MONDAY, December 16, 1839.

Mr. Wells presented the remonstrance of William Payne, and others, against the construction of a dam at the outlet of Pewau kee lake.

Which was read, and, on motion,

Ordered, That the same be referred to the select committee to which the petition of Asa Clark, and others, was referred on the 6th inst., consisting of Messrs. Shew, Longstreet and Dewey.

Mr. Ray, agreeably to previous notice, by leave, introduced bill No. 10, entitled

"A bill to provide for laying out a Territorial road from Gene va lake to Fon du Lac."

Which was read a first and second time.

Mr. Stevens presented the petition of citizens of Wisconsin, praying that a road may be laid out and established from Southport to Beloit, on Rock river, via Daniel Stevens' house and the Des Plaines river, in section eighteen, town one, range twentytwo.

Ordered, That the same be referred to the committee on roads.

Mr. Baldwin presented the petition of citizens of Iowa county, praying for the location of a road leading from Mineral Point, in said county, to the point on the state line of Illinois where the road from Rockford terminates.

Ordered, That the same be referred to the committee on roads.

Mr. Wells, from the committee on the judiciary, reported bills of the following titles, to wit:

No. 11, "A bill to repeal the 4th section of an act entitled 'An act to restrain unauthorized banking, and for other purpo

No. 12, "A bill to provide for recording contracts relating to lands, and for other purposes."

Which were severally read a first and second time.

On motion of Mr. Wells,

Ordered, That all bills of this House now on the table, and

which have not been considered in committee of the whole, be printed for the use of the members of this House.

Mr. Longstreet, from the joint committee on enrolment, reported that the committee on the 12th instant presented to the Governor, for his approval, resolutions of the following titles, to wit:

No. 5, "Resolution in relation the half-breed lands on Lake Pepin."

No. 6, "Resolution relating to the extension of the military reserve of Fort Snelling to the east side of the Mississippi river."

Mr. Childs, from the committee on engrossed bills, reported resolution No. 8, entitled "Resolution relative to the distribution of the local laws," to be correctly engrossed.

On motion of Mr. Shackelford,

Bill No. 5, entitled "A bill to organize the county of St. Croix," was read a first and second time.

The Speaker laid before the House a communication from the Executive, notifying the House that he did on this day approve and sign enrolled resolutions of the following titles, viz:

No. 5, "Resolution in relation to the half-breed lands on Lake Pepin."

No. 6, Resolution relating to the extension of the military reserve of Fort Snelling to the east side of the Mississippi river."

The Speaker announced that the House would now proceed to the orders of the day, being resolutions relating to the fiscal agency of Moses M. Strong.

Mr. Sholes offered the following substitute for the said resolution :

Resolved, That Moses M. Strong, Esq., who was appointed by the Legislative Assembly, at its session commencing the 26th day of November, 1838, fiscal agent of the legislature, and authorized to borrow the sum of fifteen thousand dollars upon the faith of the Territory, be requested to report to this House as soon as practicable, the manner in which he has performed the duties imposed upon him; what amount and what kind of money was received by him for the payment of the loan made and at what time; whe

ther the debt contracted against the Territory has been paid, and if so, when; together with all such information as may enable the assembly to determine whether he has faithfully discharged the du. ties he was required to perform by the resolution under which he was appointed.

Mr. Shew moved to amend the resolution by adding the following:

Resolved, That the chief clerk of this House be requested to forward a copy of the above resolution as soon as practicable to the said Moses M. Strong, Esq.

The amendment was agreed to.

The question was then put, "shall the substitute for the origi nal resolution pass?"

And was decided in the affirmative.

Mr. Stevens, by leave, offered the following resolution: Resolved, That the serjeant-at-arms be instructed to procure a sufficient number of chairs and desks for the accommodation of the transcribing clerks of this House.

The question being put, "shall this resolution pass?"

It was decided in the affirmative.

Resolution No. 8, entitled "Resolution relative to the distribution of the local laws," was then taken up, read a third tine, passed and the title thereof agreed to.

Ordered, That the Council be requested to concur therein.
On motion of Mr. Childs,

Bills of the following titles, Council file, were read the first and second time, and considered in committee of the whole, Mr. Childs in the chair, viz:

No. 3, "A bill to divide the towns of Kinnikenick and Lisbon, and to change the name of Prairie Village."

No. 5, “A bill to amend an act entitled 'an act to provide for a Territorial revenue.'

After a short time the committee rose and reported the said bills to the House without amendments, which were severally or dered to third reading.

Message from the Council by their secretary:

"Mr. Speaker-The Council have passed the following, in which I am directed to ask the concurrence of this House, viz: "No. 7, A bill to amend the act entitled an act to provide for and regulate general elections;'

"No. 1, Memorial to Congress relative to mineral lots and reservations; and,

"No. 3, Memorial to Secretary of War, for the construction of a military road from Fort Howard to Fort Snelling.'"

"And have concurred in a resolution of this House, (No. 7,) .entitled

"Resolution relative to the committees on public buildings."" And then he withdrew.

On motion of Mr. Street,

The House went into committee of the whole, Mr. Billings in the chair, for the consideration of resolution No. 2 from the Council, entitled

"Resolution relating to the public printing."

After some time the committee rose and reported the said resolution with amendments.

The first and second amendments, reported by the committee, were concurred in by the House, and on the question of agreeing to the third amendment,

A motion was made by Mr. Sholes, that the House do disagree to the third amendment, which amendment provided that the incidental printing and the Journals be equally divided between the printers at Madison.

Mr. Beardsley called for the ayes and oes on the question, "Will the House disagree to the said amendment?" which were taken and were as follows:

Ayes-Messrs. Conroe, Jenkins, Sholes, Street, Wells and Whiton, speaker-6.

Noes-Messrs. Baldwin, Beardsley, Billings, Bracken, Brunson, Childs, Craig, Cruson, Dewey, Hoyt, Longstreet, McGregor, Newman, Ray, Shackelford, Shew, Stevens, Story and Sutherland** -19.

So the amendment was agreed to.

The said resolution was then ordered to be read the third time.

Mr. Longstreet gave notice that, on some future day, he should beg leave to introduce a bill to amend an act concerning judg ments and executions.

Mr. Conroe gave notice that, on a future day, he should ask leave to introduce a bill to authorize the construction of a dam across the Manitowoc river.

Mr. Childs moved to adjourn, and the question being put,

It was decided in the negative.

Mr. Shew moved to adjourn until 3 o'clock P. M., which was agreed to.

So the House adjourned until 3 o'clock P. M.

AFTERNOON SESSION.

Three o'clock.

On motion of Mr. Sholes,

Memorials and a bill from the Council were read a first and second time, entitled as follows:

No. 1, "Memorial to Congress relative to mineral lots and reservations.'

No. 3, "Memorial to Secretary of War for the construction of a military road from Fort Howard to Fort Snelling;" and,

No. 7, "A bill to amend the act entitled an act to provide for and regalate general elections." "

On motion of Mr. Story,

The House resolved itself into committee of the whole, Mr. Story in the chair, having under consideration the said memorials and bill.

After some time the committee rose, and by their chairman reported the said memorials and bill to the House, with amendments.

The House agreed to the amendment to Memorial No. 1.
