred to the committee

on claims.

On motion of Mr. Sholes,

The House adjourned.

MONDAY, December 30, 1839.

Mr. Stevens presented petitions from citizens of Racine county, relating to the seat of justice of said county.

Ordered, That the same be referred to the committee on the judiciary.

Mr. Story presented the petition of citizens of the town of Brookfield, praying that said town may be divided, and moved that the same be referred to a select committee.

The Speaker appointed Messrs. Story, Ray and Longstreet, said committee.

Mr. Bracken presented the petition of William R. Smith, and others, in relation to the duties on imported lead.

Referred to a select committee, consisting of Messrs. Bracken, Baldwin and Jenkins.

Mr. Sutherland presented remonstrances from citizens of Dane county, against authorizing an additional term of the court to be held in said county.

Which were read and laid on the table.

Mr. Street, from the committee on corporations, reported bill No. 31, entitled

"A bill to incorporate the wardens and vestrymen of Trinity Church, at Mineral Point."

Which was read a first and second time and ordered to be printed.

Mr. Longstreet, from the joint committee on enrolment, reported that the said committee did, on the 28th inst., submit to the Governor, for his approval, "A memorial to Congress relative to confirming the titles to lots one, two and three, of section thirtytwo, town seven, range twenty-two east."

Mr. Bracken offered the following resolution, which was adopt

ed:

Resolved, That the president of the Milwaukee and Rock river canal company, be requested to furnish to this House the plans and drawings of said canal, and estimates of the cost of constructing the same, now in his possession.

Mr. Wells, from the committee on the judiciary, reported bills, which were read a first and second time, and ordered to be printed, entitled as follows, viz:

No. 32, "A bill in relation to assessors.'

No. 33, "A bill relative to the writ of mandamus, and for other purposes."

No. 34, "A bill relating to strays."

Mr. Story presented the account of Horatio N. Wells, Attorney-General of the Territory, for services rendered and expenses incurred in commencing suit against the Bank of Wisconsin, and moved that the same be referred to a select committee.

Ordered, That the said account be so referred.

The Speaker appointed Messrs. Story, Bracken and Shew, said

committee.

The Speaker laid befere the House a message from the Executive, notifying the House that he had this day approved and signed "A memorial to Congress relative to confirming the titles to lots one, two and three, of section thirty-two, town seven, range twenty-two east."

Mr. Street moved that the House do reconsider the vote of Saturday last, by which the communication from Thomas Fawcett, and others, was referred to a select committee.

The ayes and noes being called on the question to reconsider, there were ayes 9, noes 17.

Those who voted in the affirmative were, Messrs. Bracken, Craig, Cruson, McGregor, Newman, Shackelford, Shew, Story and Street.

Those who voted in the negative were, Messrs. Baldwin, Beardsley, Blackstone, Billings, Brunson, Childs, Conroe, Dewey,

Hoyt, Jenkins, Longstreet, Ray, Sholes, Stevens, Sutherland, Wells and Whiton, speaker.

So the motion to reconsider was lost.

Mr. Childs, from the committee on engrossed bills, reported the following to be correctly engrossed, viz:

No. 18, "A bill to repeal an act entitled 'An act to change the corporate limits and powers of the town of Green Bay.'"

No. 23, "A bill to annual the marriage contract of Joseph R. Brown and Margaret Brown ;" and,

No. 24, "A bill to provide for the support of common schools, and for other purposes.'

The House then proceeded to the orders of the day, being bills, &c., on their passage, when

No. 18, "A bill to change the corporate limits and powers of the town of Green Bay," was read a third time, passed, and the title thereof agreed to.

No. 23, "A bill to annul the marriage contract of Joseph R. Brown and Margaret Brown," was read a third time, and the ayes noes being called for, by Mr. McGregor, on the question of its final passage, there were, ayes 14, noes 12.

Those who voted in the affirmative were, Messrs. Beardsley, Billings, Bracken, Brunson, Childs, Craig, Dewey, Hoyt, Longstreet, Shackelford, Sholes, Stevens, Street and Wells.

Those who voted in the negative were, Messrs. Baldwin, Blackstone, Conroe, Cruson, Jenkins, McGregor, Newman, Ray, Shew, Story, Sutherland and Whiton, speaker.

So the said bill was passed, and the title thereof was then agreed

No. 24, "A bill to provide for the support of common schools, and for other purposes," was read a third time, passed, and title thereof agreed to.

Ordered, That the clerk request the concurrence of the Council in the said several bills..

"Have concurred in resolution No. 10, of this House, entitled Resolution relating to the appointment of Samuel B. Knapp fiscal agent,' with amendments thereto, in which the concurrence of this House is requested.

"And have non-concurred in the amendment of this House to bill No. 15, entitled A bill to prevent the sale of intoxicating li quors to Indians.

"The Governor has notified the Council that he did on this day approve An act to provide for the construction of a bridge across the Milwaukee river.""

And then he withdrew.

On motion of Mr. Shackelford,

The House resolved itself into the committee of the whole, Mr. Dewey in the chair, having bills under consideration of the following titles, to wit:

No. 13, "A bill to amend an act concerning judgments and executions ;" and,

No, 21, "A bill relative to the seat of justice of Brown county."

After some time the committee rose and reported bill No. 13 with, and bill No. 21 without amendments.

Mr. Childs called for the ayes and noes on the question of agreeing to the report of the committee on bill No. 13, and, Pending the question thereon,

On motion of Mr. Shackelford,

Ordered, That the said bill do lie on the table.
