Senator DeArmond submitted the following report from the Committee on Judiciary; which was read:

MR. PRESIDENT: Your Committee on Judiciary, to whom was referred Senate bill No. 78, entitled "An act to exempt the husband from the payment of debts of the wife contracted before marriage," beg leave to report that they have considered the same, and recommend that it do pass.

Senate bill No. 78 was taken up and ordered engrossed.

Senator McGrath introduced Senate bill No. 167, entitled "An act concerning the liability of cities, towns and persons for damages to persons or property caused by riots;" which was read first time and 50 copies ordered printed.

Senator Cottey moved that when the Senate adjourn, it adjourn until to-morrow morning at 10 o'clock.

On motion of Senator Caldwell the Senate adjourned.

Senator Rouse presented a petition from citizens of Howard county, Missouri, praying for a change in the time of assessment; which was referred to the Committee on Ways and Means.

Senator Rouse presented a petition from citizens of Randolph county, Missouri, praying for a constitutional amendment prohibiting the manufacture and sale of intoxicating liqurs; which was referred to the Committee on Constitutional Amendments.

Senator Jacobs presented a petition from the merchants of Trenton, Missouri, praying for a change in the revenue law affecting merchants' licenses; which was referred to the Committee on Ways and Means.

Senator Caldwell introduced Senate bill No. 168, entitled "An act relating to township trustee and ex officio collector;" which was read first time and 50 copies ordered printed.

Senator Naylor introduced Senate bill No. 169, entitled "An act to amend section 790, chapter 21, article 2 of the Revised Statutes, entitled 'Railroad companies;'" which was read first time and 50 copies ordered printed.

Senator Mabrey introduced Senate bill No. 170, entitled "An act to amend section 1167, article 4, chapter 23, Revised Statutes of Missouri, relating to circuit courts in the 231 judicial circuit of Missouri;" which was read first time and ordered not printed.

Senator Mabrey introduced Senate bill No. 171, entitled "An act to amend section 5608, entitled 'Fees;'" which was read first time and ordered not printed.

PRESIDENT: Your Committee on Judiciary, to whom was referred Senate bill No. 116, entitled "An act to authorize counties having a past indebtedness for the building of court houses and jails to refund the same at a lower rate of interest," beg leave to report that they have considered the same, and report the same back without recommendation.

The following message was received from the House of Representatives through Mr. Hawley, Chief Clerk:

MR. PRESIDENT: I am instructed by the House to inform the Senate that the House has taken up, amended and passed Senate bill No. 57, entitled "An act to amend sections 5371, 5372 and 5407, article 4, chapter 95, Revised Statutes of Missouri, entitled 'Of counties,'” in which the concurrence of the Senate is requested.

Also, Senate bill No. 107, entitled "An act to amend section 4358, article two, chapter 87, Revised Statutes of Missouri, 'Of the restraint of diseased and Texas cattle."

Senator Byrns submitted the following report from the Committee on Criminal Jurisprudence, which was read:

MR. PRESIDENT: Your Committee on Criminal Jurisprudence, to whom was referred Senate bill No. 139, entitled "An act to provide for medical treatment of insane criminals and to appropriate money therefor," beg leave to report that they have considered the same, and recommend that it do pass.

The bill so reported, being Senate bill No. 139, was taken up and ordered engrossed.

PRESIDENT: Your Committee on Judiciary, to whom was referred Senate bill No. 106, entitled "An act to amend section 2956, chapter 44 of the Revised Statutes of Missouri, entitled 'Of justices courts," beg leave to report that they have considered the same, and recommend that the accompanying substitute do pass.

PRESIDENT: Your Committee on Judiciary, to whom was referred Senate bill No. 11, entitled "An act to amend chapter sixty-two (62) of the Revised Statutes of Missouri, entitled 'Of recorders of deeds,"" beg leave to report that they have considered the same, and recommend that the accompanying substitute do pass.

Senate bill No. 11 not being called for, the substitute reported by the Committee was taken up, read first and second times and adopted ordered printed.

Senator Byrns submitted the following report from the Committee on Criminal Jurisprudence, which was read:

MR. PRESIDENT: Your Committee on Criminal Jurisprudence, to whom was referred Senate bill No. 457, entitled "An act to provide and regulate an additional mode of punishment for crime," beg leave to report that they have considered the same, and recommend that with the accompanying amendment it do pass.

Senate bill No. 45 was taken up and the following amendment reported by the committee was read first and second times and adopted: Amend section one by inserting the word "three" in the blank space between the words "of" and dollars."

Senator DeArmond offered the following amendment: Amend section one by inserting immediately after "inflicted," fourth line printed bill, the words for violent assaults upon children, for assaults of whatever degree upon females of any age, for garroting, for the larceny of any animal of the horse or mule kind, for burglary in the first degree, for robbery in the first degree: Provided, That no female shall be punished by whipping," which was read first and second times, and Senator Heaston moved to lay the amendment on the table.

The ayes and noes being demanded, the motion to lay on the table was lost by the fellowing vote:

AYES-Senators Allen, Caldwell, Heaston, Hutt, Jacobs, Manistre, Rogers and Stephens-8.

NOES-Senators Bradley, Bryant, Byrns, Bland, Cottey, DeArmond, Dobyns, Dungan, Edwards of Lafayette, Edwards of St. Charles, Headlee, Heard, Lloyd, McGrath, McMahan, Mabrey, Mackay, Manring, Morrisson, Naylor, Pehle, Perkins, Rouse and Walker-22.

ABSENT Senators Cabell and Gottschalk-2.

ABSENT ON LEAVE-Senators Lloyd and Perkins-2.

The amendment was then adopted.

Senator Heaston moved that the bill be indefinitely postponed. The ayes and noes being demanded, the motion was lost by the following vote:

AYES Senators Allen, Bryant, Caldwell, Edwards of St. Charles, Heaston, Hutt, Jacobs, Manistre, Naylor, Rogers and Stephens-11.

NOES-Senators Bradley, Byrns, Bland, Cottey, DeArmond, Dobyns, Dungan, Edwards of Lafayette, Headlee, Heard, McGrath, McMahan, Mabrey, Mackay, Manring, Morrisson, Pehle, Rouse and Walker-19.

Senator Allen moved to postpone the further consideration of the bill until next Monday.

The ayes and noes being demanded, the motion to postpone was lost by the following vote:

Manistre-6.
