Mr. Longstreet presented the petition of Benjamin Nute, and others, praying to be authorized to construct a dam across the west branch of Rock river, in town seven, range fourteen, on sec. tion four, and moved that it be referred to the select committee which reported bill No. 16, and that said bill and all petitions and papers relating thereto be referred back to said committee.

So referred.

Mr. Ray, from the committee on claims, to which was referred the accounts of J. P. Rogers, and Thomas Watson & Son, for printing, reported the same back to the House, and moved that the accounts be referred to the joint committee on public printing.

Ordered, That the accounts be so referred.

Mr. Sholes, from the select committee, to which a petition from the inhabitants of Navarino and Astor was referred on the 9th inst., reported the following, viz:

No. 18, "A bill to repeal an act entitled 'An act to change the corporate limits and powers of the town of Green Bay.' Which was read a first and second time, and

Ordered, That the same do lie on the table and be printed. The Speaker laid before the House the report of Moses M. Strong, fiscal agent of the Territory, called for by a resolution of this House on the 16th inst., which was read.

On motion of Mr. Childs,

Ordered, That 150 copies of the said report be printed for the use of this House.

The House then proceeded to the orders of the day, being bills, &c., on their third reading.

No. 4, entitled "A bili to establish certain ferries therein named," was then read a third time.

On the question "shall this bill pass ?" the ayes and noes were called for by Mr. Jenkins, and were as follows:

Ayes-Messrs. Billings, Bracken, Brunson, Childs, Conroe,

Craig, Cruson, Dewey, Hoyt, McGregor, Shackelford, Shew and Street-13.

Noes--Messrs. Baldwin, Beardsley, Jenkins, Longstreet, Newman, Ray, Sholes, Stevens, Story, Sutherland, Wells and Whiton, speaker-12.

The title of the bill was then agreed to.

No. 10, entitled, "A bill to provide for laying out a Territorial road from Geneva lake to Fon du Lac," was read a third time and passed.

The title was amended, by striking out Geneva lake and in. serting Troy.

Ordered, That the Council be requested to concur therein. Mr. Childs, from the committee on engrossed bills, reported the following to be correctly engrossed, viz:

No. 2, "A memorial to Congress relative to confirming the ti tles to lots one, two and three of section thirty-two, town seven, range twenty-two."

No. 12, "A bill to provide for recording contracts relating to lands, and for other purposes."

The said bill and memorial were then severally read the third time, passed, and titles thereof agreed to.

Ordered, That the Council be requested to concur therein. Mr. Brunson, from the select committee, to which was referred the petition of inhabitants of Crawford county, reported bill No. 19, which was read the first and second time, and ordered to be printed, entitled as follows:

"A bill to prevent trespass and other injuries being done to the possessions of settlers on public lands, and to define the right of possession on said lands."

Mr. Childs, from the select committee to which the subject was referred, reported bill No. 20, entitled

"A bill to provide for the location and sale of university lands ;"

Which was read the first and second time and ordered to be printed.

On motion of Mr. Brunson,

The House took up bill No. 1, entitled "A bill to legalize the proceedings of the county officers of Crawford county therein referred to."

And it being read the third time, the question was put, "shall the said bill pass ?"

And the ayes and noes being called for by Mr. McGregor, were taken and were as follows:

Ayes-Messrs. Billings, Bracken, Brunson, Childs, Conroe, Craig, Jenkins, Longstreet, Street, Sutherland and Whiton, speaker-11.

Noes-Messrs. Baldwin, Beardsley, Cruson, Dewey, Hoyt, McGregor, Newman, Ray, Shackelford, Shew, Sholes, Stevens, Story and Wells-14.

So the said bill was lost.

Mr. Wells, by leave, introduced resolution No. 9, entitled "Resolution relating to the fiscal agency of Moses M. Strong." On motion of Mr. Shew,

The following resolution was adopted:

Resolved, That there be a committee appointed of one from each election district, to which shall be referred the report of the committee on internal improvements in relation to the Milwaukee and Rock river canal, together with all other information in relation to said canal that is now in possession of the House, and that the said committee be instructed to report by bill or otherwise.

The Speaker appointed Messrs. Shew, Childs, Stevens, Beardsley, Sutherland, Baldwin, Dewey, and Brunson, the committee under the said resolution.

Message from the Council by the secretary thereof:

"Mr. Speaker-The Council have passed bills as follows, in which the concurrence of this House is requested, viz:

No. 8, A bill to create the office of superintendant of common schools, and to prescribe the duties of such office;' and, "No. 10, A bill to divide the town of Delevan, and for other purposes;'

"And have concurred in a resolution of the House (No. 8) entitled 'resolution relating to the distribution of the local laws.'

“Messrs. Vineyard, Maxwell and Bullen have been appointed the committee on the part of the Council, under the resolution 1elating to the public printing.

"The Governor has notified the Council that he did on this day examine and approve the following:

"An act to divide the towns of Kinnikinick and Lisbon, and to change the name of Prairie Village.'

“An act to amend an act, entitled, an act to provide for and regulate general elections.'

“An act to amend an act, entitled, an act to provide for a territorial reveue;' and,

"Memorial to Secretary of War, for the construction of a mi. litary road from Fort Howard to Fort Snelling.""

And then he withdrew.

Mr. Billings moved to adjourn, which was disagreed to.

On motion of Mr. Shew,

The House adjourned until 3 o'clock P. M.

AFTERNOON SESSION.

Three o'clock.

On motion of Mr. Conroe,

The following bills and memorials from the Council were read the first and second time, viz:

No. 6, “A bill to authorize the building a bridge across the Fox river in the county of Brown."

No. 8, "A bill to create the office of superintendent of mon schools, and to prescribe the duties of said office." No. 10, "A bill to divide the town of Delevan, and for other purposes."

No. 4, "Memorial to Congress for an appropriation for the establishment of a penitentiary."

On motion of Mr. Conroe,

The House resolved itself into the committee of the whole, for the consideration of the following bills, Mr. Sholes in the chair, viz:

No. 14, "A bill concerning attorneys."

No. 15, "A bill to amend an act of the Revised Statutes of 1839, entitled 'An act concerning the supreme and district courts.""

No. 17, "A bill to authorize William H. Bruce, and others, to build and maintain a dam on the Manitouwoc river, and for other purposes."

After some time the committee rose, and reported the said bills to the House, No. 14 without amendment, and Nos. 15 and 17 with amendments.

Mr. Bracken moved to amend bill No. 14, by striking out the first line of the second section, which reads, "He shall be a resi dent of this Territory."

The question being put "shall the amendment be adopt ed?"

And the ayes and noes being called for, by Mr. Wells, there were ayes 6, noes 19.

Those who voted in the affirmative were, Messrs. Billings, Bracken, Conroe, Craig, Jenkins and Stevens.

Those who voted in the negative were, Messrs. Baldwin, Beardsley, Brunson, Childs, Cruson, Dewey, Hoyt, Longstreet, McGre. gor, Newman, Ray, Shackelford, Shew, Sholes, Story, Street, Sutherland, Wells and Whiton, speaker.

So the amendment was not adopted.

The amendments to bills Nos. 15 and 17, were then severally agreed to.

Ordered, That the said bills Nos. 14, 15 and 17 be engrossed and read a third time.

Mr. Bracken, from the select committee to which that portion of the Governor's message was referred which relates to the granting of pre-emption rights to miners, reported the following memorial, which was read a first and second time, viz:

No. 3, "Memorial to Congress concerning pre-emption rights to miners."

Ordered, That 150 copies of the same be printed for the use of this House.
